I have not read the whole thread. So it might have been said.

THE BEST REASON NOT TO SAY ANYTHING IS THAT WHATEVER YOU SAY ISNT WHAT GOES IN THE POLICE REPORT. COPS LIE AND CHANGE WORDS AND SITUATIONS IN POLICE REPORTS TO MAKE YOU GUILTY AND THEM GOOD COPS

fuckers....I really only hate one group of people. I would never befriend a cop. Never done a single good thing for me.

1969 I got pulled over in west texas by a
state trooper I had hair to the middle of
my back he set me in the back seat of his car
after taking my whole wallet he asked a lot of
questions I just said yes SIR or no SIR or I
don't know SIR never asked if he could search
but he did search it pulled a trunk out flipped it
opened and up side down in the ditch never looked
in it just dumped it in the ditch after he empted
my van on the side of road he came n sat in
his car looked at me n said "son I pulled you over
just to bust your head but damn it you won't
give me a reason to" he gave me a speeding
ticket and left since i had 10 lbs in the trunk
I said thank you and took my time reloading
my van lol

My friend got pulled over for not coming to a complete stop at a stop sign. He decided to play the bad boys theme song on his ipod for the officer. He got off with a warning because the officer thought it was amusing. I'm sure it could turn into "you think this is a joke son?" really easily though.

Yes -- this is good advice... I told the cops after I was mirandized and asked if I understood my rights that I didn't understand them... they asked if I understood english... I told them yes. They asked what part of my rights do I not understand. I told them all of them... they asked if I was trying to be smart... I responded "No sir... I realize this is a serious situation and I need a lawyer to explain me my rights" -- they quit asking me any type of questions after this exchange.

however just keeping your mouth shut is prob the smarter route
 
and we all know who the public defender works for, who he gets drinks with after court, and that its the lowest paying of lawyer jobs. another part of this equation. 80% of cases that would go to trial are settled in this country by a plea deal, just saying. watch out.

The cost of an upfront retainer will depend on the lawyer. A few years ago I retained the services of a lawyer in advance. This was like 5 years ago so I could be a little off in the exact amount I gave upfront but it was something like $2500 or so. The lawyer I hired was charging something like $250/hour. Basically the retainer is just prepaid services. In the event that you should get popped and have to call your lawyer he won't give you the "well I need to get paid before I do anything" talk. You get popped, call him and he just bills his hourly rate against what you have already prepaid. Once your retainer has ran out he bills you for services rendered or he might ask for more money once your fund is getting low, again this depends on your lawyer.

Having a lawyer on retainer is freaking awesome and is something everyone should do as soon as humanly possible. I can tell you all from experience there is nothing like walking into the courtroom for arraingnment at 8 am the day after your arrest and seeing your lawyer already there waiting on your ass. It's a relief to say the least. For those of you that don't know your lawyer can file a motion to have your bond reduced or even eleminated all together and for the most part it works (unless of course you spit at the cop or threatened to stick his mom up his ass if he asked you another question). The point is that having a lawyer ready and waiting on your call is extremely helpful. My friend got popped and his bail was automatically set at $60k +. First thing the lawyer did was file a motion to have it reduced and within 4 days of getting arrested he was out on $19k bond vs $60k.

Ive been told by an old head that if you arent able to put away at least $1000 on a retainer for a good lawyer (most need $500 minimum) then you are either in the wrong business, or wasting your time/money and not thinking about your future! You can always have someone u trust ready with that amount as well, but it sure beats a 4am phone call to someone you DONT know - whereas pre-arranging legal services means that they are working for you as soon as you are in need - immediately - and ready the next morning if need be.

You can even say something to them like "now and then I pass along some stuff and want to be prepared in case anything ever goes wrong".. or, less direct, say you do business/contracting etc and need a lawyer ready (though a criminal defense lawyer is what youll need). Usually they wont care/ask what the potential services are for or wont press you about it if youd rather not say.. for peace of mind u can ask them to go over their privacy rules and confidentiality priviliges etc. also the retainer can be given back to you if you dont ever use it / need it - they would prob only charge a small admin fee to write the check back to you (as they would have earned some interest on it and had the extra cash-flow benefit during the time they had your money so its almost like a bank (and insurance policy) in a way! a good place to keep some money also if you are lucky enough to be in that situation - as it shouldnt all be in a bank or safe deposit box etc - or in the home even (no fire/theft insurance for cash plus its gone if you ever get busted and makes case against u worse!) u gotta be creative with these aspects of your life and business/hobby.

this thread is great - hammers home the basic idea of not incriminating yourself. dont do their job for them! even travelling with stuff in trunk instead of inside vehicle offers extra level of protection - I believe a warrant is ALWAYS needed to search it (unless someone is calling "help" from inside, lol... so make sure they are unconscious!!) unlike smelling pot and using the "crime in progress" clause to search the interior.

