Fatalities Following A Home Invasion Robbery In North San Juan

Jan. 2, 2010 - At approximately 10:08 am this morning, the Nevada County Sheriff's Dispatch Center received a 911 call regarding a home invasion robbery that had just occurred at a residence located within the 12000 block of Tobacco Road which is located in the North San Juan area of Nevada County.

Apparently, 2 males wearing ski masks and black police type uniforms entered the victims' residence displaying weapons and indicating they were members of the Narcotics Task Force. Victims present in the residence at the time of the robbery included 3 adult males and one female (all between 25-34 years of age). The suspects tied up the victims by using metal handcuffs and plastic zip ties. The suspects then took from the victims their cell phones and identifications, along with computer equipment and one camera. The suspects then fled the scene in a white Ford F250 pickup truck.

One of the male victims was able to have his zip tied hands freed and gave pursuit of the suspects in his red pickup truck. The suspects fled on Oak Tree Road to Highway 49 and proceeded southbound being pursued by the victim in his vehicle. Ultimately, the suspect vehicle lost control and struck a tree along the roadside near the intersection of Highway 49 and Sauer Lane. The driver of the suspect vehicle was determined dead at the scene, and the passenger was life flighted by helicopter to Sutter Roseville Hospital due to apparent head injuries.

Early indications show the victim made several attempts to ram the suspects' vehicle, and that sometime during this pursuit the suspects fired several rounds from their weapons. At the accident scene a shotgun and one handgun were found in or near the vehicle. Additionally, a third handgun was located near the road way several hundred feet from the sight of the accident. Two large plastic bags were found at the accident scene which contained a large quantity of pre-packaged marijuana.

CHP is assisting with the accident investigation. At this time, we have been unable to confirm the identity of the suspect passenger, who was treated and released at the hospital, and has been arrested and will be booked into the Nevada County Wayne Brown Correctional Facility for homicide and robbery. Positive ID on the decease suspect driver has not yet confirmed. However, the suspect vehicle comes back registered to an address in Elk Grove, CA. This investigation is still continuing and further charges are pending.

If homeowners do not feel protected, they may well start shooting first and asking questions later--and it is not hard to imagine a scenario in which genuine law enforcement officers are killed by mistake. If I were in law enforcement, I would do all I could to prevent that happening to my people."


"I just looked and saw that a victim was in wayne brown, on what charges I do not know. I hope all charges are dropped and he is swiftly released. As a community we need to stand behind our citzens who take the law into their own hands. Living 45 minutes from police protection leaves us no choice but to take the law into our own hands. Lets support our fellow citizen and not allow these criminals to ruin his life."

Most of us would be willing to share a little of what we have with others who are in need, but this sort of action is criminal!! I'm so sad this has happened in our community, but I realize it's just part of the game.

Several years ago my home was broken into and vandalized. Apparently over 300 kids/adults had a grand ole party while we were out of town. When we returned there was a note on the only piece of furniture still standing in our home. It was from the mother of the kid who threw the party. She was apologizing and describing in detail what happened.

Not one arrest was ever made! No help from local authorities. I almost left Nevada County over it. It felt so betrayed and unsupported. But I did learn a good lesson from it. If justice is to be served, it's up to me. And believe me, I'm prepared today!!!

Victim still up on charges.
Charges lowered from murder one (for knocking the perp's truck into a tree) to manslaughter.
I've been up in that area; 'ridge justice' is alive and well.
The perps just got too far away from the invasion before the vic could take care of business...he got caught and now sits in the clink.
Me thinks poor security at the house set them all up for drama.

I saw that a couple days ago, and I get the feeling that whoever set it up, (everyone claims the thieves do not know the victim) is worried right now. Murder, Robbery, Burglary, Home invasion and conspiracy charges are probably in his/her future.

And the title should be: Home invasion goes "par for the course"

amazing, in the situation of living 40 mins away from law enforcement, whats the difference if it were CHP or the victim trying to stop the perp??? in the victims mind i believe he had to do what he had to do!

Authorities find more plants, red tag pot burglary property

Nevada County narcotics enforcement authorities have allegedly found another large marijuana grow at the North San Juan home invaded by apparent pot robbers over the weekend.

