So post #1006 was just wishful thinking in support of fantasy, right?
Of course it was. It doesn't describe reality at all.
The CO reality is that state authorities can't act against anybody for having constitutionally protected plant counts.
No Catch 22.
Local police and state authorities are by law required not to act against anyone claiming legitimate protection under prop 215. So I am really failing to see any fantasy...
I'm not seeing how the cops couldn't do whatever they please in CO. Is there some sort of punishment in place if they do what they please? The supreme court of California has already decided that using federal law as a reason to arrest people that are breaking no law in California is NOT okay. That doesn't stop police from doing what they want... And dealing with the consequences, or lack there of, later.
As I said above, most of the time they don't ask to see your paperwork. A verbal confirmation is fine. It is not a pipe dream, this is reality. What is to stop a cop from busting into your home because he had "probable cause you were breaking personal cultivation laws"? Guess what? There is nothing to stop him. If he finds you have more than 6 plants you are going to jail.
At least in california my case wouod get thrown out in court. In CO theyd probably promote the guy to detective for busting that black market grower on a hunch...
