California State Card - Yes or No?

Aloha:

Please be aware I sometimes get it wrong, that being said I believe that the only protection that a state/county issued card provides is one from arrest.

A state card prevents an officer from making an arrest on possession. A club card or a paper rec is not going to prevent you from arrest but will probably keep the DA from filing charges.

I will not get a state card because - it is not required - it does put you on the radar - I have been a medical user for 6+ years and have NEVER had the need for more authorization than my Doctor's rec.

Well that's how we roll here on the Island.

Registration requirements

(a) Physicians who issue written certification shall register the names, addresses, patient identification numbers, and other identifying information of the patients issued written certifications with the department of public safety.

(b) Qualifying patients shall register with the department of public safety. Such registration shall be effective until the expiration of the certificate issued by the physician. Every qualifying patient shall provide sufficient identifying information to establish personal identity of the qualifying patient and the primary caregiver. Qualifying patients shall report changes in information within five working days. Every qualifying patient shall have only one primary caregiver at any given time. The department shall then issue to the qualifying patient a registration certificate, and may charge a reasonable fee not to exceed $25.

(c) Primary caregivers shall register with the department of public safety. Every primary caregiver shall be responsible for the care of only one qualifying patient at any given time.

(d) Upon an inquiry by a law enforcement agency, the department of public safety shall verify whether the particular qualifying patient has registered with the department and may provide reasonable access to the registry information for official law enforcement purposes.

Hawaii Medical Marijuana Card

Under Hawaii medical marijuana law, qualifying patients must register with and obtain a registration certificate (sometimes referred to as a medical marijuana card, cannabis card, or pot card) from the Narcotics Enforcement Division (NED), a division of Hawaii's Department of Safety. The fee is currently $25. The registration certificate is valid for one year, and qualifying patients must report changes in information within five business days.

How to Obtain a Medical Marijuana Card in Hawaii

1.Have your physician request a written certification form from the Narcotics Enforcement Division of the Department of Public Safety by calling (808) 837-8470. Find a medical marijuana doctor in Hawaii here.
2.Send the completed certification form along with a copy of your photo ID and a check for the registration fee ($25 for the patient plus $25 for the caregiver, if any) to:
Narcotics Enforcement Division (NED)
3375 Koapaka St., Suite D-100
Honolulu, HI 96819

^that is not the same as California... Hawaii does not have SB 420....

Medical Marijuana Program

The Medical Marijuana Program (MMP) was established to provide a voluntary medical marijuana identification card issuance and registry program for qualified patients and their caregivers. The web-based registry system allows law enforcement and the public to verify the validity of qualified patient or caregiver's card as authorization to possess, grow, transport and/or use Medical Marijuana in California. To facilitate the verification of authorized cardholders, the verification database is available on the internet at www.calmmp.ca.gov.

In 2003, Senate Bill (SB) 420 (Chapter 875, Statutes of 2003) was passed as an extension and clarification of Proposition 215, the Compassionate Use Act of 1996. The Medical Marijuana Program, within CDPH, is administered through a patient's county of residence. Upon obtaining a recommendation from their physician for use of medicinal marijuana, patients and their primary caregivers may apply for and be issued, a Medical Marijuana Identification Card. Senate Bill 420 also required that the MMP be fully supported through the card application processing fees. Both the state and the counties have authority to cover their costs for the program through these application fees.

I prefer to believe your heart is pure and you meant no harm but, people are LITERALLY getting beaten, robbed and killed over this stuff. "Killed" as is in dead, muerte, food for worms, sleeps with the fishes dead.

We can't control Google but, IC will not allow posting life threatening info whether that info deals with members, visitors or strangers.

For those who find my tone here strident or overreactive... tough. This is not funny.

My attorney (recognized as one of the top 3 in California) recommends getting the state card, as well as signing up with NORML, SAFER and the ASA. SAFER he says will organize phone calling campaigns on your behalf if you ever get popped. Donate to them and get your state card!

He also said that scrips are good, collective paperwork is ok, but the more state paperwork you have the more trouble you're in IF the case goes federal. State paperwork is basically admitting guilt in writing to the Feds.
