As you can see here, they were on track for this a year prior to this VTA..

The part you bolded just makes note of the fact of timeline. It was an arbitrary reference in time made by the author of the article. No city official made any indication that prop 19's failure made them decide to outlaw MMJ dispensaries and such.

This proposed new city law came about after the November defeat of Proposition 19 -- the regulate, control and tax marijuana act. According to Kingsburg City Attorney Michael Noland, in light of the defeat of Proposition 19, federal and state laws continue to prohibit the possession, sale, distribution and cultivation of marijuana.


But who cares anyways...19 failing PROVES to THEM that the people don't want pot legalized. It's not that the prop was bad or anything with the content of the prop..just the fact that cali voted NO...we just gave them more ammo.

This part VTA. NO where does an official from Kingsburg mention prop19 is at fault. This is from the author of the article, referencing the time of the decision to EXTEND THE BAN FROM 2009 (way before voting even occurred on prop19).
The only thing Michael Noland says, that in light of prop19, SALES OF MMJ ARE STILL ILLEGAL FEDERALLY AND STATE.
He made no mention of prop19 being at fault for anything.
You saw prop19 in an article about a 1.5 year old ban that was in the making probably two or three years ago, and got excited and posted it, blaming it on prop19 by yourself.

VTA, I really do appreciate most of the articles you post, and keeping us updated.. But you have to read what you post, before you post it and make a judgement about it.

First off, you are saying there are repercussions from prop 19. What is happening in Kingsburg is not from prop19.

That part you quoted from Michael noland just says that he agrees cannabis is still illegal federally. He makes NO indication that prop19 is the reason they decided to outlaw dispensaries.

Also, your claim that MMJ may be illegal in Kingsburg is wrong too. It will be regulated with moratoriums on dispensaries, just like its been happening around California since the dispensaries opened up. They are developing their interpretation of the cannabis law, they are just late. Some counties have not even addressed it yet.

Do you see how many people already responded thinking this actually have something to do with prop19? Do you see what you're spreading?

This Kingsburg decision has NOTHING to do with prop19 failing.

If anything, this is why the regulation on outdoor MMJ cultivation has materialized.. CRIME!! NOT PROP19!!

Noland said that since several serious crimes have happened in Fresno County over the outdoor cultivation of marijuana -- in September in Fresno a man was shot allegedly stealing medical marijuana plants from an outdoor garden -- Kingsburg should not allow outdoor medical marijuana growing.

You know....I like many of you "political minded" dudes....but shit man...in a way I think it is an unhealthy addiction. November elections came and went...19 is no more....all the LEO bullshit will never ever end....but it seems many enjoy freaking out with all the gloom and doom. It just is not worth it....unless you are a masochist.

The "repercussions".....come on man.....enjoy the day. The shit I've read from icmag posters over the last yr....blaming things on the way some voted....hoping peeps get busted or bit in the ass....I can easily see why the masses don't take the MJ legality status issue serious...the anger is childish and such a bad trait. Ween yourselves off the need to be unhappy....maybe give politics a break...

I mean...I don't see much positive posting on the current situation...why? Is there nothing positive going on? It must suck waiting for the next disaster...to fill your pessimistic needs...to champion your conclusion...that all.....is well fucked up.

I respect some of y'all....but you're still nuts....or driving yourselves nuts with all this stuff....my most humble observation....as a Herbalist.

My county has never allowed dispensaries and has just again banned them for the next year.

This is a very badly written article full of misinformation.

i'm also confused. my county (yolo) has banned dispensaries so only delivery. i think solano is also like this. i have to drive to sacramento which has a plethora of options.

i also don't understand why my hometown (san diego) took forever to get clubs. like 2008 was the year but now there are 50, shits blowing up like sactown ^_^. 215 and fuck the naysers.

well, i tell ya pablos, the shit that i read on this sight by anti 19 people made me sick to my stomach...the spirit of the cali grower has ALREADY sold out, or more correctly, been over run by people who think money is more important than freedom....prop 19 was not defeated only by greedy growers, dispensary owners and idiot stoners who have no sense, but peoples true colors were brought out...and its too bad....if cali can no longer make any progress then who will?

? Dont loose faith, they will get a good prop up on this next coming one. MMJ is living strong, and this Kingsburg article and many like it have zero to do with prop19 as I clearly pointed out these are actions extending far beyond the timing of prop19

uh, yeah i'm sure prop 19 would have passed if richard lee didn't stand to make 10s of millions off of it passing by being grandfathered in as the sole provider for oakland with his 10,000 light warehouses. and if it didn't force users to buy from a store by only giving them a 5'x5' area to grow. i don't know anyone that can provide enough herb for the entire year in a small closet.

rob....it's over...it got ugly on both sides....I don't know who or who is not...selling out.....but... $$$$$...history shows....will always have its say...good or bad...right or wrong.

