He pushed me against the door, it opened we walk in the house he sees a bud on the counter, tells me thats probable cause to search, I say if you have no warrent why are you in my house...they all smiled and he says "You invited us in".

If they have evidence that a crime is in progress (=domestic battery), they do not need a warrant to come in.

Actually opening the door (even though a mistake) was not your down fall.

Here is where your #1 mistake is.

king kong, i was gonna say the same thing kinderfield said. U were pretty much screwed once u sold to the undercover. Was just a matter of time. Only sell to people youve known for years, and even then, be really careful

o yea and tell wifey not to open the door period. Best bet is to just act like no ones home, try not to make any noise. I do it to the landlord and family members all the time if the house is smoked up. Later on i tell them I was out with my girl or friends, which explains why ur car was in the driveway when they came.

although u state they may have right to come in without warrant, does that mean they have right to kick your door down since you're not opening it? OR does it mean once u open the door they push their way in? there is a difference...

dontstepongrass, leo will kick down your door without a warrant if they suspect domestic violence is going on or went on just prior to their arrival and you refuse to open the door or pretend like you are not home... it is very suspicious not to open the door after a loud domestic fight when the cops rings your bell; for all they know, someone might be seriously injured or worste, so they have to get in to make sure...because if the couple was just having a loud fight, why can't they go to the door and explain that all is good? and even then things can get complicated...

if they have a warrant, knocking or not they're gonna come busting in. there's no getting around that...even if the house is vacant at the time. best thing to do is don't answer. a lady home alone has every right to call someone to verify a presence at the door before actually opening it or even acknowledging anyone is home and is highly recommened in these days and times...

just goes to show that some people need a muzzle...

although i am fairly certain this would not happen at my location, i see ur point that my situation is not the rule... damn police!

in my neighborhood the cops just don't show up lol... i remember this one day before anything was going on i locked myself out of my house with my keys inside. the landlord refused to show up so after like an hour of tryin her i just decided to break my own front window in broad daylight. and i do mean SHATTER. then, in broad daylight i crawled in through open window. no cops. and don't even get me started on other peeps doing shit and no cops coming... the ONLY time the cops came was the sheriffs to kick in the neighbors door after they were slangin crack out their frontdoor for months straight (sketchy car drives up, driver waits with car running, passenger runs to door, knocks, doors opens a crack, money is given, door is shut, couple minutes pass with sketchy weirdos on front doorstep, then door opens and something is handed through cracked door, and weirdo runs back to car and they leave. repeat this 10x a night)

then again, u guys might not live where the neighbors dont call for ANYTHING. seriously, we asked them to their face not to sell shit out their front door and they played dumb. week later their door is kicked in, but i think it was all flushed since they still there lol

I finally got my wife understanding the importance of just saying no to searches. All it took was losing an small can of buds, and finding it under the seat of her car when we cleaned it out. "So honey, you don't have anything to hide? Are you sure about that sweetheart?", while she's standing there holding an express ticket to the pokey. We also shred everything with our names on it which used to be like pulling teeth until our recycling bin turned over and our trash was all up and down the street. She figured out how happy she was that none of our neighbors 'knew' it was ours. Of course that's not why I shred, but whatever it takes to get her on board.

women are more emotional than men
unless you've trained her by actually rehearsing this over and over, she'll probably just open the door, freak out, forget everything you've told her, and not wanting to close the door, just say "yes" when the police ask to come in
sorry...it's their nature

From someone who was woken up by an urgent banging at the door and instinctively responded by mistakenly answering the door.... (they were looking for the previous tenant)

Tell her not to admit to anything. If the house smells like weed, tell her that she doesn't smell it.

If there's a joint laying in plain view, it's not a joint.

The officer smelled it in my home and told me he knows I have marijuana and to just hand it over and I would get a citation and he wouldn't have to get a warrant.

I decided it would be a good idea to try to placate him. Well, he escorted me to get my weed and I could not let him come any further or he would have seen my grow....

Long story short, don't admit to even smoking it, smelling it, or anything. Tell her she doesn't need to have a straight face on. She can say it with a laugh for that matter... She doesn't need to be convincing (it'd be preferable if she was, that way you wouldn't need to flush your plants in case they actually do come back with a warrant), she just needs to not admit anything.

It a lot harder for them to obtain a warrant if you haven't admitted to anything. If their warrant request says, "individual in house admitted they have marijuana on premisis," a judge is going to instantly grant that warrant. And they're likely to sit with your wife and wait until they get that warrant, no matter how many hours it takes.

If they already have the warrant, still keep your mouth shut. They'll try to sweet talk you and all kinds of other stuff. Even scare tactics. They'll tell her whatever they think will work. They might say the state will take the kids away or something. They'll tell her how welcome a cute girl like herself will be in jail, and what they're going to do to her in there. They dont care, they just want her to talk.

never open the door, if they say they have a warrant, say "slide it under the door" then read it to see if its valid

other then that, you don;t have to say anything, just walk away

LOL, like they'll be just standing outside the door waiting for you to read the warrant. Sorry man, that's not how it works. If you don't open the door in about 10 seconds they come in anyway. By the time you finished saying the word 'door' they'd be handcuffing you.

^ true that. With a warrant in hand they don't even have to knock. If you're to the point that a warrant is issued, you aren't talking your way thru the door, in fact you're better just to stfu ;)

not married, but if I was, I'd tell her to say nothing. Absolutely nothing. If they stand there and knock for hours...let them. If they want in, they will/can let themselves in. If things ever came to that, lie on the floor with your hand in from of you and say nothing at all...forget how to talk. PERIOD.

I would have rather took the sale charges and saved myself the 52plant bust, plus all the crap they took/found in the house