The home and property on Tobacco Road near the Sierra County line were also red-tagged by county code enforcement officials according to Sgt. Bill Smethers of the county's Narcotics Task Force.

"There were multiple code violations," Smethers alleged. "There was exposed wiring, a hot water heater heated by a wood stove and some unpermitted structures."

Officers obtained a warrant to search the property based on the large amount of marijuana found at the scene of a fatal accident involving the burglars after the heist, Smethers said.

On Wednesday, "we found 108 plants outside in a greenhouse and 30 to 50 pounds of processed marijuana (buds) and shake," Smethers said. Also discovered were bags to hold pounds of marijuana and weighing scales.

Three people with valid marijuana recommendations were discovered on the property but not arrested, Smethers said. However, charges will be filed against them.

The name of the homeowner is not being released, pending further investigation, Smethers said. He did say the owner was one of the four initial burglary victims at the home.

The incident occurred Saturday, when Terry A. McLeod, 51, of Sacramento and Timothy D. Fitzpatrick, 43, of Elk Grove allegedly robbed four North San Juan residents at the home of a large amount of medical marijuana, cash and property.

The men allegedly tried to impersonate police with raid gear and badges, according to the Sheriff's Office.

One of the robbery victims, Christopher Teachout, 32, of North San Juan, managed to get free from the burglars' bondings, and chased them in his truck. Teachout allegedly tried to ram the getaway vehicle driven by Fitzpatrick.

Fitzpatrick died during the chase when his truck ran off the road between North San Juan and Peterson's Corner on Highway 49 and struck a tree.

Teachout was arraigned in Nevada County Superior Court Wednesday on charges of voluntary manslaughter and vehicular manslaughter, with bail set at $25,000.

Teachout was charged because his actions may have led to Fitzpatrick's death, even though he was an original victim. McLeod was charged Tuesday because the robbery actions he was involved with may have led to Fitzpatrick's death.

McLeod was arraigned on charges of murder, two counts of robbery in concert, burglary and two cases of false imprisonment.

His bail was set at $1 million and the arraignment was continued to Jan. 7 to let McLeod hire a private attorney.

Hope they had their paperwork all squared away.

They have a very vocal majority in the local community backing them , I don't see how a jury would have ever convicted them in Nevada County. They better hope they don't end up in Federal Court in Sacramento, which is where the Federal (Eastern District of California) cases from Nevada County are tried.

I like the way that it's totally cool for a cop to ram a car off the road for something as minor as kids underage trying to buy smokes and then leaving them all dead, and this guy gets arrested on murder for ramming home invasion robbers off the road.

I also like the way some comment in the original post said that cops should do more to stop home invaders imitating cops to "protect their people" SO, the cops people are other cops, what about us? don;t they feel that we are people too?

30 - 50 lbs of pre packaged bud? they probably did clear a lot of the plants out.. and 108 what was left. how many plants in flower? veg? and clone? how long would it take to grow 30 - 50 lbs of pot... and thats IF they didnt sell any during that time... but yeah they should had cleared out 9 more!

and these are mountain boys In NSJ and they don't fuck around really tight community and they all protect each other and keep an eye out on each others shit it's all like one big family city folk gangstas and morons are out of there league if they think they can go up the hill and just take what they want just a bout everyone over there is strapped lots of dogs and outsiders can not just come and blend in they stick out like a sore thumb. As far as i am concerned the thieves got what they deserved and as for the victim he needs to be freed the 108 plants yea they should have gotten rid of 9 and cleaned out the house a murder cops will be all over and they will come back. so just a dumb non decisions was not made but shit happens. What i think is funny the cops are not worried that they were impersonated just that there was MJ and a murder have to love the way tax payers dollars gets spent.

The guy will be charged because he chased them down like that, his life was no longer in danger, they had left the house.
Killing someone in your house that is threatening your life is one thing, but the law does not approve of chasing them down after the fact, your life was no longer in danger at that point, that's why he will be charged.
I'm not saying it's right, but that is how the law works.
 
well lets put it this way one lived that is more then would have been allowed were i am at they came in acted like cops bound them robbed them threatened them with guns then tried to run away he gave chase they had 3 guns it stats but did not say he had one they fired a shot gun and hand guns at him he lived did not get shot and got one of them he should have got them both they tried to kill him
