Employer implementing drug testing program

I recently found out that my workplace hired a company to deal with all their work related accidents, physicals and drug testing for applicants.

the problem for me is that they want to implement drug testing for current employees.

I am in a union, and my job is in the private sector. Anyone with labor relations know if a new testing program has to be collectively bargained? or is it possible for them to implement the test without my knowledge, and i could be tested soon?

If your union is worth a shit, which most aren't, they shouldn't be able to impose anything on you that isn't already in your contract. But those drug testing fools tend to get their way or just let you go because "you weren't working out for the job you've been doing for years now". Fuggers...

i was under the impression that current employees can only be tested in non accident instances as long as everyone who is an employee is tested...

could be wrong...

thanks for the well wishes...and it sucks but my boss is a great guy who disagrees with testing...i give him joints from time to time

its human resources that wants to do this

in my union its just going to be my department that gets tested...noone else

we consist of 4 employees out of 300, the reason they want to start it is because i have access to a lot of valuable stuff and a fellow employee was stealing about a year and a half ago. They fired him, and we've had a clean track record ever since

i'm hoping to get at least 60 days notice....

They did the same thing where i work and the company had so many law suits against them for improper testing that they fired the HR dude. They will do there testing i assure you but keep track of who is tested and make sure its on the up and up which i doubt. Now we have no testing unless your injured which i think is all workers comp's BS. It seems like for the time being it might be a gamble. Just be prepared to sub if you have to. They were doing mouth swabs on us which made it impossible to sub but in the end it all worked out.

Check the contract or ask a union steward. They'll know the agreement by heart, especially that part of the contract. If they were smart they put protections in the contract.

Sec. 31-51x. Drug testing: Reasonable suspicion required.
Random tests. (a) No employer may require an employee to submit to a urinalysis drug test unless the employer has reasonable suspicion that the employee is under the influence of drugs or alcohol which adversely affects or could adversely affect such employee's job performance. The Labor Commissioner shall adopt regulations in accordance with chapter 54 to specify circumstances which shall be presumed to give rise to an employer having such a reasonable suspicion, provided nothing in such regulations shall preclude an employer from citing other circumstances as giving rise to such a reasonable suspicion.

Ive seen companies work around that clause by saying its for new health insurance. Either way it will almost always be an unsupervised test. Cheat away.

sounds like your company went priviate insurance for the company and not state, all priviate work place insurance companys offer deals. deals like you'll get 15% discount on your policy if you prove your company is drug free.happened to me in 1999 in a metal shop
funny thing is we didnt get drug tested untill the fn union was brought in. with the union we had to prove we where drug free, shit drug testing is so fn rampant where i live theres 1 major job site. this job site requires pre employment testing the union requires once a yr testing on your Bday. now you've proven your drug free for the company you work for you enter this major job site and your ok. ok untill you go to another part of this major job site then your required to pass a on the spot test before your allowed to enter the new section of the job site. same job site 20 diff companys operating this job site 20 differant testings if you roam the whole job site. this has opened up the meth and crack monster cookie jar yes thats correct ppl. workers on this major job site arent smoken cannibis if they get weekend off they smoke crack and meth friday night why because by monday thier clean. now i found this out from very close friend who stoped for while now says F them and is smoken again when he is tested and fails he'll say least i dont smoke meth or crack like every1 else. drug testing was nancy regans war against drugs shit 1988 she inacted the drug free work place act.


when i worked at the metal shop i stoped smoken or 1 month nothing not even on my bday did i smoke. took 1st test failed scored 150 nano grams in my system thats after 1 month of nothing. i was sent home told come back with clean test results in hand i fialed 5 tests before i used clean urine from some1 else i wanted to see if i could pass on my own. i couldnt so i done what it took nowdays i wont even take a drug test i'll tell them outright i smoke lol wont get hire so i dont even bother lookn for a real job i've dropped out

word on the synthitic urine here alot of employers have the lab check for it.

Have passed 2 urine tests in the last 8 months with Certo & Gatorade routine.
It also works for the saliva test as well.

Greyskull is right. Random drug testing involves random selection of all employees. There is usually a clause that prevents multiple tests within a certain period of time.
