I am partnering up with a Canadian to run a medical marijuana site in Canada, I live in the US. This is an internet business that members pay to join. It is legal in Canada.
Can I get into trouble for this?
Can I handle the payments in the US?

I am not 100 percent on this one, but i doubt it would be legal for you to accept payments in the U.S because of interstate/country commerce. this is something i would take to a lawyer, specifically one that deals with businesses and only trust his opinion, unless there are lawyer up here that would chime in, either way, get your own and run it over with him/her

Well, if you're selling anything, you could end up like "Elite Genetics". Crossing state lines is a nono. Medical MJ is definitely restricted to your state, and Federally, unfortunately MMJ defence is not even allowed in court..

Something (weed or money) is going to cross borders and Uncle Sam won't be happy about that. It sounds like you're trying a Reverse Emery move. An American trying to make money off of weed being quasi legal in Canada without the danger of having smuggling it. I'm wondering why a Canadian would want or need an American business partner.

I've dealt with something very similar bro except not a formal 'medical' site or service. I would not recommend you leave a paper trail. In fact payment for the beans was run through a third party even though a money order. While states may have med laws it's definitely illegal to transport across state lines and now you're talking about across country borders. Even within state there's guidelines for 'vending' and that differs state-to-state also so legal in one state is not necessarily legal in another. I'm not a legal expert by any means but will have to vote not legal to do what you're thinking and if caught I don't think it would be very pleasant if they prove it was for commerce.

What are you missing? Ummm I never said anything about selling anything to anyone. We provide a service to med patients, we don't have or deliver anything. This is just a new type of service for med users. I am not going to say what it is, cuz no one is doing this.

I just was curious if everything was run out of canada, can i get into trouble?

It's my understanding in the US they can possibly get you under RICO depending on what your doing. A friend was an admin at a US based MMJ website and mentioned that so he used layers of security and encryption also in some cases for communication when helping people. Honestly never seen anyone charged under that for dealing with canna information though.

If you wanna be sure and you are making an investment I'd also invest in talking to an attorney. I wouldn't mess around. If dealing with MJ stuff in general you should already have an attorney.

Man, if it has anything to do with pot, you have to be certified by the government....Then it's legal, if you don't do that, you will go to jail man, so will your buddy here in Canada.........If your buddy is not medically licensed and you guys handle pot, seeds or clones you will go to jail.

It's kind of hard to give an answer without knowing what the service is. If it isn't illegal here and it isn't illegal there then it isn't illegal.

But if it isn't illegal I can't see you selling anything to med patients....

I have no clue but the scenario of owning a piece of an Amsterdam coffee shop comes to mind. I mean shit...GW Pharaceuticals is a Great Britain based company focused on cannabis drugs and trades under the ticker GWP.L. Does this mean as a US citizen I can not own any shares cause there supposedly is no medical use for cannabis in the US and such a company would be illegal in the US?
