I got arrested today...AGAIN

Well ladies and gents, Huff and Puff is really on a roll! I got bagged for doing 42 in a 35- but I was beyond the 35mph sign, looking at a 55mph sign 10 yard ahead.

No speeding ticket, but apparently my license was suspended. Same shit happened 7 months ago. I had gotten a ticket and paid it. Apparently, they spelled my name wrong when they entered the info, so although the check was cashed, it didn't reflect that I had paid it. I got pulled over 7 months ago, and bam. car towed, and impounded. Found a roach that I musta dropped weeks before during an "inventory search prior to tow". So now its OAS and possession. paid 2 gs to a lawyer to take care of it, and I had the charge dropped to Operating without a valid license. (what you get if you get pulled over and your license is at home) The possession charge was dropped.

So I was on my way to a final exam today when I got bagged. Great. What I don't get is why the fuck my license is suspended?!?! They told me after the disposition of the other charges that I was all good, and that didn't get resolved till last month. All I can think is that its something real old that just found its way through the system, or the idiots at the clerks office didn't process my stuff. If I find out its cuz of the spelling of my last name again, I'm changing it to Smith.

So now I am going to have to pay another $2000, because if you don't get a lawyer in this facist country of ours, they think you are poor and they fuck you. There is no more 'adversarial system' at work in the courts any more. Defense, prosecutor and judge are all buddies, and they are all there to make sure the defendants cough up as much dough with as little struggle possible. Get a lawyer, and you are paying for an influential friend of the prosecutor and judge. Don't get one, and you will be found guilty of your offense. More likely, they'll convince you you're getting off easy and have you plead to a 'lesser offense'. An offense the lawyer woulda made disappear anyhow.

So, to my fellow heads......
Pay tickets on time. Check with your DMV the week after you send payment, to be sure that it was processed correctly. Apparently do this after any applicable court appearances, too. And if you do get charged with something, pay a lawyer and probably half of the original fines. Otherwise you'll be paying all of the fines and will wind up with shit on your record.

What upsets me most, is that this is just a fucking excuse for revenue. I pay taxes, I work, I go to school. Now I have to pay bail, impound fees, towing fees, take a day off to go to court and miss a final exam. You know what, just take fucking 3 grand from me once a year, and give me a little decal/sticker that keeps me immune from minimal infractions like this garbage. If I'm drunk, or a threat to other drivers, have at me. But if all you want is money, why not? It'd be like paying insurance. Or maybe more like the "protection" money certain businesses in Boston's North End have to pay.

Hope you guys and dolls had a better day than I did.

Stay safe and be well,

HAP

my friend, he lives in a condo, so there was something wrong with the toilet, it made a buzzing sound, so instead of calling to check up, they checked each place.

We're all like little lobsters trying to climb out of the big fish tank. As soon as one lobster has a leg up, 10 other lobsters drag him down trying to climb over him to get out of the fish tank while those on the outside (lawyer, judges, police) point and laugh at all the stupid little lobsters trying killing each other to get out.

Sucks brotha,

Similiar less severe story here..... Got a ticket for speeding a year or so ago, cop managed to file two tickes into their system for the one incident. Duplicate tickets. so after I paid the ticket , I kept gettin these notices in the mail, you got a warrant out for your arrest etc etc... called the court up MULTIPLE times, they assured me that it was all a mistake, that it would be corrected, the additional ticket deleted, and to ignore the warrant requests.... warrant round up time comes and i figure ide double check that it was all taken care of... Call them up. Get a rather snooty lady on the phone demanding I come in and pay for this outstanding ticket. After a good 10 min of argueing finally got to a supervisor high enough that ensured me that it would all be taken care of that second. Ask for a letter of confirmation. thats my .02

