Keep your chin up PP09. Even in Wisconsin, miracles can happen. I've got people that have been tagged way harder with tons of crap on their records, with a lot more than an 1/8 and a pipe and have walked away with fines, community service and some probation.

Each case is different, but I believe with the right game plan you could be laughing about this by the 4th of July.

Do you have a court date for arraignment? Or will you "be notified?" Or were you arraigned in jail? If you haven't been arraigned then I'd wait on the lawyer thing until you are arraigned on a felony. Cops will throw all kinds of shit at you out of ignorance and bluster. If you are charged with a felony at arraignment get a lawyer immediately. This sounds like some bullshit case that would've been tuned down 35 years ago.

Felony or misdemeanor, don;t put your hand up for one minute of jail time without a lawyer.

Have you considered moving back home with your parents? You don't learn do you? You should quit smoking and clean out your system for your upcoming drug tests for court. If you get clean for your first tests the judge is going to be more lenient than showing up and basically telling him with your piss test "I don't give a fuck that you arrested me, I kept smoking anyway, fuck you judge." I would also recommend being proactive and getting into Narcoholics Anonymous asap and get proof you've been going. SHOW the judge you understand you have a "problem" and need "help."

There are much better ways to deal with this than basically suck the judges wood. They really don't care what you are doing, there is no justice any more. All courts worldwide are de facto not de jure, all they are interested in is creating a 'charge' which you have to pay. Why do you think the like of Bernard Madoff are sitting in penthouses right now instead of jail.

You were on the right lines when you told the cop you don't consent. They need consent to act, lawful governance cannot exist without the consent of the governed. They need a contract with you to act. "But I don't have a contract with them" I hear you cry. The problem is that consent can be implied as well as expressed.

That car you were 'driving' when stopped... registered? If the answer is yes you have already consented. Have a license to 'drive' that thing? You have consented. There are invisible contracts all around us.

When a cop asks you for your name, he/she is really asking you if you want to contract. Because a cop is an actor, or 'legal fiction' in law, they need your 'legal fiction' (which is your NAME) to do any lawful business with you. Try it out for yourselves, it's a real eye opener. I had a friend recently who ran into trouble with the police recently... he is a flesh & blood man, authorised representative and secured party creditor to his 'Person' or 'Name'. He declined to contract with them, so they decided to kidnap him and hold him at their club house. He handed his 'Notice of Understanding and Claim of Right' to the police, which clearly states who he is. The police freaked! They kept hounding him... 'What is your name?', to which he replied 'this is who I am...' pointing to his notice. They needed him to physically admit he is a 'legal fiction' in order to act on him. He stayed strong and was finally released without charge, albiet 8 hours later after some serious 'Ohming' and meditative chanting in the cell. He's now got a claim in of his own.

I know this sort of talk is going to meet resistance from people, especially anyone with a so called 'legal' background. 'Legal' only deals with the de facto world of legislation and statutes and has nothing to do with the 'Law'. It's based in admiralty jurisdiction, or commerce, as you probably know...it's all about the benjamins.

Claim your rights bro, don't beg for them... and learn how to stand under your own law. Learn how to use an 'affidavit' (which stands as truth until rebutted), learn how to operate your 'StrawMan' or 'Person' in commerce, and above all... open your mind to the tools we all have available to us to reclaim the freedom that has so sneakily being stolen.

Here is the best advice. Keep you trap shut until arraignment or when they officially charge you. At that time get your lawyer. Don't waste money because that meter starts as soon as he takes your case. And for the love of God get clean for a few months. You will be subject to a piss test. Don't fuck around and try subbing.

when would they piss test me? i dont think they'll be testing me until(or if) im on papers....im pretty sure they already charged me...i have an initial hearing set and they are charging me with felony possession. not sure what arriagnment or w/e is....

my address is has been the same since ive been born. i live with my parents...we also run a business. if something came in the mail....i would have known. trust me.
we were going 10 over. no need to insult me.
i didnt know he even had a beer, i was in the back seat.

Id still go to court without a mouth piece, if your on a small to med bail that is a pretty good indication of what is going to happen. Being your own lawyer should mean you can request the case details of the charge vs waiting till after final court case,

Ya know what I do when LEO pulls me over and I have a small bag on me? (always small, never bigger than an half zip) I put it in my butt cheeks as fast as I can without the pig asking why I was moving around alot. WORKS EVERYTIME!!!!

so i was talking to a friend who was in the same position as me a few years back and he says he had a "public pretender" and got 14 days jail and 1 year probation, and im going to have a kickass lawyer so the outlook is pretty goood i guess....
