I had the original written rec from my doctor, however the police did not bother calling the 24/7 verification line. the 2 large freezer bags were not marked. they were large freezer bags with about 1 oz in each. I thought i had nothing to hide so i allowed them to search my car. (now knowing i probably should have said no)... and i actually was not leaving the dispensary... it was Easter Sunday and i was on my way to have Easter dinner with family friends...HAPPY EASTER to me lol.....btw does anyone know if and when my case is dropped, can i take any action to get my $2000 bail reimbursed, like a counter sue or civil dispute? btw this is very fishy....the bail bonds man called my parents and told them i was in jail?? and they bailed me out reluctantly. My dad is 66 and has heart conditions...so i did not want him to get involved that why i was going to just stay in jail for a couple days.on top of that i owe them 2g's for bail. we do not know how the bail bonds man got they're phone number... the story he told me made no sense, on top of that it conflicted with the story he told my Father. All lies. they must be working with the police right?

just do not rollover for them they will drag their feet(courts) file motions to dismiss .yes file lawsuit against the city for the cost of your medicaine,time in jail,emotional physical distress.also whatever your qualifying condition cancer ,aids,sue them for a million as your health has been irevocably damaged by the police. whatever damages they have cost you is what I would file for.the office in question probably has a reputation for being a dick so subpeona his employee file.
whatever you do.do not plea bargain,prop 215 is explicit .do not enter into evidence your medical recomendation as prosecuter can seek to disqualify it.
just demand a jury trial,and don't plea bargain or accept a lesser charge.

add in violations of the unruh act,malicious prosecution,false imprisonment,kidnapping,and anything else pertinent.

please,..do not, under any circumstances, except any "DEAL", the worst thing you can do is give away your freedom,....as said before,get all the paperwork together and if you have to use a public pretender make them utilize everything you can get your hands on and be firm about everything!!!.....fight the good fight!!!.........G.:joint:

Thats wrong. It's evidence for an affirmative defense at the preliminary hearing. That alone should get him out of this. If anything you want to present as much evidence and the facts as possible. Even if it gets Ruled to be in admissible by the judge it's still on record in the event of an appeal. At the appellate level they rule based upon the law only and do not try to find facts. You have to introduce your facts at trial.

I am not sure but, at the preliminary plea hearing not guilty -guilty.yes. now I am not wanting to give people bad advice research weedtracker for a case in pasadena in legal issues if the judge is trying to squeeze money out of you with a plea bargain or acts in i.m.o. bad faith be wary as they will delay your request for jury trial make it a pain in the ass so you want to plea bargain give up your rights.
be aware that some judges are not advocates of prop 215 as it circumvents their ability to judge you.after your initial plea bargain I think it best not to enter any evidence until subsequent jury trial.as judge will usually dismiss case before this happens before or on day of jury selection.just don't let them intimidate you.Like i said a friend of mine went thru same thing in pasadena his case is weedtracker and he eventually had csae dismissed then
you file for a return of property report.

I had the same case but alittle worse I was arrested with a P of weed and a hp of hash and 5500$ cash. Fight the case they have nothing on you. I had my doc come in and say i needed all the weed for personal use cause I dont smoke I bake with it. anyway needless to say they have nothing on you and its pretty easy to find a good person in Los angeles espically 12 of em. If you take it to trail they will more then likely drop it.

im feeling pretty positive about this whole thing. thanks. i will be filing for a motion of return of property after the case is dismissed or closed...i will also be filing a tort claim against the city of los angeles and lapd to receive monetary compensation for emotional and physical damages to me and my father as well as time spent in jail, etc etc.

IF your in the position to sue the county or city or whatever...........you'll be doing everyone else after you a favor. The only thing they understand is money. If it continues to cost them...........they'll stop.

Go after the bailbonds man as well for intruding without written permission.

And my side note:
NEVER give LEO the ok to search you or your property without a search warrant. EVER !!
Even when there is nothing for them to find.

