my friend is on felony probation for a while but yet she still continues to grow multiple things in her house. such as mushrooms and that all mighty canabis i am concerned that her probation officer may go to her house one day and find all of this and violate her sending her to prison. what sort of things can and cant a po do can they search ur house without a worrent do cops no longer need a warrent with the aid of a po all of her grow ops are very well hidden do to the fact she lives with her parents im just concerd can someone please shed some light on the situation the state in ? is ny if that helps at all

They usually search right at the end of probation (in FL), main thing your friend should be concerned with is making sure the house is immaculate.

for me they didn't they saw that my room was clean walked in, did a 360 pan around and left, same thing happened for my friend

My brother is a po. What they can do that will hold up in court and what all of them actually do are very different. That is to say, he'll snoop around if he damn well pleases, and if he finds anything, he'll call the boys in blue, who will then bullshit their way into a warrant.

And then, her life is effectively over.

advice to her: Tell her to stop being a tard, grow up, and get away from drugs classified as serious offenses(shrooms) while she is technically not even "free" from the system. How dumb can you be? Shrooms aren't addictive so it's not like she's an addict getting a fix. She's just a tard.

Advice to you: make more intelligent friends. When you hang out with tards, eventually it'll rub off on you.

If her probation calls for "random testing" then YES - the probation officer will show up to the house whenever they want. Especially if your on house arrest.

If you are on a "conditional" agreement, they will notify you when you have testing. You will have time to clean up.

If you are just on "probation" with no conditions, then you can smoke weed and do whatever the hell you want, as long as it's not breaking the law.

Check and see which your buddy is on. If they are on "random testing" probation, they are screwed. Tell em to enjoy it while they can, they're just asking for trouble.

well her po is soposed to come by her house once a month but hasnt done that in forever prolly 7 months if not more and she hasnt been drug tested in over 3-6 months ive had her po he seams pretty laid back and says he doesnt like paper work thats why there isnt any real monthly visits like i said though all her shit is like micro and is very well hidden the only way u would know where it is would be for her to tell u or to have a drug dog

she should be thankful and call her p.o. every once in a while. Tell her of her work/living status, thank her for trusting her and to inform her p.o. that she's always thinking or considering the reason she's on probation and is not taking anything for granted ~~~ she gets that message across once and her p.o. will be tickled pink.

I had a p.o. just like that & I'd call him every 3rd month or so saying this as a joke "Hey Mr Smith, it's me Dave, you haven't checked in with me in awhile and have me worried." he loved that shit really. I kept my job, kept my address stable & informed him before I was moving (still within his jurisdiction) & why, he knew I was going to behave to cut my time short, I got 5 yrs probation and was off in just a bit more than 2 yrs.......

how to shorten probation? do you have to go see the judge? just request to the p.o.? what if you're on probation but don't have p.o.? I've heard of this probation-cut-short before

It depends on the state as well as the class of probation. OP hasn't given enough information to get a coherent answer. But likely it's spelled out in black and white on the agreement the OP signed when he started out on probation.

In my state... your PO cannot search your house without a warrant without a SPECIFIC reason to believe that there is something illegal in your house. It also specifically states that a SUSPICION or a "hunch" is not a valid reason.

I'm on felony probation myself and I've actually had my PO in my house while I had plants late in flowering in my basement. Trust me... I was shitting bricks for that one.
 
yep...she is playing with fire....and mushrooms to boot (stricter class of drug). If I do illegal things...I would avoid her like herpies.

Here is the good, and the bad of it--
When you agree to probation, you sign away your Rights-- The can search any time, for any reason--
Since it is not your house tho, they can only search in the area you live in, like your bedroom--

so i should tell her to eather 1 stop cause i would much rather have all her stuff here lol or suck up to her po all the time and or keep things well hidden and never leave room for suspition for them to search i keep telling her to move them to my house but she thinks ill pinch lol

Legality/authority is an ever changing landscape. Appellate challenges and rulings.

Policy is also ever changing within each jurisdiction. How a P.O. interacts with you can change like the weather. He or she may get a directive from above today, which puts you and hundreds of others in jail tomorrow.

A spree killer's or robber's action today could bring the hammer down on literally hundreds of Probationers/parolees. (Round up the usual suspects)

I have seen and experienced all of the above.

The above was also true in my case.

Those that claim across the board rules for all states are incorrect, and promulgating misinformation, as in the post by Ganja Outlaw above.