just remember only the odd cop will throw out or take your weed and let you go - and only if its just a few g's and prob only in larger cities; happens all the time to my cuz - says they usually have a film container to stuff the nugs in, with other ppl's stuff already in there too! prob puffin it later and laughing with each other about making the kids pee themselves! haha.. but thats only like a g or 2... and not all popes do that.. i know of peeps in small town getting written up for a joint or a few roaches even! USUALLY it gets tossed/stayed, but sometimes they get a fine or sommunity service and a discharge... usually no ACTUAL record (I was charched from a 2-bag, 2-stain find made by a piggy in Saskatchewan when I was passin through and stopped on an unrelated matter - pled "no contest / guilty" and had it moved to a larger city in my province and had it promptly conditionally discharged with 50hrs community service and 12-month's of unsupervised probation (meaning that it would become a conviction if |I got into any legal trouble in the next year and/or didnt complete my comm service - which incidentally was with a HUGE stoner boss who got me ripped all the time and was not really picky about time inputs or working too hard... worked out pretty good actually)

tho i have no idea how harper and the conservatives have affected things recently - this was a summer 2005 charge settled in Jan 07 I believe (f-ing legal system!) - it was at least a year even with the plea to change venues (otherwise I would have been up infront of hicktown hanging saskatchewan judge who i was told NEVER not convicted anyone on a pot charge)...

oh yeah and cop even asked if I was travelling artound funding my trip by selling!!! HAHAHAHA. because I had an eight in 2 separate bags of 2 kinds collected during a trip out to Van Island... geez! he had it spread out on the table like some big find - prob highlight of career!!!

You are 100% correct, Thirtyshort! I worked as a legal secretary almost 20 years in the D/FW area of Texas. There is simply no comfort like knowing you have an attorney on retainer like a "rainy day fund," or an extra month's paycheck in the bank.

I rather dislike attorneys (doctors too), but have to admit they are loyal to the dollar. As one working in the legal field, I've seen them at their worst, believe me. Still, there's something about that basic greed that assures a basic level of loyalty when one has a prepaid trust account with a competent attorney.

This played out for me long after I quit my day job at the law firm. In 1994, I had to make the choice to go full-time working from home for my medical transcription business. (Hmmm... $90/hr here, $12/hr there?? No contest.)

I was making my own meds at that time, so I thot it wise to contact one of the most competent attorneys in town for drug offenses, whom I knew from experience would do me right.

Five years later, in the middle of my lovely White Widow grow, I was surprised at home. Two guys looking like they wanted to mow my lawn were at the door (I had a migraine & was in my bathrobe & jammies). I talked to them thru the speaker of my full-length glass door. They kept motioning that they could not hear me. Finally, stupidly (pain will do that to you), I opened the glass door about 3 inches & told them I had a regular man who cared for my lawn. THE VERY MOMENT I CRACKED THE GLASS DOOR OPEN, the guy in back said, "I smell marijuana!" and they knocked me to the floor where I passed out, unconscious.

When I came to, they were roaming thru my house. I thot they were looking for things to steal to pawn for crack or something. All I could see were starbursts of pinkish white against blue/black background due to the tunnel vision of my migraine. After 20 minutes or so, they sat me at my kitchen table & told me what they were there for.

Wow! Then, they asked "permission" to search my home which they had already roamed thru while I was out cold. They said they had enough to get a warrant, etc. & were threatening me. All I could feel at the time was pain. They had knocked me to the floor, bumping my head against the wall & injuring my neck which already had 3 fractures. I was dazed & not in control. I agreed to the search, as they assured me the warrant would be arriving shortly.

After the Metro Squad & K-9 had left, I was left in the company of
a lady cop while waiting for them to finish up, resigned to being arrested. Phone rang & I told my daughter-in-law what had happened so she could contact my husband. He called & headed home. The cops kept trying to say they would include them in the charges, but I knew that was an empty threat.

The officer who arrived to escort me to jail actually apologized to me & placed cushions from my sofa in the back of the cruiser to soften the ride to our county seat. I was allowed to take a last dose of my pharmaceutical pain meds, altho I could not bring them with me to jail.

As I was being booked in, the deputy could not spell the names of my different medical conditions or the names of the prescription drugs I was taking. By this time, having a fresh load of Rx on board, I was feeling a bit better & offered to do the computer work for her. So, I ended up typing my own booking form. All the while I was working I was thinking, "Wow, this woman's education is way below mine..." And all the time she kept apologizing to me, saying, "You really don't need to be here."

Next, I was taken to be patted down & given a jail outfit to wear. They would not allow me to keep my ragged old fuzzy blue bathrobe for warmth. I ended up freezing on a concrete floor with a yoga mat under me & a horse blanket over me.

Before I knew it, my "angels" appeared - a hooker & a girl in for cocaine. They gave me a bunk to rest in & loaned me their blankets. One helped me figure out how to work the sink & toilet & another warned me about the food, what not to eat.

I was surrounded with the worst of the worst - mostly drug offenders & hookers in a cell containing 50+ women. They showed me nothing but kindness & concern.

Four hours later, my husband arrived, saying my prepaid attorney had posted my bail (after having it dropped from $100,000 to $10,000). And the lady deputy appeared, saying, "Wake up, honey. You're going home. You never should have been in this place."

Anyway, other than having to call in to my bail bondsman every Friday, my life went on as normal until I learned that the charges had been dropped.

I was very lucky to have had that attorney on retainer. More, he was a man I knew & trusted.

Having an attorney on retainer (a man you respect & trust to do a good job for you "just in case,") is priceless.
