DEA continues pot raids Obama opposes

Drug Enforcement Administration agents this week raided four medical marijuana shops in California, contrary to President Obama's campaign promises to stop the raids.

The White House said it expects those kinds of raids to end once Mr. Obama nominates someone to take charge of DEA, which is still run by Bush administration holdovers.

“The president believes that federal resources should not be used to circumvent state laws, and as he continues to appoint senior leadership to fill out the ranks of the federal government, he expects them to review their policies with that in mind," White House spokesman Nick Shapiro said.

Medical use of marijuana is legal under the law in California and a dozen other states, but the federal government under President Bush, bolstered by a 2005 Supreme Court ruling, argued that federal interests trumped state law.

Dogged by marijuana advocates throughout the campaign, Mr. Obama repeatedly said he was opposed to using the federal government to raid medical marijuana shops, particularly because it was an infringement on states' decisions.

“I'm not going to be using Justice Department resources to try to circumvent state laws on this issue," Mr. Obama told the Mail Tribune newspaper in Oregon in March, during the Democratic primary campaign.

He told the newspaper the "basic concept of using medical marijuana for the same purposes and with the same controls as other drugs prescribed by doctors, I think that's entirely appropriate."

Mr. Obama is still filling key law enforcement posts. For now, DEA is run by acting Administrator Michele Leonhart, a Bush appointee.

Special Agent Sarah Pullen of the DEA's Los Angeles office said agents raided four marijuana dispensaries about noon Tuesday. Two were in Venice and one each was in Marina Del Rey and Playa Del Ray -- all in the Los Angeles area.

A man who answered the phone at Marina Caregivers in Marina Del Rey said his shop was the target of a raid but declined to elaborate, saying the shop was just trying to get back to operating.

Agent Pullen said the four raids seized $10,000 in cash and 224 kilograms of marijuana and marijuana-laced food, such as cookies. No one was arrested, she said, but the raid is part of an ongoing investigation seeking to trace the marijuana back to its suppliers or source.

She said agents have conducted 30 or 40 similar raids in the past several years, many of which resulted in prosecutions.

"It's clear that the DEA is showing no respect for President Obama's campaign promises," said Dan Bernath, a spokesman for the Marijuana Policy Project in Washington, which advocates for medical marijuana and for decriminalizing the drug.

California allows patients whose doctors prescribe marijuana to use the drug. The state has set up a registry to allow patients to obtain cards allowing them to possess, grow, transport and use marijuana.

Kris Hermes of Americans for Safe Access, a medical marijuana advocacy group in California, called the raids an attempt to undermine state law and said they were apparently conducted without the knowledge of Los Angeles city or police officials.

He said the DEA has raided five medical marijuana dispensaries in the state since Mr. Obama was inaugurated and that the first took place on Jan. 22 in South Lake Tahoe.

"President Obama needs to keep a promise he made, not just in one campaign stop, but in multiple speeches that he would not be spending Justice Department funds on these kinds of raids," Mr. Hermes said. "We do want to give him a little bit of leeway, but at the same time we're expecting him to stop this egregious enforcement policy that is continuing into his presidency."

He said he is aware that Mr. Obama has not installed his own DEA chief but that new Attorney General "Eric Holder can still suspend these types of operations."

The Justice Department referred questions to the White House.

I hope Obama follows through. I hope he realizes this country is based on a democracy and the people have clearly spoken.


I guess things seem to simple to me. Why doesnt he just call this Michele Leonhart person and tell her to quit her shit?

Good to hear such a sensible thing come out of an American president. If he actually manages to appoint someone to the DEA who will respect state laws then I think this is a great step for law reform. Hopefully in a few years he'll actually grow some balls and at least have open discussion on the state of marijuana prohibition. Rather than the mostly dismissive answers he's given on the topic in the past.

Most, if not all states strip a convicted felon of the right to vote, at least for a period of time. I've always wondered about the logic. Do they think that felons will vote crooks into office? The non-felons already do a good enough job of that.

I need to look into because I think the state I am in now, I may actually be able to vote. Also you can can ask the state to reinstate that civil right.

Thats right, get popped, they will take your money but you have no say on what happens to it or who gets to spend it. It is kind of fucked up IMO

I didn't vote for Obama but at least he is leaning in the right direction on THIS ISSUE. Obama isn't who I am afraid of, it is his Attorney General and VP they are both way over the top Anti-Drug guys.

It is very clear the Us and Canada do not have democracy. Government Interests rule. Obama is just a puppet. He voted for an all out gun ban in Dc, and is 100 percent behind the new world order.

Yes I tend to agree..That is the single issue as to why I did not vote for him, But I think he is the right guy for the right job at this time

In most cases, you can petition the Judge of your case to re-instate your right to vote. Firearm possesion is a whole other ballgame.

I do support Obama and feel he will end DEA raids but will do it properly. Its still all leftover republicans pulling those strings and each and every one is itching for a fight and could cause lots of public controversy. Better to do it slowly and legally and avoid the conflict.

Fact remains too that the states are CALLING FOR AND ALLOWING THE RAIDS in direct violation of what their voters mandated. If the states would stand up and back their voters mandates, this would not even BE an issue. Yet is all dumped in Obama's lap to put an end to it.

If you live in a med state that allows and even calls for DEA raids, then its time to start considering a new batch of state leaders, because the ones you have are selling you out, they could have stopped it a long time ago, before it even got started.

Even if Obama does muzzle the DEA, state leaders will figure out another way around it, just like they have by using the DEA.

Totally agree with you on what you're saying. I'm waiting for Obama to make good on his word, as simple as it is, like you and others have been saying... This guy has a lot on his plate and a lot of people are acting like he's going to be able to solve the world's problems... If Obama ends the raids, he'll probably be one of the first presidents to come through after hearing the voices of the people. If he does, if he does come through on all the shit he's spit, I'll vote for him next election... I'm not down with staying in the middle east at all though, so it's kinda win/lose...

It's funny, I follow politics but I don't vote. As much as I know, the convicted felon thing is something that slipped from me a long time ago... Not something that gets talked about a whole lot but that's probably because it's bullshit... Everyone is equal whether you're a murderer or preacher, everyone should have a say in who's running this country. It's the natural balance of things but apparently they don't honor it...

Why is Obama pushing for a "FAST" resolve in a spending bill of over 900 Billion but we should go slow on the Big problems like the DEA.

The biggest difference between me and you isn't if I am a Dem or a Rep but I do not want the federal Government in any part of my life and do no look to them for anything.....In return, I want them to stay the FUCK out of my life!!!!!!!!!!

Right to Life, Liberty, and Property. Don't expect Obama to change anything. McNugget would have been just as bad. If you want change then you have to get involved in your local politics. The founders would have been on our side but they also would never support Social security, medicare, welfare, or the much talked about health care. Social security gains control over your investments and property. medicare takes control over your medical choice welfare perpetuates poverty and health care will take control over your body and what you do with it.

o ya and one more thing. The USA is not a democracy. It is a Republic. That is a VERY good thing. Democracy will lead to the plundering of rights. A Republic is government under Law. Unfortunately the Law is not being obeyed by the people elected to uphold it.
