Like I told the 50 people who private messaged me and alerted me to that (I was very polite to everyone, but I'm a hacker, I wouldn't let a slip up like that)

Thanks JJ but my name and address was used on the news and in the paper, I don't care if IC members know...I have nothing to hide anymore...the only thing I have left is rolling papers and a plastic clone dome.

It's up to you then. You can put it back if you like....

They where actually playing the bad boys theme song and laughing hysterically in my drive way, while eating pears they picked off my trees.

If you don't care about people finding out your real name and address then why did you bother blocking anything out in your original post? You should thank mr.Scorpio for looking out for you

Can you clarify that for me a bit...what do you mean discount and note (doc's referal)??

Thanks,
:joint:Elite

By discount I mean don't just throw up you hands and say I don't have a doctor's note/rec so Mr. Katz can't do anything for me. Indeed, he may confirm that notion if you consult with him, however I don't see any mention of a doctor's rec issued previous to the PG raid and medical conviction story to which I linked above.

Basically I'm saying don't give up until you hear the door slam behind you. Don't just assume it will. I've been busted and know that I was so inclined to just give up, and just when it's most important to do the opposite. Perhaps you won't have that problem, I hope not, I wouldn't wish it on anyone. Well, except for Blue Dot, lol.

If the fucking Senate would get off their asses and vote on the DC appropriations bill DC could be medically legal this year. Perhaps if you end up on probation a move to DC would be in order so that you can medicate without worry. Hell, even if you beat the thing medicating without worry is priceless.

State by State Medical Necessity Defense

Maryland
- As of May 22, 2003: 2003 Darrell Putman Compassionate Use Act passed which allows certain individuals to introduce evidence relating to medical necessity under certain circumstances (if medical necessity is found, max penalty imposed can be $100). This Act amends the Maryland Md. CRIMINAL LAW Code Ann. § 5-601 as follows:

o 5-601. (c) (1) Except as provided in [paragraph (2)]PARAGRAPHS (2) AND (3) of this subsection, a person who violates this section is guilty of a misdemeanor and on conviction is subject to imprisonment not exceeding 4 years or a fine not exceeding $25,000 or both. (2) A person whose violation of this section involves the use or possession of marijuana is subject to imprisonment not exceeding 1 year or a fine not exceeding $1,000 or both. (3) (I) IN A PROSECUTION FOR THE USE OR POSSESSION OF MARIJUANA, THE DEFENDANT MAY INTRODUCE AND THE COURT SHALL CONSIDER AS A MITIGATING FACTOR ANY EVIDENCE OF MEDICAL NECESSITY. (II) NOTWITHSTANDING PARAGRAPH (2) OF THIS SUBSECTION, IF THE COURT FINDS THAT THE PERSON USED OR POSSESSED MARIJUANA BECAUSE OF MEDICAL NECESSITY, ON CONVICTION OF A VIOLATION OF THIS SECTION, THE MAXIMUM PENALTY THAT THE COURT MAY IMPOSE ON THE PERSON IS A FINE NOT EXCEEDING $100.

Home > Legal Issues > Medical Necessity Defense
The medical necessity defense is usually grounded in either a state's common law or general necessity defense statute. Regardless of its origin, the basis of the necessity defense is that society is sometimes willing to excuse or even justify conduct that would otherwise be illegal if that conduct was done to avoid an even worse or greater evil.

State By State Laws

Medical marijuana: This state has medical marijuana laws enacted. Modern research suggests that cannabis is a valuable aid in the treatment of a wide range of clinical applications. These include pain relief, nausea, spasticity, glaucoma, and movement disorders. Marijuana is also a powerful appetite stimulant and emerging research suggests that marijuana's medicinal properties may protect the body against some types of malignant tumors, and are neuroprotective. For more information see NORML's Medical Marijuana section.

I would call that lawyer that was linked to earlier. I read that story and if he can get that guy off with that you shouldn't have an issue. If cash is going to be a problem, you need to tell him that up front. Tell him you can work out a payment schedule or whatever. If you do have all those illnesses documented and he can find some journal article saying that MJ helps those conditions you should be paying a 100 dollar fine and walking your happy ass out of court with a grin from ear to ear. Oh and if the press want to talk to you, make sure you say something about violent police raids on MMJ users and about the benefits you get from MMJ over the other drugs. Its always good to stand up for MMJ if you get the chance :)

Sorry to hear of your bad news Elite, sounds like some sound advice from people in this thread, when you get out of the shock of it happening you could well find the Med angle will keep it non custodial. Best of luck.

Maybe if you show up in your pajama's ? ;>}

LOL ChaosCatalunya, you could be right ;<}

Elite, I am sorry to hear of your troubles yet, I am curious as to why, if your state has a Medical Marijuana program and you use this plant medicinally, why you were not already registered as a participant? Is it an age restriction thing? I ask that due to your acknowledgement of growing in your mom's house.

If that is the case, I believe your case could serve as a prime example to others that your law needs an adjustment. Each and every Medical Necessity Defense case leaves in it's wake, precident.
When Medical Necessity Defense is sucessful in overwhelming numbers to the defeated pleas, Medical Marijuana Laws are strengthened.

I don't know your situation nor, do I know the evidence or motives atrributed to your case.
If your situation is similar to that of mine, an individual growing their own for personal consumption only then, I believe a judge and/or jury shall see the Medical Necessity as a proper Defense.

Good Luck and, please let us all know how things progress.

I understand why the mods deleted the info to protect your identity. But Im a firm believer that bust stories should be told as a warning sign and reminder to us growers. Some details should be left so we know what happen and know what to avoid.

So... what happen?

Being busted I can see that.. Playing the Bad Boys theme song in the driveway I can see that.. But if I was to see one of them jerk-offs eating pears off my tree in the front lawn... That would have been then straw that broke the cammels back... I couldn't imagion what I would have done.. I woulda lost it big time.. I'm very envious of your ability to keep cool under it all..

Also if somebody handcuffed my mother... I would have def tried to resist and fight.. Good job at keeping your cool.. They do shit like that because they want you to fight and they want you to mouth off.. Then they use that in court against you.. I just couldn't take all that.. I hope the cops that ate your pears get a parasite and it rotts their assholes out from the inside.. I just can't beleive that.. The part about the pears just made me insane...

Make sure you get pics of the Pear damage left behind.I doubt very much permission was given to consume fruit from your tree on your property.

I can't believe you said that with a straight face, are you telling him to bitch about pears when they have him for growing? Yeah, that makes a ton of sense.

Casting doubt on their search and seizure procedures can help his case. Playing the cops theme music, eating his food, all point to improper conduct. Any lawyer will tell you to document EVERYTHING. People have gotten off for less. You think cops can walk into a grocery store and walk out with pears?

how did your mom not know about this stuff?! just kept it locked off?

My mom greatly respects my privacy, I was very slick. I'm nocturnal and shes so involved with her work, I could sneak a lot past/around her.

If you don't care about people finding out your real name and address then why did you bother blocking anything out in your original post?

Because I figured not everyone would know, so I just half assed it

You should thank mr.Scorpio for looking out for you

That was the first thing I did...Whats with all the questions??

I had a difficult time getting klonopin for my anxiety. This is MD not CA. They don't prescribe MJ unless you have like MS or Glaucoma. Doctors won't prescribe MJ for my ailments. With all due respect, just because you can "copy and paste" our laws, doesn't mean you understand how they work...
