Should I start again?

I haven't been on here in a while, I got busted last November because cops were canvasing my neighborhood looking for somebody else and say they smelled weed by my window while they were searching between my house (stupid me no carbon scrubber at the time). I still stay in the same house, so my question is what kind of risk do you guys think I run of getting caught a second time if I try to grow again in the same spot I've already been busted at?

If you were busted, ain't you on probation? And if you're on probation, we know what that means--doesn't matter where you live, YOU are the bust, not the spot you're living at itself. You drag it in with you, like dog shit on your shoe.

Well?? I am..state went legal..mom had cancer

I weighed the risks vs my mom,and one thing lead to where I am today.. A legal caregiver/patient..serving other caregivers who do not have the time/desire to grow...ballsy or stupid??? not sure yet..

cops never actually found my room..just some OD and leaf and para....;)

getting a warrant for a house/apartment that was previously busted is as easy as knowing a judges number to get a warrant approved and a few lies.

If it was 2010, and it wasn't a small town (and you didn't have any particular notoriety) and you planned a smaller op, I wouldn't think it's a huge risk. Just don't have obvious come-and-go traffic and don't run a huge power bill, don't leave stuff in your trash. Definitely don't be so stupid to do things like run without a scrubber. wtf?

Obviously, it would be best to get a new spot, but that's sometimes easier said than done. Realistically, though, in most places the cops aren't still driving by someone's grow house a year+ later - and even if they were it's not like they're gonna just know there's another grow going on.

Every situation is different.....non-med state? You've gotta be fucking insane.

Med-state and the cops did a look-through, told you to post scripts and watch numbers? Possibly, but only if you live a clean-life and can follow the rules. Even then, you've gotta have some brass ones...

But if you are in a legal state then odor isn't a legal reason to search for a grow. Because they need reason to believe that a crime is being committed and since mmj is legal for hundreds of thousands of people; it isn't reasonable cause anymore.

Are you sure about this? Even in a med state grows are illegal if there isn't proper documentation and how would they know one from the other? If they smell it and don't see documentation couldn't they presume it was illegal? Even if this is true all they need is one of their "anonymous tips" combined with smell to get a warrant for the utilities. Whatever happened to your right to face your accuser?

Has anyone seen a warrant in a med state with just smell as reasonable articulable suspicion? My bet is they all have an anonymous tip...

Its a bunch of bs that it is LEO job to lie to us but it is a crime to lie to them.

They will lie through their teeth up on the stand as well and they get caught and nothing happens but the case being dropped afaik

There really should be some laws in place to make LEO actually lead by example. They break laws all the time and its not ok.

Not all med states are created equal so I can't say with certainty about most of them, but I can say for a fact that in my state they will assume it's illegal until proven otherwise. There's no state registry or anything, so there is no possible way they *could* know it's legal until they see your papers. And if you are following the rules strictly then your papers are posted right next to your grow, so... And if you're growing indoors and they suspect, they sure aren't going to just walk up to you and conversationally ask if you are a patient or caregiver, they'll bust in guns drawn and shoot your dog.

Smell is probable cause. Go speak with an attorney, they'll tell you that even in the most liberal medical state it is still considered good probable cause.
