CLEVELAND POLICE SEIZE 12 POUNDS OF MARIJUANA FOUND IN UHAUL TRUCK

On Sunday, March 11, 2012 around 8:49 p.m. Officer Paul Young with the Cleveland Police Department was patrolling in the 1000 block of U.S. Highway 59 northbound where he observed a U-Haul moving truck traveling north on 59 that was failing to maintain a single marked lane.


Officer Young initiated a traffic stop on the U-Haul truck, and met with the driver who was identified as: Anton Cortez Garvin, Sr., a black male, age 46, showing an address in Belleville, Illinois. Garvin was asked about his travel, and where he was coming from and his destination.
Garvin stated, “he and a girlfriend had been living in the Pasadena area, but have recently broken-off their relationship.



Officer Young questioned Garvin about what was in the back of his truck, and Garvin said, “just some of his furniture”. Garvin allowed Officer Young to look inside the back of the truck. According to Officer Young indeed furniture was inside the back of the truck, but he also smelled an odor of marijuana. The furniture appeared to be in poor condition, according to Officer Young.


Officer Young said, he noticed a dresser that had broken hinges, a broken drawer, and a missing lower drawer. The position of the dresser, and the path leading to it appeared very suspicious to Officer Young. According to Officer Young the closer he got to the dresser the odor of marijuana
became stronger. Underneath the dresser Officer Young discovered a new black duffle bag stuffed in the area of the missing drawer. The duffle bag had an odor of marijuana emitting from it. Officer Young removed the bag and opened it, and noticed a large block wrapped in green plastic film. The block appeared to contain a green leafy substance that was believed to be marijuana. Garvin was immediately placed under arrest by Officer Young, and later transported to the Cleveland Police Department’s jail.

Anton Garvin was charged with felony possession of marijuana less than 50 lbs., but more than > 5 lbs.; Third Degree Felony; an individual adjudged guilty of a felony of a third degree shall be punished by imprisonment in the Texas Department of Criminal Justice for any term of not more than 10 years, or less than 2 years, in addition may be fined not to exceed $10,000

I just don't get cops right to ask you where you're going!?!! It's (was) a free country isn't it? To me the Barney Fife hunching and searching for problems is not what we have peace officers for. He's been pulled over for a traffic offense ticket him for that and move on.

I could understand if the guy was fitting the description of a escaped convict or murderer, but a simple traffic stop should never end this way, so sad! :rasta:

By my count, he made 5 but really only 1 matters. Switching lanes leading to the pullover, it all stems from that. Supposedly. It ain't like cops aren't known to make shit up to justify pulling people over.

1) "failing to maintain a single lane" -- If he doesn't do this, he doesn't get pulled over, theoretically.
2) Poorly hidden & poorly odor controlled contraband -- If he has things packaged correctly, being pulled over isn't such a big deal provided that he doesn't do #3....
3) Allowing the cop to search the Uhaul -- Um, wtf? At least make the pig work for it. Don't just roll over and let him search, dumbass.
4) Talking to the cop with his BS story, saying anything beyond the basics is asking for trouble. Learn how to speak to police.
5) Driving in Texas. They have 'Homeland Security' checkpoints with dogs throughout the state, particularly within 100mi of the border, which is called a "Constitution free zone". 2/3 of the US population live within this zone.

Did anyone catch what happened to George Hotz, the PS3 hacker? He was caught driving to SXSW with a 1/2 oz of bud and some edibles. They weighed the edibles and now he's facing a 1/2 lb felony charge.

btw in that county they know all about the uhaul gig, busted my boy with a load a few years back, as well as others doing the same thing. they are out on the hunt cause word on the street is cali to tx is the new houston hustle.

Really, hos one true mistake is allowing search of the uhaul. Up to the point of the pullover, there was no probable cause that would get him a search warrant. He would have needed to get K9 onsite, and go through the motions to get a search warrant.
 
Biggest mistake was he didn't have it hidden where if the cop wanted to find it he would have to unload the whole truck by the side of the road.
Sounds like it was easily accessible to the cop.
I don't know about the cop smelling it; they usually make that up afterwards if they find anything on their fishing expidition to make it look like they had grounds to search.
He also shouldn't have consented to the search, he should have known that the cop would find it given it wasn't hidden very well.
At least if he refused to consent to a search he might have grounds to get the evidence thrown out if the cop went ahead and searched without his permission.

I remember once I knew this guy, he was a small time dealer, but thought he was a "gangsta".
He was giving me a lift one night and when I came out of the apartment he was squatting on the footpath outside with scales and pot spread around on the footpath, making up deals.
Then on the way to where he was giving me a lift to he was so off his face that he swerved sideways and hit the kerb twice, and the glovebox was full of pot and baggies and scales and deals made up.
I quickly distanced myself from him, he was a disaster waiting to happen!

Is it me or does that cop not have the look of someone who failed math and science?? Ya'll know I love Texas but man o man ....I guess he could have been dumber and went up through Okie.I mean does Texas really have the need to do this, they won't bust the crazy, mean ass crooks.They just nab the stoned stoners, too sad! Here in the NE they let the cities go wild with serious crime while all the smaller towns on the coast with $ have about 16 cops per 3000 people.I know my town does.With any luck my grandchildren will look at this story as something remote and stupid...
