Cmon now, he's a kid. I for one have done my fair share of dumb shit. IMO any country that allows people with multiple DWI convictions to stay but deports people for shoplifting, a glass pipe or some shrooms needs some serious legal reforms.

definitely make sure you've got a good and smart lawyer. try to get a direct meeting with the DA as opposed to waiting for him/her to question you. you never know, the DA might be a marijuana smoker as well and may just decide to be lenient. my friend is a paralegal and let's just say lawyers aren't the hardasses we all imagine. think Weeds on showtime! not all of them are guilliani-like.

going to the DA directly will give him an opportunity to see you as opposed to just having only a police officers report to go off of. a lot of times, this is why police WILL NOT take a statement from you. it'll be up to you to let the DA see YOU and not what the police officer made you out to be in the report.

my story doesn't have to do with marijuana. but basically i witnessed a police brutality and i stood up for the guy. he did DO the crime (stealing food) but there was about 5 officers wailing on him AFTER he was already handcuffed and a 6th officer who pretty much pissed pepper spray on him from just before he got in the cruiser to 10 seconds after he was tossed, door closed. this is when i spoke up. i was in my bedroom, 2nd floor, in my draws at the time watching this from the window. anyway, the report says i said all of these things and that i even THREW something at one of the officers. i was charged with inciting a riot and disorderly conduct and another charge that i can't remember which was later dropped. and no, no assault charges for allegedly throwing something at the officer. it sounds worse if you read the whole police statement. they made me out to be a seriously rabid animal.

but my lawyer got me to speak wit the ADA (assistant DA) on the case and she got to see me! SHE WAS HOT TOO! :redface:

but she got to see ME. college educated, running own business (marketing and advertising if anyone's interested lol), with obviously enough funds for a damn good lawyer - A DAMN GOOD LAWYER. NOT the rabid animal the police painted in their statement. we had to wait to see what would happen. she said she wanted to speak to the officer first. about a month later, i get the call from my lawyer that the ADA wants to offer me an ACD (adjournment in contemplation of dismissal) which means if i don't get into any trouble in 6 months, the case would be dismissed and SEALED! NO RECORD. my lawyer told me to take the offer.

I REJECTED THE OFFER!

let's be real here. im witness to a police brutality, along with many others who were standing around. i saw everything directly. and how in the hell does one cause a riot from their 2nd floor bedroom window in their fuckin underwear

anyway, a month after that we go to trial and they give me the bullshit. the ADA is sick and our case is pushed back. LOL. another month later, she decides to drop all charges and dismiss the case. i still win, no record, no bullshit ACD either. either she didn't wanna bother with me anymore or she realized it would be hardpressed to paint someone like myself as the rabid animal in front of jury. who the hell knows exactly what went on in her mind at the time?

point is, when you're in that situation, it's about the cop first... do what you can with him. you got 5 of 6 charges DROPPED. good so far. next is to worry about the DA because that's who will actually present the charges. the cops can't prosecute a case. only the DA can. work with the DA directly, not saying skip the lawyer but if there are any meetings YOU BE THERE AND YOU BE ON YOUR BEST! don't show up in a suit or shit every time. JUST BE YOU! if you get a good reduction in the case, take it. in my situation, i was lookin for complete dismissal and NOTHING less. for you, there's real evidence so try to go for an ACD or community service or something that could clean your record. if that doesn't work then you've got to deal with the judge/jury. and that's who you work on!

Here in California, where less than an ounce only carries a $100 fine, is the charge STILL reported to the feds? That could mess up A LOT of things in a person’s life.

It’s a question I have no reliable answer for. Does anyone have reference for this?

A first conviction for possession of under 30 grams of marijuana (misdemeanor in most localities) is not deportable. The second is. The county/state will notify the local office of the INS. Very often, people will be picked up by INS at probation or at jails around the country. That's when the fun begins.

BTW PoppinFresh: he's not illegal. He's a green card holder. Doesn't matter that he's spent like 99% of his life in the US. He can be deported.

I hear ya on his status. But, it's just as it pertains to the media. Let's be real here. We all know of placed in the right hands they would make the poor kid out to be satan if they could.

This brings up an interesting point.

When I was arrested, it was a criminal offense. I even had to spend the night in jail for an eighth of crappy mexican brickweed!

Some states, however, treat misdemeanor marijuana possession as a civil offence, which is on the same level as a traffic ticket.

I am not sure if such civil offenses are reported to the FBI or not.

Because of the OP's post, I guarantee you the FBI will be notified of this "crime".
