You NEVER give consent no matter what. Anyone who says different is no lawyer, and does not know the facts. In the worst case scenario, it is better to say nothing and never give consent, and it gives your lawyer the best chance of getting the evidence suppressed.

Why give the cops and prosecutors ammunition to hang you? Why throw away any chance of walking away or at least bettering your position? It makes No sense to give consent. if the cops had any right to is they would not be asking, they would be taking. it is like a cop telling yopu to empty your pockets; if you do so you are a sucker because if he had any grounds to go in your pockets he would have gone in them already. Cops don't ask, they take...when they have legal grounds. When they don't, they bluff, lie, bluster, intimidate, pressure, etc., to get us to give up our rights so they can have an easier tuime fucking us!!

Well, i want to make it as hard as possible to fuck ME...and so I never give them jack..and no one else should either.

I do agree, never agree to a search. Make them get a warrant. Who knows, that is one more step and they make fuck that up. That business that a dog sniffing your car means they don't need a warrant is Bullshit. I mean isn't a dog sniffing you a search with out a warrant? That needs to be looked into.

The issue of using dogs without consent has gone all the way to the supreme court and it was ruled constitutional. It is allowed because they do not see it as a inconvenience IF they are able to get the dog there in a reasonable time frame. I don't think they defined what a reasonable time frame; that would be up to a lawyer to argue.

it's legal for them to run the dog around the outside of the car if you do not consent to a search, i believe. Your only right is to roll your windows up, lock doors, keep mouth shut.

Actually your wrong and its spelled WARRANT, if you decline a search the cops can get a dog. Now if the dog DOESN'T alert then they cant do anything but if the dog DOES alert then that gives them probable cause to search the vehicle.

So true!!! Hell if i got a small bag i try my best to follow the rules. I would not consent in hopes the dog was busy. Now days they bring the dog pretty quick unless its on another snifing mission,lol. I moved alot of pot in my younger days and i followed 2 rules. Don't be high while doing it and follow all traffic laws and i never even came close.

People should realize that many cops are afraid of citizens with intelligence and confidence, and that all it takes sometimes is flexing your rights (which you should damn well know the LEOs are not ignorant of) and informing them about calling your lawyer whether you have one or not.
Anyway, never consent, ever...

Do you think the dog would alert if your goods are inside packaged well? I figured since they are only allowed to run a dog on the outside, then the dog would just sense the weed if it was hidden on the outside of the vehicle.

My buddy had just picked up a nice sized load one time, he was on his way to my house to break me off a chunk. The local police pulled him over, they wanted to search the car. He called me as they were pulling him over, he didn't say a word. I was like wtf is going on, just sounds like he accidentially called me and didn't know his phone was on. So I listened in for a min, and then I heard the cops asking him over and over to search the car. He was laughing at them and telling them there was no way they were searching his car without a warrrant or probabale cause. They danced around for like 10 min, they never searched him. You could tell by their tone they were pissed off. He had a few #'s of dank and a 45 in the car. Dumb piggys....

So your saying you have some magic song and dance "role" that you go into after the cops have asked for permission to search your car that makes them not want to it search anymore???? Bullshit.
Because that's what were talking about here, how to handle yourself once consent to search has been asked for.

Telling people to start making up some story(role) is bad advice.
Magic song and dance? :biglaugh: Its just common sense, and being aware of yourself and what is going on. Cops do tend to make me nervous, especially with the prospect of getting busted, but they piss me off! I have no problem being sly with them when it comes to potentially getting busted for herb.

Look, there are obviously many situations where its just impossible to talk your way out of, but sometimes you might find yourself in a situation where playing along will see you through. I'm a hairy snowman but, just for instance, I'm sure many hot women have wriggled out of certain busts by applying some charm. That's not too hard to imagine, is it? Have you ever watched episodes of CHIPS? :bigeye:

I do realize that many with pot on them have walked free by asserting their rights, its important for people to understand all their options to avoid getting busted. Knowing your legal rights is important, and often asserting your rights against unlawful search and seizure is the best move, though IMO in practice it is not always best to put your faith in the system (or the advice of attorneys), especially such a horribly broken system.
 
just remember everything you say can and will be used AGAINST you in court, but never FOR you.
even if you are 100% Innocent and have a story or whatever you could still be found guilty in court. NEVER TALK TO THE COPS. no exceptions..
my favorite is answering questions with questions and feeding them bullshit information that has NOTHING to do with what is going on...
 
I think it's funny listening to people talk about cops needing a warrant to search your car. If you're talking about the USA, then you're simply wrong... they don't need one. All they really need is to bring in a dog, tell it to hit on the car, and bam... they can search.

Here's a question...

Let's say you have weed stashed someplace very very well (inside the gas tank, inside a tire, etc). Would it be a good idea to play totally innocent and consent to a search? They might not look as hard if you act super innocent. I mean... how often do they actually rip the wheels or gas tank off of your car in a traffic stop? I realize you are taking a huge risk by consenting (makes it much harder to get the case thrown out) but it also reduces the suspicion of the LEO's involved.

I'm not saying this is the best course of action... I'm just throwing it out there for discussion... as I have wondered myself.
