wow thats pretty fucking awesome! i saw one of those before, the one that keeps asking if he's being detained. it feels so good to see people out there fighting for their rights. the best one was the one who turned it around and started interrogating the check point dudes, lfmao.

It's funny how they dress up in costumes, use props, and get us to volunteer into something they have no legal authority to do without our consent and participation.

It's basically trickery, which I think is close enough to fraud to be something that should be illegal in its own right.

We all have the "right to remain silent"...shame that many of us lack the "ability to remain silent". Now, remember--these guys (border patrol, DHS, etc) are technically "law officers" and the punishment for "lying to a law officer" can be significant...so "silence is golden". Answering their question with a question IS NOT LYING and is not technically "impeding"...whereas refusing to respond (silence)--in the right circumstances--can be considered "impeding" and might win you a night in the gray bar hotel!

BTW, did anyone else besides notice the common thread in each scene...POLITENESS and RESPECT? Those two traits have "extracted me out" of many a bad situation! It is easier to be "firm" when you also "respectfully polite"...than being an "asshole".

Yep, magic words I have used many a time...."am I being detained or am I free to go?".

silence is a right, it's the 5th, you do not have to answer any questions. as soon as leo of any kind ask you a question, you have the right to a lawyer present before answering. they will use your answer against you if they can, as you have the right not to incriminate yourself that means you have the right to remain silent. this applies to all types of road blocks or stationary check points. if they pull you over it's different as they theoretically have probable cause to pull you over in the first place, so you have to give your driving license etc. but check points are different, they are done without probable cause, everyone is just stopped and engaged in a voluntary discussion. that discussion is then used to establish probable cause if possible. those that say, just answer the question and be done with it are stupid, they don't understand that by cooperating you are giving up your rights, by making it clear from the first second that you are standing on every single last of your rights, they know they can forget doing a search and all the rest of their shenanigans. but if you are polite and play their game, they are automatically assuming that you are giving up your rights so they can do the full number on you. don't think you can answer the first question and then refuse the search, as they will say that's probable cause as you didn't seem to mind answering questions. although always refuse the search anyway, specially if you have stuff with you that's private.

Here's where it gets tricky. In my jurisdiction, or thereabouts, the officer has 20 minutes to arrest you or release you after you have been detained, otherwise, the officer is in the wrong. Most people don't understand this or know about this. I didn't.

You can't be detained for an hour without cause, and that cause should be sufficient enough to arrest you within 20 minutes or let you go.

Besides, knowing the stuff the people in the video did is good reason to believe they are American. It's true Americana at its best.

If you're going to verbally box with someone for 5 minutes and you don't have good cause to act, it's reasonable to believe you'll verbally box with them for 20 or 30 minutes and still not come up with anything criminal. If the officer ends up in court with 5 of these a day, they'll probably lose their job.

Know your rights. Even if you never exercise them like the people in the video.

BTW...ever wonder why LEO says, "anything you say will be USED AGAINST YOU"--but never offers, "anything you say will be USED TO DEFEND YOU"?

It is because the "hearsay rule" prohibits most statements made outside a courtroom from being used as evidence in court.

Silence is golden, especially when it is "courteous, respectful and polite".

My fav "excuses"....."I'm sorry, but I rather not talk right now."..."I am not feeling well and rather not speak to anyone."...and the one used many a time, "I'm sorry, I don't understand the question--it is kinda of confusing. Can you ask it differently?" (Works great in court!)

Tried and proven...at least it was "back in my day"....Cheers!

exactly, any word you say and even how you say it will be used against you. would be cool if everyone started reacting like that to random road blocks and compliance checks. it's their own fault, they have become so abusive that people are looking up any way to find a remedy from their tyrannical behavior.

only info you got to give is your id,ss number whatever. if you don't provide that expect atleast a 24 hr detain. don't ask but it wasn't me lol. not providing id never goes well. cause their is lots of wanted people of every description and you happen to match one. time for fingerprints and such. my last checkpoint check they thought they had me riding low. they were right . trunk full of soil. me and my homie were laughing our asses off. no bust here mofos