I had a similar situation, but i was on probation at the time. while driving home one night i was pulled over by 4 cop cars, so i knew i was fucked but why i had no clue, when the cop came to my window he told me that he had run a routine licence plate check and my license was suspended for a missed vehicle emissions test. i told him that couldnt be possible, that the vehicle was registered in my mothers name, he looked shocked when i handed him my insurance card and it had a different name on it, as well as an up to date cert that my vehicle had passed emmision the summer before, he took my dl and came back informing me that since i was on probation i had to get out of the car. his partner started in with the "you have a colorful past" and such telling me how they dont like doper scum like myself in their town and that they were going to search my car, and that i had better tell him where the dope was. i replied i have nothing in the car and clicked the door lock on my key chain. with that i was pushed down onto the ground and handcuffed i watched as the cops took my keys and un-locked the door. they found nothing, but still took me in for suspended license and had my car towed and impounded. i called my lawyer the next am, after having my ma come down to get me at 1 in the morning with a $100 bail, i told him the court date and he was like i already have 7 cases at that courthouse that morning anyway so ok. i called around and found out what had happened with my license and corrected it, saw my probation officer and informed him as well. i get to court and the cop and his "posse" are all there, one makes a snide comment in the hallway loud enough for me to hear, on me going to prison for violating my probation. my lawyers bright and smiling face comes into view, and he tells me to go in and if iget called to ask the judge to pass until my lawyer can get into the court room. my lawyer had to collect from some other clients. i go in and am called first, the cops are all smiling, i say good morning to the judge and he asks if i had straightened everything out before i can say another word, i say yes your honor, the judge says case dismissed and the cops are not happy. i go out into the hall and my lawyer is walking up to the door i tell him, its done. my po comes up and tells me that the cops from that town are a bunch of cowboys, and that he is not going to violate me this time and to keep my nose clean. my lawyer says well lets just keep this love fest going and that i dont have to pay him for his appearance, i looked at him and said man i should have been a lawyer all i had to do was say the word yes and i was free. moral of the story is you can be obeying the law and still get pulled over.

good luck bro, i hope the instructor of your class has sympathy for you and doesnt screw you over on the final. i also hope that your outcome is the same as mine.

peace -fb

Sucks man, I've had it happen to me also. Had a ticket that I piad, but was told I hadn't. I never knew until I got pulled over and was told I was driving without a licence and had to let someone else drive. After a huge pain in the ass I got it straightened out. Gl.

I've been pulled over a few times myself for traffic violations, i'm a very nice person and respectful. And have shown much respect to the officers each time addressing them with confident yes, no, and always calling them sir. Some returned the respect and where very respectable people, but too many seem to be arrogant assholes that just want to bust you as hard as they think they get away with and show you no respect. Maybe if so many weren't so jaded and respected those they where sworn to protect people would have alot more respect for them in return

Oh, don't get me wrong. I may bash cops when it comes to their enforcement of MJ laws, but usually not about anything else. And certainly not to their face. I learned that the hard way as a young skateboarder.

I have found a couple of things that seem to help. When you see you're getting pulled over, pull right the fuck over. Shut the car off, put the ebrake on, get out the reg, leave the glovey open. Rest your left hand out the window, and hold the reg and license in your right hand, out the window. This tells the cop that you know his job is potentially deadly, and that you mean him no harm.

Always refer to them as "sir" "ma'am" or "officer". Always remain calm, and speak to them in calm, pleasant tones. NEVER give consent to search, but be aware- IF THE COPS HAVE ARRESTED YOU, THEY WILL PERFORM AN 'INVENTORY SEARCH' PRIOR TO TOW. Let them find what they are going to find. If they are going to find something, and you know it, do not listen to them when they tell you to help them out.

That is where you tell them you are going to exercise your right to remain silent, because you're lawyer has told you he will not represent you if you have waived any of your rights, at any point in time.

I refused to give consent to the cop during the first incident, and was "detained" and placed in his cruiser, until he could finish his 'inventory' search for the roach he suspected was there. Too bad the big lout didn't mark my radar detector, gps, golf clubs or bowling ball down on the inventory form. It showed the judge that the search was a surreptitious ruse, and he told the prosecutor to go screw.

I respect the fact that on rare occasions an officer's job can be deadly. More often, however, they are doing paperwork or traffic duty. Either way, make it clear that you are not an asshole, but you're not an idiot, either and you should be ok.

The professor is the man, and he told me to take it on wednesday, and to take tomorrow to straighten some of this shit out. Good man, good advice. Called my lawyer, I'll be hearing back from him ASAP.

I do find it a bit funny that the cop had no way of knowing where my license was suspended out of, and so could give me no advice/leads on how to fix it. Oh well, I guess that's what the lawyer is for.

Thanks for the kind words gang. And, while it sucks that some of you have been through similar shit, it helps to know that it ain't just me, nahmean? And Rebel, I hear ya, bro. That was the possession charge cop. Here's what I've learned:

You cannot control the (re)actions of others, only your own. Don't let someone else's actions bring you down to their level, and you can sleep soundly that night because you can wake up and look at yourself in the mirror the next morning. The sleep of the righteous is a righteous sleep indeed.

Take care everyone, and thanks again!

I never ever carry my license and they never ever fuck with me over it. I am polite explain that I lost it and give them my drivers license number and birthdate and they happily write my ticket or my warning and let me go. Only once has a cop said something about me not having it and it was he didn't believe me, I simply explained I am absent minded and would lose my head if it wasn't attached. We chuckled and he let me go.

I have found the more attitude you give the more you get.
