GW Pharma Claims CBD and THC usage specific patents...

Question:

If I apply CBD and THC with the terpenes am I not completely out of the patents legislation? (i.e. -"novel" / "non-infringing")

Meaning: Ya'll know that those goofs over at GW still have no clue how to do things, even with smart folks like E. Russo on their team.

PS- It is possible to patent a composition and its application and this is a fairly common practice.

Considering that HortaPharm BV and GW Pharma work hand in hand with each other, I'm sure they've got it figured out and they know EXACTLY what they are doing.

Just take a quick look into HotraPharm BV. Enough said.

I don't think this is going to be a problem.
First, it's quite likely they do have to narrow down the cannabinoid ratio for a patent.
And since the application is for a rare form of brain cancer, it will only apply in that situation.
Then they must go thru FDA approval and prove it works, without too many negative side effects.

What will happen next is of greater concern. Once a drug is approved, drug companies can add to the list of applications for the drug, like for other cancers or pain or whatever. Those uses will need to be approved by the FDA, but probably won't require new patents unless they change the ratios and therefore the drug itself, which they might have to do.

But in the meantime, as others have pointed out, their studies should reveal how beneficial marijuana is for so many health issues.

And I really doubt a patent will prevent people from making their own tinctures. If you're not selling it, you won't have a problem. Even if you do sell it locally you're not likely to have a problem. You'd have to have exactly the same ratio as the pharma drug, and be selling it for the same reason(s). Which means the Pharma company would have to buy your tincture, analyze it, and if it appeared to be exactly the same, then take legal action to stop you from selling it.

Fact is companies are going to do all they can to profit from Canna, IMO people shouldn't be fearing it they should use it as they can to their advantage.

Details have been disclosed of the collaboration between GW Pharmaceuticals - the British Company licensed by the Home Office to conduct research into the medicinal uses of cannabis - and Dutch medicinal cannabis plant breeding company HortaPharm B.V.
Speaking at the International Cannabinoid Research Society (ICRS) conference in Montpellier, Dr Geoffrey W Guy, Chairman of GW Pharmaceuticals, said that HortaPharm will provide GW with exclusive access to its entire range of cannabis varieties for the development of medicines. The worldwide rights acquired by GW for an undisclosed sum cover varieties grown to date with certain exceptions and all varieties to be bred in future. Plant registrations arising from the Dutch breeding programme will be owned by GW. Under the agreement GW will be responsible for the development of specific drug delivery technologies to administer the pharmaceutical grade medicinal cannabis. This work will include a vaporiser for which HortaPharm has a patent pending. In addition GW will fund HortaPharm's botanical research and HortaPharm scientists will assist in the UK Glasshouse propagation, cloning and cultivation programme. Dr Guy, said: "There has been much speculation as to the exact role of the various chemical components of cannabis in treating patients with illnesses such as Multiple Sclerosis and AIDS wasting syndrome. In particular THC (the psychoactive constituent chemical) has received much attention. Historical medical reports and more recent work may point to the influence of cannabidiol (CBD) in epilepsy and stroke for example. We wish to explore the therapeutic benefits and the potential for reduction in unwanted effects that may be offered through administration of complete extracts containing various defined ratios of the principal cannabinoids." Mr David Watson, Chief Executive of HortaPharm commented "HortaPharm leads the world in its understanding of cannabis botany and has built up over many years the most extensive 'Living Library' of Medicinal Cannabis varieties. As soon as Dr Guy's clinical research indicates the exact desired composition our scientists can breed and register new medicinal varieties".

I don't see it as some big problem myself. But i'd hope they know what they are doing! as they are big players in it. What is it you elude to that they are doing? Voodoo?

I just don't get it, here they are proving the good uses of cannabis and then getting slated for it!.

But who is the major supplier of pharmaceutical grade cannabinoids? That's right GW- they have received regulatory approval for Sativex nearly the world over so it's no stretch to think they could get approval for all their other cannabinoid products too- doctors will be buying GW's products- this patent looks to be more about advertising what cannabis can do and getting orders in.

I've read some good things about Sativex. The only downside is the high cost and the fact that we can make our own tinctures much cheaper.

It's going to get harder and harder to argue for cannabis prohibition as these studies are completed.

Please explain to me how is it going to get harder when things are being proven for medical benefits? you think proven facts are a bad thing? the price should come down over time as with every other pharma medicine that has to recover the high cost to get the thing to market in the 1st place.

The only fear I'd have would be akin to what some fella posted here:

Of course big biz, big unions, or anything else with money, like big Pharma, and a reason to influence the government and laws will try. As long as you can grow your own, do you really care? Lets get everyone to admit Cannabis can help patients, products legal like SATIVEX should help in this effort.

the patent offices are a joke... some people I went to high school with who now run a lab at a major university get patents denied because the "experts" at the patent office can't wrap their 'lil heads around the pending patents...

nor can I, I went into the humanities lol...
