It looks like a secret has been revealed. Travelers leaving via Oakland airport have an advantage over most other travelers. They can bring along up to eight ounces of marijuana if they are medical marijuana legal in California. It turns out Los Angeles and San Francisco also are relatively friendly to medical marijuana patients.

It seems back in early 2008, Oakland airport decided to allow patients to take their mj with them on flights. If they discover a patient with medical cannabis, they don't call ahead to the destination to alert the authorities, but they warn that other airports are not so friendly, particularly San Diego.

Indeed it seems you'd be OK if you flew out of Oakland to another state where medical marijuana is legal.

I would recommend calling up security at any proposed destination to find out their policy regarding medical marijuana before assuming that you will be OK to fly there with your stash.

I was excited to hear about this from a teaser on TV. When I travel, I usually do it with edibles, just because they are far less likely to get me jammed up. I always assume that the airways are federal territory, so I handle the situation accordingly, but it's good to know that I have options. I noticed one odd omission. They never mention San Jose International's policy on MMJ. Anyone know how they feel about it? I almost never travel from SJC, but it would be good to know if it's more risky that SFO.

BTW, in the article, they say not to call ahead and alert the authorities, so you might want to proceed with caution when trying to assess the policy of other airports.

How can this be possible, arent all airports federal? Ive yet to walk through one that didnt have a bunch of TSA assholes giving me shit....

You misread that, they say the Sheriff doesn't call ahead to warn the destination that pot is arriving with you. You can call to see if they care or not.

In the article, it says if the TSA screeners find it, they call the sheriff. If the sheriff does nothing about it, you're inconvenienced but not arrested.

If you read the article it says that Federal Transport law only prohibits things that are not allowed under Federal AND state law. That's the same test the DEA supposedly uses now to go after cannabis. So long as the STATE allows it, the airports should too.

I thought TSA was federal. Meaning any marijuana was illigal. San Jose International is the only international airport in the nation still run by local authorities because of it's current state. It's still under construction becoming an international airport. When completed, feds take it over also. A freind of mine tried to bring 2 oz w/ him and was promptly stopped at security @ SJC. The local sheriff was called and after a court case he was able to get his meds back but could not fly w/ it. It would seem that even if this is a current possibility it will quickly get noticed and ammended. I can only imagine how getting on a plane w/ half a lb can be taken atvantage of - and thats exactly what people will do regardless if it's medical or not. Although I'm in agreement that I should be able to take my herb with me where ever I go, I'll let some one else try this one first and let me know how it goes.

Like I said, I've never travelled with herb, but I've definitely taken edibles through SFO and SJC with no problems. I'm under the same impression as you are, airplanes are federal territory as far as I'm concerned, and I don't want to risk the possibility of legal nightmares if I misinterpret that fact.

Thank you skip! Always providing interesting articles and good to know. I live in SD though and usually travel with edibles. Next time ill probably try bringing a small amount in an airtight jar on my person. I never set off the detector and walk right through 100% of the time. My father got caught with around a gram about 7 years ago and all they did was take it away....and no he isnt an mmj patient

I understand what it says. That is only one of the possible laws at play here, interstate drug trafficking could be inferred here by an overzealous dea agent or US attorney.

If you read the article (and my comment) they say that San Diego airport is NOT marijuana friendly, just like it's not dispensary friendly. I'd hesitate to bring anything thru that airport.

my oregon friend tells me that Portland international allows med legal patients to fly with upto 1.5 #

This rates as one of the top things that
'Just because you can, doesnt mean you should'

better vacuum seal 3x and act cool when you get where you are going if its not a med legal place

Interesting, If federal law only counts when state law is also violated.... state with decriminalized mj laws should allow this too?

TSA wouldnt even let my grandmother fly with toe nail clippers, you really think they are going to let people fly with weed...? It sure would make it alot easier for us medical patients, but somehow it sounds too good to be true....


Has anyone done this before....?

This is good for CA MMJ patients flying in CA, but what does that mean for patients flying outside of CA?
