Before i begin my story, i feel i should mention this thread is intended to get some help in formulating ideas of what to do next; im not posting this simply for the sake of posting.

I'm in college and at the beginning of the year me and 3 buddies from the dorms decided to get an apartment together. I hadn't known any of them for more than a year, but they were all chill guys and thus we signed a 1 year lease together for our apartment.

Me and another roommate decided to start a medical grow at the beginning of the year. The other 2 roomates were down, and we smoked them out a bunch. Everything was good until today...when out of the complete fucking blue one of the roomates called up and said he was coming over with his parents to move out......
.....i was pretty shocked, to say the least. He gave no warning. Talking to him, he explained that he didn't feel comfortable with the grow going on (even though it's legal here in CA, i can understand where he was coming from) and that he was also uncomfortable with the inevitable messes that accumulate in college apartments. We tried to reason with him, saying we would take down the grow, but he simply would not listen. His parents came over and helped him move all of his shit out, and gave me 250 rent for next month (it's 550 a month for each of us) and said after that they wouldn't be paying.

His dad told me that he wouldn't let the land lord or our parents know about the circumstances of his son wanting to leave (i assume his son told him about our grow) as long as we didn't make them pay the rest of the lease.

So this is the fucked up situation i find myself in. Im flipping my kids into flowering tomorrow....but really, what do you guys think i should do? I have a legal grow but i don't want my parents or land lord to find out, but at the same time i cant pay up this assholes remaining 6 months of rent. I'm thinking perhaps to finish off this grow and then take them to small claims court, because i cant see myself tearing my grow down. any advice you guys might have for me?
 
if you're legal and within your limits then fuck that. did that kid's parents sign the lease? if so, get rid of your plants just to be safe and take whatever legal action is necessary to get them to pay up, what they're doing is pretty much blackmail


edit: toss your grow no matter what you do, it's highly likely by now that more people know about it that you want to.

got damn that's fucking lame. but then again shouldn't be growing in a college apartment. legal or not you'll end up getting fuct in the long run, ppl stealing, ect.

that is a tough situation you are in my friend. i too, have had a similar experience with what is going on there. my roommates are fucking pigs and slobs, never clean after themselves and last semester i was fed up with their shit i almost up and moved out. but i didn't. but legally, he is obliged to pay rent, that is if he and you all signed individual leases. i think a joint lease is when all of you pay your months rent, and if one guy doesnt pay it, the others are responsible for it. i myself signed a individual lease, saying that if i fuck up, i'm responsible for it.

here's what i found on joint lease...
"A joint lease is kind of like a corporation in which one person in a corporation cannot be held liable; rather, the whole corporation will be held responsible for the actions of everyone. In the same respect, all roommates are held responsible for the lease, if one person breaks the lease in a three bedroom apartment, the other two roommates are responsible for paying the TOTAL rent."

Each person is held responsible for his or her own actions. For instance if one roommate breaks the lease that person is still responsible for paying their own rent, etc. Most landlords give you the option of a joint or individual lease is make sure you ask if the options are available.

now im not at all familiar with the cali prop 215 laws or anything since im more than a few states away, but if you have all your papers and stuff for a medical grow, then you should be fine right? if you guys did sign individual leases, tell your landlord (if you have the cards/papers for a med grow) that guy who moved out isn't paying his share of the rent that he is LEGALLY obligated to pay. i hope i cleared some things up, not make them more confusing. its kinda late, so let me know if you need me to clarify something. cheers and hope everything works out for the best.

Edit: damn i got beat. maybe a friend would be kind enough to take on the grow for you?

i remember reading about how many apartment complexes didn't want/like 215 medical patients growing on their property. so if words gets out even with his papers he might find himself looking for a new apartment...

anyway i'm not in cali so what do i know...

same here. idk about the laws over there. might just be better off moving/getting rid of your grow and take legal action. nobody likes a shithead.