But I believe you now know this.

thats the spirit when you win fancy your self doling your foot out to alex in a clockword orange all the while thinking "lick it . lick it clean thats right nice and clean"in a cockney accent.nothing like sticking it to the man and their plan,by winning in court .this will be a black mark on cops record,and more people that do this more they will be disinclined to harrassing medical patients.
also your qualifying condition for medical mj can be used as damages,as being arrested tends to affect your health and wellbeing doh.if not you don't have to address the any questons regarding your medical record as they are private and you have the right not to self incriminate 5th,your call there.also you should all be aware that we the people can stand outside the court carrying signs about medical mj and jury nullification,also everyone can write a friend of the court brief bombarding any anal judge with losts of briefs to peruse,hmm joy.

Sorry if this is sort of intruding or rude, but I feel it must be said: you are being raped by the system, and this is bigger than you now. You cannot roll over and take it. You MUST sue the city brother. You can do this, and we've got your back. If the situation calls for a few bucks from friends, make a thread and I'll do my thing and I'm sure others will as well.


This has all the markings of a landmark case; I'm not being a drama queen, either. You can set a precedent here.


You're saying all the right things, and I'm glad you seem positive. Please, if you need help or you're getting the wrong vibes from your attorney, get a new one. We'll help.

Don't stop until you're compensated for your emotional/physical damages. We must let these fucks know that they are not totalitarian leaders in their districts-they are servants of the people. This is a textbook case wherein we can take a stand.

I'm confused about the purpose for the stop/search? Was your car running? Were you driving and pulled over? If so, was it for a traffic offense? Or were they waiting for you outside the dispensary? In other words, how'd it go down?

Could you possibly sue the officers in civil court for damages/fees who were cleary breaking the law? Kinda like a wrongful death type of suit?

not while federal laws abide. however you could complain to the DA - but i seriously doubt that will help =[

and yeah GET LAWYER not public pretender - lets just say that several cats faced this in glendale/pasadena which are worse than la proper, and ended up just having to go to court a couple times.

Remember really the point of having the note, is if you get stopped to not have a 'life changing' event - extended lockup, etc. a day or two in jail is a bitch, but a few years is much worse.

also a reminder to keep the ORIGINAL RIGHT NEXT TO POT IN TRUNK!

how is the judge responding is he/she arrogant dismissive ?one thing each and every person here can do is send a friend of the court brief from each person with points of law deemed relevant to your present case.
not to mention a contingent of medical marijuana patients holding up signs for patient rights.you should file a civil claim a.s.a.p. reasearch your damages if you have any health conditions that have been adversely affected by your arrest cite them.your father was there?and they arrested him also?if you were physically assaulted visit a doctor to susbstantiate.if you are affected mentally,or continue to be seek pyschiatric care or therapy to validate your
claim of mental anguish.
your damages have to be substantiated! how did this affect your physical mental wellbeing?did you seek medical treatment for your said affected condition/s?no..?you cant hope to win a civil claim if you cannot substantiate your qualifying conditions for a favorable civil judgement.filing a civil suit in conjuction with pleading not guilty sends the message out to everyone your in a fighting mood,and they may dismiss criminal case.rather than potentially giving damning testimony towards a civil suit.also you can get a copy of the criminal trial to see if officer in question contradicted himself from his original
police report which you could use in civl trial c/e.

I was pulled over in the first place because of problems with my registration. i really appreciate your support and have come to the conclusion that this fight is bigger than myself. Way Bigger!! I will keep everyone posted, with detailed info. my court date is early may.

To gain anything from this post would be to make sure if you are rididng with illegal/legal substances, make sure the transportation is free from issue, i.e. registration. How did the stop go from tags to crawling in your trunk?

I rarely ever read about a bust on these forums directly relating back to the herb itself. It is always, I was on a dark street at one a.m. or my tags were bunk, or I was speeding. Follow the arbitrary rules of the road to protect yourself if anything.

Dank, fight that shit but smarten up too man. Two unmarked bags of herb in a trunk would make any officer get a hard on. I've taken the bus when too ill to drive or get meds. A lot of issues with medical patients comes down to thinking that CA actually respects it's own laws, which many patients find out afterwards is not true. You could go through all of this with a lawyer and win, but it will only end up costing you and nothing from the city. The monster will win, if you get off. Worry about your health and forget the court date if that is where your priorities lie.

there is so much good stuff in this post i don't know where to start. if only i could say how many buddies that got busted jaywalking. used to take pub. transportation all the time, as long as it didn't smell :p
