So lets say you live in a Non Med state..

You do a VERY small and completely for yourself "No tell No Smell No Sell" setup..

1 plant at a time or 2 plants at the Max at a time.

(Is there any number of plants where things get a lot worse if you have that number or higher?)..

No guns, No scales, No large sums of cash, no nothing...

No record.. Not even a Driving ticket..

In general what would happen if you got busted for this situation???

I am assuming if you got a good lawyer, a slap on the wrist and probation??? With of course Lawyer fees, any fines, and court cost etc...

What state are you in if you don't mind me asking? Each state has there own laws..

If you do the setup exactly like you described bro, you won't get busted, and no...plant count does not matter, although having more plants obviously makes the operation larger and correspondingly harder to hide.

it would be a complete waste of time/money/resources to bust you for a plant in your closet

Not disagreeing with you but this sort of depends on the state? I understand if it's the DEA then the whole 99 plants or less thing comes into play. But if it's state, some go by plant count and some go to lbs. And I know in MA at least that 1 plant= 1 lb.
And the sentences are like Under 50lbs= *****
Over 50 lbs= *****
Like I said all depends on the state I guess assuming your thinking along the lines of state laws and not federal.

my advice is look up your state laws on norml and stick to whatever the number is that will be a misdemeanor, or amount to only a fine. also know that they gonna cop math you. my grow got busted and they tried to say i was producing 5-10 lbs. i almost laughed myself to death. i grow in less than 1gallon, usually never more than 1 quart containers, and lately mostly beer cups. there's no way i had 5-10lbs even if you weighed the goddamn dirt and the jars my stash was in.

anyway stick to the minimum and be prepared to die for what you believe in i guess.

Interesting thing about Texas is they have no cultivation laws that I have even been able to find.. Nothing.. Always wondered what that means?? They can charge you with whatever???

Sad to me that it would be less of a sentence to Purchase small amounts and risk getting mugged, shot, ripped off, given weed with poison in it, Not to mention you would probably be contributing to the Mexican cartel problem...

There is something SO completely F%$#'ed up about all of this..

Damn. Seems like anything over 4 ounces is a mandatory minimum of 180 days-2years.

Couldn't find anything pertaining to cultivation, but it stands to reason that if you're growing over 4 ounces you'll be looking at Mandatory Minimum.

They gave this guy 35 years!

I thought I read one time on one of the Texas Web sites that first time offenses of 1 lb or under the judge had to sentence you to probation and make you go to a rehabilitation program...

I REALLY dont think they throw first time offenders, with no record at all, in for 35 years..

I don't always 100% trust what NORMAL has on their web site..

For first time offenders of misdemeanor possession, exemptions are present in sentencing. For example, if convicted of possession in less than one pound, a judge is required to implement a sentence requesting drug treatment and probation. This requirement is only in a case where there are no prior felony convictions. In a case where a treatment facility is not located within the jurisdiction, this requirement may be waived.

PEARLAND, Texas – A man and a woman were behind bars Monday after investigators say they discovered a sophisticated pot-growing operation in a Pearland home.

The investigation began when members of the Pearland Police Department and Brazoria County Narcotics Task Force developed information about possible marijuana-growing activity at a home in the Avalon Terrace subdivision.

Working undercover, agents said they confirmed the existence of the grow house, and officers obtained a search warrant.

The warrant was executed at a home in the 2600 block of Avalon Cove Lane on January 25, 2012.

Investigators said the entire home had been converted to grow pot.

Officers said the system included a complete air-filtration system throughout the home to mask the smell of the pot, as well as industrial-grade lighting in multiple rooms.

Officers seized 244 marijuana plants and 32 pounds of hydroponic pot – a haul worth nearly $523,000 on the street.

Investigators also said the electric meter at the home had been bypassed, so the unusually high power consumption at the home wouldn’t draw the attention of utility companies.

Two suspects, Huu Quang Dinh and Thuy Trand Thi Nguyen, were arrested in connection with the investigation.

Both are facing felony charges of possession of marijuana and misdemeanor charges of diverting a power supply.
They were being held in the Brazoria County Jail Monday on $45,000 bond apiece.

The difference between 1, and 100 is vast.

1 will keep you in State court, and probably get you probation.
100 may keep you in State court, but makes it possible for you to get 5 flat from the fed's
2-99 can get you some State time possibly.

Really it all depends on if you want to fight off Ass rape in State Prison, or if you want to not fight off ass rape in Fed prison. Fed prison does not have the ass rape issues State prison does.

So you can get ass raped for maybe a year, or you can get non-ass raped for 5 years.

For some this may be a tough decision.:)

Definitely choose the ass wrap, man.

I think your post lacks fact. How can you say 1 plant sill be a slap on the wrist but 2. 5 or 10 will put you over the edge? The fed limit is 99 plants. More than numbers would go into the decision.

Not everyone who goes to prison gets raped.

I would say you are in the best cast scenario that is...one of our own. I too am in a similar style moment in my life. Check NORML.org for your state laws if you're truly concerned. Don't tell a soul, keep up good shop/odor control, your appearance, your bills, and you're a regular joe, Jack.
