Pot mags scrutinized in Colorado; may treat like porn

DENVER - Marijuana magazines are under scrutiny in Colorado, where lawmakers might require stores to put them behind the counter.
The unusual provision to treat pot magazines like pornography was considered Thursday in a Senate committee. If approved, the provision would make Colorado the first state to require stores that allow entry to shoppers under age 21 to place pot magazines behind the counter.
'It's analogous to the pornography example, ' said Rep. Bob Gardner, R-Colorado Springs and sponsor of the magazine amendment.
The magazine restriction faced long odds in the Legislature, though. Gardner's magazine limitation was added in a late-night amendment last week and was expected to be removed by Democratic sponsors. Gardner conceded Thursday that he wouldn't be surprised if his magazine idea fails to make the final marijuana regulation bill.
A lawyer for High Times magazine called the magazine restriction 'patently unconstitutional ' and said there's no legal precedent for treating pictures of a drug as obscene. Lawyer David Holland said the magazine would likely sue if the provision becomes law.
'It is a content-based restriction that violates freedom of speech, ' Holland said.
The magazine provision was among a long list of pot regulations awaiting a vote in a Senate committee Thursday. The bill also includes labeling and packaging requirements and a limit on marijuana purchases by out-of-state visitors. The bill limits retail sales to out-of-state customers to one-fourth of an ounce in a single transaction, though all adults would be allowed to possess a full ounce of the drug.
Colorado and Washington, the two states that voted last year to flout federal drug law and allow pot for recreational use by adults over 21, are still awaiting a federal response. In the meantime, the states are on their own regulating the drug. Colorado's Legislature is considering at least three separate bills to dictate how pot should be grown, packaged, sold and taxed.
Gardner insisted his magazine limit should be included in Colorado's final pot regulation. He said many marijuana magazines are simply advertisements for the drug.
'As we legalize marijuana, I think we can also control - in time place and manner - how it is advertised. I think that it's constitutionally defensible, ' Gardner said.

Daamn I hoped the silly bud porn on the walls in drying rooms and stuff would leave.

Those magazines are promoting consumption and culture. I do not believe they are simply pictures. If you were to make a calender of different scenes of Papaver somniferum with no other content, do you think anyone would care? I dont.

The more society resists a culture, the more it will be embraced. I don't care if they put an age limit on bud porn. Like real porn, kids will find a way on the net for free stuff. Usually it's also against the law, to let a minor view porn. I guess they wouldn't be allowed to show pictures of cannabis, in drug classes such as DARE or health class!

cuz making it illegal to view porn as a young teen TOTALLY stopped me...oh wait no it didnt...in fact smoking marijuana is a federal crime too and im doing that RIGHT NOW! when will they learn banning things never helps..

Internet access to bud porn is free and easily more available to most viewers than HT mag. or any other bud porn mag.

Mags are on their way out anyhow, same goes for news papers...

Silly lawmakers waist-in $$$ making laws/bills to protect us from ourselves.

Yet at the same time anyone can see ads for a slew of different beer brewers and how many cigerette makers in the windows of your local 7/11 store, seems a bit of a mixed message to me.

Beer/Cigs are OK?
Bud Porn is the devils work!

The notion that bud porn needs to be kept under the counter in the internet age is absurd, symptomatic of just how disconnected from reality anti-pot forces really are.

Have they no Google?

Bottom line, there is just no conceivable way this can pass First Amendment muster. This was a stupid idea from some sore losers. Gosh, since we all voted to regulate mj like alcohol, we should have pretty girls in scant attire posters for it, just like all the brewers and distillers, right?

So, I guess all those grow videos on youtube will have to come down since they don't allow porn?

Silly, silly politicians.

The lawsuit will continue, rightfully so. Prior to A64, such mags were openly displayed by various outlets. Even if the State AG says there will be no enforcement, that won't stop local prosecutors from engaging in harassment.

I suspect that more rational legislators were chuckling under their breath when they threw this bone to the bad loser authoritarians among them. Insisting on having it is a great way to make yourself look incredibly priggish, controlling & stupid. Not that so-called "Conservatives" (really authoritarians) will notice, given their low level of self awareness.

A more interesting question is how the authorities will deal with the thousands of backyard grows that A64 will inspire. There will be a struggle to define terms like "enclosed locked space" along with "openly & publicly" to authoritarian liking rather than within normal expectations of privacy.

Near as I can tell, the legislature failed to assign any penalties to outdoor growing that might be construed to violate those provisions of A64, vague as they are...
