The only other choice is to persuade Congress to repeal military tribunals for non-sanctioned terrorists. If more of the folks unhappy with the stroke of a pen had made their feelings known in 2010, we might have had a different outcome.

While Congress filled the 2010 debate with, "We don't want no civilian prosecutions for foreign terrorists", America paid little attention accept for a few hundred folks picketing the courthouse steps (and played repeatedly on Fox News.) The only significant push to end military commissions came from the administration alone. I respect your premise that Obama should have fought harder to command a mandate. IMO, Obama would have benefited from more public support in favor of ending tribunals. Prosecuting KSM in NYC would have paved the way to close Guantanamo.

Today, too many lawmakers have to answer to big doners and special-interest contracts before they'll compromise their stances. Now if both you and Conjito are referring to the lack of State law making that legal because we have allowed the Federal Government to have authority of that particular issue then that is an extreme extrapolation. Ron Paul never said he would attempt to get rid of the Supreme Court and all their rulings. States would still be bound by those and future rulings is my understanding. I would not accept that extrapolation or his acceptance of it unless given decisive proof that is what he would intend. Sounds like nothing I have ever heard, read, or seen before.
