GOVERNMENT’S MOTION FOR LEAVE TO DISMISS INDICTMENT
The United States, by and through Halsey B. Frank, United States Attorney for the
District of Maine, and Michael J. Conley, Assistant United States Attorney, respectfully moves
moves this Honorable Court for an order for leave to dismiss the indictment in the above
captioned case, pursuant to Rule 48(a) of the Federal Rules of Criminal Procedure. As grounds
for this motion, the government represents the following:
Defendant Gypsy Nirvana is a citizen of the United Kingdom (UK). On March 15,
2018, following an extradition request from the United States to the UK, the UK’s High Court of
Justice, Queen’s Bench Division (UK High Court), denied the government’s extradition request
on the grounds that the alleged conduct that formed the basis of the charges in the abovecaptioned indictment did not constitute a criminal offense in the UK.1 With respect to that
ruling, there is no prospect of further appeal.
Based on the UK High Court’s assessment that
extradition would run afoul of the “dual criminality rule,” and on additional factual information
that has come to the attention of the government since the indictment was returned, the United
States has determined that dismissal of the indictment in the above-captioned criminal case is in
the interest of justice.

Defense counsel has indicated that there is no objection to the government’s motion. Dated in Portland, Maine this 4th day of November 2019.