Freedom.....I don't know if that concept exist.....as I feel we are more or less economic slaves. It is a sugary word.... based on cash flow in our society. I'm happy everyday my head is above water.....without having to sell my soul or sell short my ethics/morals...I try to participate in the slave system as little as possible....but I remain a credible citizen....ie...I pay in.

I don't know who will answer the bell for the next round dude....I'd imagine it will be us again....maybe CO jumps in and swings in unison...I understand your frustration...I do. We're in the same county...in the same state...with the same peeps...with their views and agendas....but it will work out....cash flows will get sorted.

My true belief....as an herbalist....no governing body/man has a right to tell another body what plants he may cultivate/possess....all plants should be legal...no exceptions. It is inexcusable that government has befit itself to play God. They should apologize for their arrogance and lies. But...of course...we are way beyond that...

And had 19 passed, marijuana sales would be legal in the State and thus a game changer...Also "in light of prop 19" says something to me...if not for you then so be it.

The fact is that 19 failing sent a message...The State of California, the most liberal in the country, does not want marijuana legalized.

It may be better to have locals banning dispensaries rather than feds raiding patients and dispensaries right and left.

I clearly pointed out how the only mention of prop19 was to say that sales of MMJ remain illegal both under state and federal law. Its their interpretation of the law, and has been for at least a year and a half.

You made it sound like Kingsburg was now making this decision because of failure of prop19.

To be accurate, you should of mentioned that this was an extension of an old ban that had been in effect/development for more then a year before we voted on prop19.

Instead you pick and chose to get your agenda across..

The fact is that 19 failing sent a message...The State of California, the most liberal in the country, does not want marijuana legalized.

Thanks Hammer...I agree that if 19 had passed...it would of changed their priorities. Before the election I posted tons of articles indicating cities and/or counties that wanted to wait to pass regulations/moratoriums/bans until after the outcome of 19. One such city is the one that I live in. But that doesn't matter to some. In all fairness to Frozenguy, I do have an agenda and I keep it no secret. My agenda has to do with legalizing cannabis. Anyway it takes to get us there. Some say 19 was shit...I saw it as a 1st step...and a big one at that.

Frozenguy...whatever dude..I believe that if 19 passed...these ass clowns wouldn't be worried about medical so much. 19 would of allowed anybody to grow...they would of had their hands full with that. People like to say that if 19 passed LEO would be fucking recreational growers over... and leave the med growers alone.

I would like to point out that rec growers and med growers do the same thing.

And they will all be in the sights of the DEA regardless of state statutes.

Until those individuals who think the war is going to be off of anyone's shoulders realize this is on ALL OF US, we won't be united on any front.

Why are we still dividing the issue? What's wrong with just including all of us doing what we all do? I'm not against legalization at all, though some make it out that way... I just want to see no stoner left behind. We've worked too hard to start fighting each other about how much we're willing to give... why don't we all just hit a bong?

If we start saying 'It's OK to throw so and so under the bus' we have lost.

I don't see why people don't see that this division isn't working for any side that is procannabis!

I guess I'll wait for him to explain what he meant by that before I assume it was along the lines of what hes previously talked about -- prop19's failure will ripple among MMJ.

I agree that things would of been different, for better in some aspects; but I dont agree things are worse off then they were before prop19 failed, regardless of the opportunity it afforded had it passed.

And I want cannabis legalized too..

I know he, himself, mentioned prop19, but only in terms that since it failed, sales in any capacity of MJ are illegal both state and federally. Did prop19 legalize sales of MMJ? To 18 year olds as well? Link?

If they had essentially no stance on MMJ before prop19, and then once prop19 failed they decided to ban dispensaries and outdoor grows, THEN, I would agree with you that it is a repercussion of the failure of prop19. But, as of right now I see it as maintaining what has been long before prop19.

The first post does imply that 19's failure is being used against 215 when the story doesn't necessarily indicate that at all. The ban was in effect before 19 failed as is the case with similar bans all across the state. These bans are being challenged in the courts as we speak and only those courts eventually the CA SC would have changed those bans. If 19 had passed similar bans would likely have been passed by municipalities around the state. That is neither here nor there though, 215 was under attack before 19 and it continues now, ultimately the courts will decide and they aren't subject to 19's failure legally. Now if people are simply saying that 19's failure emboldened 215's enemies then they are right, however that doesn't really have an effect on the legal process already undertaken.
