sorry for the caps, but this is ridiculous. lawyers don't have the slightest about probation and how it works. they have the THEORY down pat, but let's get a show of hands here:

how many times was YOUR lawyer PRESENT at a PROBATION appointment?

seriously, you people need to use your heads because that is the purpose of this subforum.

If you are in Cali you can get your 215 for medical mj. Then not only can you smoke while on probation but you can grow :) The courts dont want to be responsible for your health and if the doctor says you should use MJ for your health they will not dispute. I was on probation for a very large MJ case. Once released from custody I got my 215 and grew and smoked the whole 5 years. Good Luck.

How do you figure a Lawyer doesn't know anything about probation and how it works? They work together on a weekly, if not daily basis. I don't think it gets much closer than that.

To the thread starter. Unless you have med ok, I would advise you not to smoke because of what your probation is for. If yopu get caught pissing dirty, while being on probation for a drug charge, expect the Judge to sentence you to the max on the violation. It's not worth the time you will do my friend. Either get a med card or stay clean....

Who do you call when you get a VOP?


I agree that an atttorney may not know the logistics of when you go, if you are watched when pissing etc, but he sure as hell knows what to do when shit hits the fan and you are back in court on a VOP.

I have been on felony probation and I had a shitty public defender that didnt do shit for me. HOWEVER lawyers deal with probation on a daily basis like another reply stated, saying "lawyers dont know shit about it" is like saying "apples are red", some are, some aren't, some lawyers are fantastic, others are worthless vampires.

Fact remains, more lawyers know more about probation then your average joe.
 
Sorry but I still don't think your correct. I interned at the district attorneys office for a year. 90% of the criminal defense lawyers I was introduced at to at the courthouse had worked there or another prosecutors office at some point...even met some that actually worked in probation at some point.

They usually start out that way and switch sides to make money...They could go on forever about probation, diversion, sentencing guidelines, juries, etc...I agree they dont show up to probation meetings but why do they need to? At that point you should have your shit together....

are you trying to tell me that a lawyer will have you come back and TAKE UP HIS TIME to ask you how probation is going? a lawyer makes their bank representing a client in legal proceeding such as motions, trials, etc. there is no pot of gold to be found at the end of probation, so a lawyer won't be there.

MONEY MAKES THE WORLD GO ROUND! sad but true...

You don't think a medical dr. charges you for those follow ups?? A lawyer will do the same if you pay them what they want...have your insurance stop paying your medical bills and see if your dr. will TAKE UP HIS TIME for free.

The feds quit giving probation some time back, but after you serve your sentence you usually have to serve a few years supervised release, wich is like probation. Probation officers do deal with lawyers, but usually after a violation.
With the Feds you can go back to prison for violating, and the time in prison dosent count against your supervised release. Just for smoking mj whille on supervised release you can do a dung load of time in prison, if you keep it up, you can be in prison long after your sentence and supervised release time have been served.

I am one of the 10% or so that made it through felony prob. without violating
it was tough for me and I am very lucky with all the shit I did.

1) don't act fake around them, they will know (look up the requirements to be a probation officer at the local collage, I even read their text books!) don't volunteer more info than is needed especially on your first visit, try to dress a certain way when visiting the office ie; jeans and a blank t-shirt, let the officers underestimate you

2)they can and will test you anytime you are called into the office, be ready. :badday: I was tested 3x a week for a month when one of my tests came up diluted, that gets expensive.

3) My house was only visited twice, once I did not answer, and then a month before my term was up they came over, I opened the door wide and welcomed them in, they seemed surprised! one even commented on my huge book collection, I guess most "criminals" don't read

4) know your na/aa credo if it is mandated that you go to meetings

5) if you drink/toke don't do it at your house

6)jump the hoops and good luck!
