Cops can and do... whatever the fuck the feel like.
you can always fight to get your $ back in civil court...
I have researched this a little... and it seems there arent many clear guidelines on when a leo can seize your cash... so without clear guide lines it is up to the discretion of the officer (not a good thing)... they only need to suspect that it is illegal proceeds, suspicion is not a high hurdle to clear..

The police do what they want.

When it comes to money to burden of proof is on you. You better be able to show that it was obtained through legitimate means.
Even so.. many times they'll make you fight for it through the legal system. It can sometimes be cost prohibitive to try to obtain your money back... and that is provided that they even acknowledge the full amount they took from you.

Locked briefcase and in the trunk of a vehicle. This eliminates SUVs, trucks, hatchbacks, etc. You want that shit in a clean vehicle, locked case, in a locked trunk.

..and as always. Never consent to a search of your vehicle. Ever.

You know, I was walking into the court house last Friday to register for my highway clean up duty (on top of the four days, for res. the terrorist threats thing was and is dropped) and the two security wand cops were talking. I over heard.

They actually said something to the effect of, "there should be less rehabilitation in the justice system."

To which I replied, "Are you kidding, do you know WHY recitivism rates are what they are. for what reason?"

He said yes, and replied "we want to keep our jobs."

I told him that was mighty selfish, he agreed.
