What happens if seeds gets snagged by customs in eu?

If you receive seeds from a seller outside eu and they get detained because of wrong declaration and missing phyto certificate, what will be the next step? Will you be fined, charged with something or what will happen? And what is the best way to handle this?

Seeds are legal in my country but not germination. So they are not seeds meant for planting but for collection items only, so do I even need a phyto certificate for that? Do you need to prove your intention? Is it best just to go along with the decision already made instead of fighting it?

You are also welcome to share any tips or experiences regarding import/export of seeds inside or outside of eu or any relevant info/questions you would like to share/ask.

Or if you could point me in a direction where this has already been discussed that would also be great! Ok I am done editing now (I think)!

Hemp seeds are legal to eat and are available all over the world. What is the difference between a hemp seed and a Marijuana seed in terms of the law? Nothing! There is no difference and having either is within the same guidelines of the law. If your seeds get taken by customs they just take them and that's it. Customs or the police can not lock you up or fine you for having seeds sent. Sometimes they will send you a letter saying they were contraband but that is very rare. The worst thing is you will lose your money and seeds.

Seeds are completely legal souvenirs in eu and uk, no need for customs to detain them… I can’t begin to imagine how many thousands are shipped daily into uk/EU based seed banks for example.

The problem is that because of the Brexit, regulations on seeds are quite steep if they enter EU memberstates and vica versa.

If they are packed stealth enough, they should pass customs without problems.

Could be they charge you for import costs. Worst case scenario they destroy the seeds if they find them, because they lack the proper paperwork (phyto certificate).

What if you still receive the package with the seeds removed and a note from customs instead? I would assume they are not planning on sending them back then.

As I read the import laws of my country it looks like they are supposed to send them back unless the importer allows them to destroy them. And "seeds" are defined as seeds made for growing/germination and these are obviously not made for germination or growing but for collection purpose only so they can't even qualify as seeds imo.

Been there. I had a letter say an investigation would be opened but ultimately nothing happened. Seeds just dont arrive, but their letter does.

Edit: imported hundreds of seeds since no problemo.

Edit: Nevermind. When I made this thread I thought it could be a good way to educate myself and others on our rights, but I realise now, that in a system infested with corruption you simply don't have any rights. But that is perhaps the important lesson I learned from this.
