If in the back seat of an autonomous self-driving vehicle and one is legally intoxicated, can they legally be charged for DUI? After all, they're not driving, the car is.
 
Id assume not. They are in the back seat. Its the law that someone must be in the drivers seat as a back up that would get them in trouble. Can you over-ride an automated car?

yes of course he/she could be charged, the person obviously entered the vehicle at some point & then engaged the vehicle to drive somewhere, while they were drunk.

Could and would that vehicle operate on its own, going from one place to another w/o the drunk in the back seat? I kinda doubt it.

No, you haven't invented the ultimate way to get your drunk ass home after a night in the pubs. Grab some bud, stoke up that bowl, Totino's, Netflix & chill.

Hmm... I wonder if the car could be charged with DUI if running on alcohol.

I wondered the same thing.Stoner is probably right.my alcoholic ass aint getting a get out of jail free loop.not that i would drive drunk

Several people have gotten DUIs while riding horses, so I'm going to say yeah.

yes indeed, I've seen it on the news in years past. can you imagine the potential of danger/disaster a drunk on a horse possesses? the unpredictability of a horse in traffic, and of course the very good chance that if there's an accident of sorts, it will very likely be the horse that suffers.......

I got a DUI for nodding out at a red light turned green for a few seconds,and hadn't had a drink of alcohol in around 11 years.Now the truth.I took some Xanax and got behind the wheel and am so lucky I didn't hurt or kill someone,one of those really stupid stupid decisions.The lack of alcohol for 11 years was the only truly honest part about how it went down although I did nod after the light turned green.No erb since November because of probation,and I deserve it at least.My head is sickeningly clear.To answer the question hell yea you could and probably would get a DUI.If the mechanism fails it is your responsibility to drive it or get it out of the road.

I don't think it exists yet but I could be surprised!

Oh how wrong you are. I know several people that were asleep in the back seat that got a DUI because they were in possession of the keys. One had the keys in his pocket, another left the keys in the ignition. In all cases, the car was parked and not running. Still got a DUI.

WTF?? Someone responsibly sleeps away their drunk but gets a DUI anyway??

I think that depends on the state. DUI laws are governed by the state although the .08 threshold may be national. Check your state laws.

they are trying to lower .08 in one or more states.i believe it was Utah or similar.and yeah if you are in possesion of the car it doesnt matter what seat your in.

I know there is something in Fla law about key accessibility and the only way I know of that would make them inaccesable is if you were to give them to a friend or someone and they took them home with them.Of course if you could do that you could just catch a ride home with the person lol.They just passed a smart law down here for a change.Before the law,you car could be towed and impounded the evening you left it in the club parking lot.The new law says your car cannot be towed away until sometime the next day,like 24 hours after discovery or something similar,I'm not positive about the details but it's a smart law that will cut down on people driving home when they shouldn't

The laws will have to change as fully autonomous self driving cars become a reality. Taxi companies along with uber and lyft will go that route 100% once the technology is tested and proven. People will take taxis home from the bar drunk, no actual driver in the car with them.

I heard growing up that you'd be safe from a DUI if you slept in the back seat with your keys in the glove compartment. This was in Florida. I don't know if that's actually true.
