getting pulled over....

a friend insists the followign is true and has been upheld by the supreme court.........if a cop initiates a pull over in the middle of nowhere or in a dark/unlit place, you can put your flashers on, and drive slowly and safely to a well lit/inhabited location before pulling over and you are not responsible for resisting arrest or anything like that.... is this true or false or close to true or what?

That is true, you may encounter a real dick after, but let them/him know your intent. You have the right to feel safe during your encounter. Do yourself a favor and get your cell phone and record the whole thing. Will help when your fighting your ticket.

I have used that as a reason as I stashed my shit..

Also it wouldn't be resisting arrest as your are not being placed under arrest, evading is more the tone, but again the flashers help and don't use that time to throw anything out the window and they really can't go there..

15-20 years ago a local woman fled the scene from a uniformed officer in an official marked car. High speed chase and all that as she sped to the police station. I don't even think there was a "phony police" warning out, for whatever reason she was just scared and they let her go.

Personally, I've led leo for distance on my motorcycles, looking for flat, solid ground.

Your damn straight...I'm a woman and I swear to god I will NEVER let a pig pull me over in an unpopulated/unlit area.

so can i get a jjscorpio style "academic" answer for this? something with case numbers and details, etc.

when i got to my gurrilla plots i never carry more than a few small rooted clones that i could easily eat if i had 30-60 seconds to do it, but i dont wanna have to pull over immediately and be stuffing them in my mouth while a cop runs up and tazes me, so this is kinda important for me. many municipalities are facing budget cuts and will make it up by writing lots of tickets, and they like to prey on out-of-county/out-of-state tags so i REALLY need to know whats up as i leave my county to do my thing!

Here is a good general answer: If you are truly in a remote area and especially if you are alone, or female, or elderly...it is understood by MOST cops that a driver that may be afraid will not stop. BUT, you MUST try and let the cop know WHY you are not stopping. It would be a great idea to record it if possible, but assuming that is not the case, pull over to the right, slowly, and show your hands as much as possible and use your cell phone to call 911. Tell the operator that you are being pulled over and that you are afraid it might not be a cop.

The dispatcher should immediately put out a call to find out what cop , if any, is following you. Likley they would already know because the cops usually run your plate or at least advise they are trying to stop a car, especially when you do not stop right away.

Go SLOWLY during all this: Speed gets adrenalin going and makes a cop think you are evading him, not fearful. If you can get stopped momentarily and can yell to the cop that you are driving to a lighted area AND are calling 911 to verify it all, it would help a lot. That would at least let the cop know WHY you are not stopping. Go slowly and gesture enough to let him know your INTENT. intent is everything.

If the cops don't act properly, let's say they try to box you in with another car...STOP. Put your hands up and submit fully.Expalin it after you are able to do so. Never try to flee multiple cars that have blue lights. The odds of a highway robbery of other assault using multiple cars is virtually unheard of.In other words, resist stopping only minimally and do not put your life in jeopardy just because you are unsure if a blue light is legit.

If you do pull over for an UNMARKED car with blue lights, you should be looking out the window at who is getting out and coming toward you. If it is someone in plainclothes and you have a gut feeling something is very wrong ...then say: " I want to make sure you are a cop...I am driving to the police station or until I see a marked car".

Then lowly drive away. If a cop is legit, he should understand someone alone and scared at night...especially if they are NOT in a marked cruiser and not in uniform. After all, anyone can flasgh an official looking badge and get a blue light. So use your head...do not resist if it is a danger to do so, and try as much as possible to COMMUNICATE to the cop that you are just unsure of his status. Thats about all you can do. Just remember, whe you refuse to stop, som cops will take it the wrong way no matter what, and those cops will get you hurt.

You have to be careful with that... If a cop thinks you are alluding they will charge you for it.. Then you have to prove in court you were looking for a safe spot to pull over.. That's a losing battle.. Your best bet is to pull of soon as y0u can.. Now that dosent mean in the middle of an intersection.. Once I was pulled over and I pulled off to the shoulder.. About 200 feet ahead of me the shoulder was much much wider, so the officer instructed me to pull up and onto the wider part of the shoulder.. It's better to get scorned for pulling off in a less that safe area thgen it is to be charged with alluding...

If you pull something like that I highly suggest that you get on the phone with 911 and let the dispatcher know your intentions.

Here's a vid where a lady felt unsafe to pull over and look what happened.

http://www.youtube.com/watch?v=ibSwITK4jjQ

I don't have speakers right now, but I think she was unsure if it was a real cop or not.
And she wanted to drive to a more populated area.

Haha...since you didn't have speakers, you prolly didn't catch the end...they said, "In the end, she got a speeding ticket, and a six-figure settlement...and the cop got fired."--:yeahthats