I wouldn't let anyone fuck me in that way but I tell you it's just me. I'd take plants out, clean up and press hard on fucker no matter what. In my opinion show weak once and you lose respect to yourself for good (or at least bi time). But that's just me. I could only advise you honestly to do how your heart tells you. But in my opinion they consider you a shmuck.

theres only 2 things ou could do,

keep the grow and pay any money thats outstanding yourself,so your gonna de around 3k short over a 6 month period is your crop gonna be able to handle that and still give you a good smoke?

other option is dump the plants and go after any money which your roomate wont pay.

they say there threatening to tell the landlord but if you have no plants or grow equipment you should be good.just say they are only saying this to get out of the lease.

all said and done leave this apartment at the end of your lease and find somewhere new on your own,if you cant afford a place on your own then you shouldnt be doing indoor grows leagal or not.

sorry but i find the part about you being legal to grow but dont want your parents to find out quite amusing

As long as they have dirt on you, you don't stand a chance. But seeing how they never came face to face with said grow, it's all hearsay. If his name was on the lease, he'll have to pay.

Then I would remind this guy that Mommy and Daddy will not be around forever to bail him out of his bad decisions. I would also make sure that this guy's parents knew that he was complicit in the operation from the beginning, so their little angel isn't so innocent himself...

Honestly, this is why you shouldn't ever involve extra people in your grow. It needlessly complicates things...

With your medical rec you should be able to discuss this fairly openly. It's not like you were breaking the law, you are just growing your own meds instead of wasting rent money. Was the room mate aware that you are legal?

2. Collect the money thats due from your old roommate. He signed a lease, he owes.
3. Move to a new apartment (either now if you want to break your lease, or when it runs out)
4. Re-start your grow.

his name is on the lease and that doesnt matter. what matters is if they all signed a joint lease, he and the other two guys (inverse and his buddies) will have to pay that guys (the guy who backed out) share. or if they signed individual leases, that guy who pulled out is responsible. not inverse and his amigos.

If you think $250 is worth you growing in the future then take him to court. You may want to take down the grow and also leave it alone. Legal or not you done want people breaking your doors down in which case your family would find out for sure.
 
Being in the real estate industry for several years I can definitely say that the people posting in here are correct. Fuck that stupid little momma's boy. He is legally obliged to pay the rest of his lease off. The fact that his parents would blackmail you with your medicinal grow shows a new level of human lowliness and incompetence. Chances are the little fucktards parents couldnt keep paying the rent and needed a quick out on the lease. Using your grow as blackmail was the perfect out for them.

just sublet the apartment and have some move in for the rest of the lease and pay what the kid was going to.

you were 100% wrong for putting two non-med users in that position. You DID NOT say that the plan to grow was made before you all signed that lease & so I'm going to assume that it was in the planning stage after everyone signed the lease, which is exactly the way it sounded. Had the other guys known you were going to start a med grow they might've said no. If the DEA kicked in your door all 4 of you would be up on charges for something only two of you had 'ownership' of.

I've been in real estate for MANY years & the courts will NEVER uphold the obligation of the student who decided to leave. All he has to do is say that you shared your meds with non-med users and you're talking expulsion from school and criminal charges (probation is likley) and of course a criminal record for 'marijuana' related offenses keep you from ANY AND ALL GOVT. SPONSORED TUITION GRANTS<----- still sound like a good idea to chase a few $$$??? Your fucking lawyers fees will BURY the amount of extra $$$ you're having to kick in at this point. Too bad they can't teach common sense in school, you need some dude.

YOU'RE FUCKED! Bone up big shot, pay for your mistake & be glad there's not going to be any legal ramifications. Next time you have a scheme like that make sure that EVERYONE on the lease is fully aware of your intentions from the very start. IMO you broke the lease by involving others in the grow even if they did do a bit of toking.

Exactly, you are in California, stand up for your rights, move, then grow again, I would not risk growing with such a breach of security at that same spot either.(ie. rippers, DEA, etc..) even if you grow a small amount, too many people know and it's turning bitter, it can only get worse, I wouldn't trust some lame ass people and their parents knowing about my valuable crop. BEST of luck,
