NORML would like to thank the 2,500+ of you who took the time to write the Governor over the past week via NORML’s ‘Take Action Center’, and the many more who called the Governor’s office directly in support of this historic measure.

Senate Bill 1449 amends the California Health and Safety Code so that the adult possession of up to 28.5 grams of marijuana is classified as an infraction, punishable by no more than a $100 fine — no court appearance, no court costs, and no criminal record.

Passage of this bill will save the state millions of dollars in court costs by keeping minor marijuana offenders out of court. The number of misdemeanor pot arrests has surged in recent years, reaching 61,388 in 2008.

The new law, which takes effect on Jan 1, 2011, will have an effect even if Californians vote to legalize marijuana by passing Prop 19. Proposition 19 leaves misdemeanor possession penalties in place for public use and smoking in the presence of children; under SB 1449, these offenses would be simple infractions.

“Gov. Schwarzenegger deserves credit for sparing the state’s taxpayers the cost of prosecuting minor pot offenders,” said California NORML director Dale Gieringer, “Californians increasingly recognize that the war on marijuana is a waste of law enforcement resources.”

Pot posession is now decriminalized in California

Though he's against Prop 19, (as are both candidates in the Governors race) Arnold thought it would be a good idea to stop charging people with misdemeanor pot possession. Now possession of up to an ounce is a ticket for $100, no arrest and no charges, like a traffic ticket.

Things are moving in cali but the feds laws supersede any state laws so we need to change goverment laws and start making up ways to decriminalize cannabis laws across the entire united states then we will break free from always feeling like criminals and share the love & peace and puff puff pass the entire usa :bandit:

true, federal law is still the 'law'
but as law, it's beginning to crack, lots of laws on the books that don't mean shit anymore, laws live long after their usefulness has expired
federal MJ law is moving this way, stupid law that is unenforceable in any useful way
and the changes in California are highlighting that

California Governor Schwarzenegger Signs Marijuana Decriminalization Bill

Exciting news for Californians and the rest of the world!

California Gov. Arnold Schwarzenegger (R) Thursday signed into law a bill that decriminalizes the possession of up to one ounce of marijuana. The bill reduces simple possession from a misdemeanor to an infraction.


Currently, small-time pot possession is "semi-decriminalized" in California. There is no possible jail sentence and a maximum $100 fine. But because possession is a misdemeanor, people caught with pot are "arrested," even if that means only they are served a notice to appear, and they must appear before a court.

That has happened to more than a half million Californians in the last decade, and more than 60,000 last year alone. Every one of them required a court appearance, complete with judge and prosecutor. That costs the cash-strapped state money it desperately needs.

Under the bill signed today, SB 1449, by Sen. Mark Leno (D-San Francisco), pot possession will be treated like a traffic ticket. The fine will remain at $100, and there will be no arrest record.

In a signing statement, Schwarzenegger said he opposed decriminalization for personal use—and threw in a gratuitous jab at Proposition 19, the tax and regulate marijuana legalization initiative—but that the state couldn't afford the status quo.

"I am signing this measure because possession of less than an ounce of marijuana is an infraction in everything but name," said Schwarzenegger. "The only difference is that because it is a misdemeanor, a criminal defendant is entitled to a jury trial and a defense attorney. In this time of drastic budget cuts, prosecutors, defense attorneys, law enforcement, and the courts cannot afford to expend limited resources prosecuting a crime that carries the same punishment as a traffic ticket."

The law goes into effect January 1. Even if Prop 19 passes in November, it leaves in place misdemeanor charges for smoking in public or in the presence of minors. Those misdemeanors would become infractions under the new law. Sacramento, CA

Possessing up to an ounce of marijuana in California is now no more serious than getting a speeding ticket.

Gov. Arnold Schwarzenegger signed a law late Thursday that reduces possession of an ounce or less from a misdemeanor to an infraction, with a maximum punishment of a $100 fine.

Even as a misdemeanor, possession of up to an ounce of pot was still punishable only by a $100 fine and no jail time. But offenders also faced arrest, a possible court appearance and a criminal record.

Schwarzenegger said after signing Senate Bill 1449 that he does not support decriminalization of marijuana, but the law would save the state courts money.

"In this time of drastic budget cuts, prosecutors, defense attorneys, law enforcement and the courts cannot afford to expend limited resources prosecuting a crime that carries the same punishment as a traffic ticket," the governor said in a statement.

The bill authored by San Francisco Democratic Sen. Mark Leno was supported by the Judicial Council of California -- the official policymaking body of the court system -- and by the California District Attorneys Association.

California's major police associations all opposed the legislation.

Opponents said reducing possession to an infraction would discourage people cited for the offense from seeking state-funded drug treatment as provided for drug offenders under a ballot measure passed in 2000.

The governor signed the pot law as state voters prepare to weigh in on a closely watched ballot measure to legalize marijuana for recreational use -- a measure Schwarzenegger opposes.

Proposition 19 would more or less make the new law irrelevant by legalizing possession of up to an ounce for personal use for adults 21 and older.

Nevertheless, marijuana advocates praised the change enacted by the bill as they pointed to the spike in misdemeanor marijuana arrests in the state in recent years.

"Californians increasingly recognize that the war on marijuana is a waste of law enforcement resources," said Dale Gieringer, director of the California chapter of the National Organization for the Reform of Marijuana Laws and co-author of the state's landmark medical marijuana law.

Authorities made more than 61,000 arrests for marijuana-related misdemeanors in 2008, the latest year for which data exists, California Department of Justice records show.

In the prior decade, such arrests averaged about 48,000 until 2006, when the figure exceeded 50,000 for the first time.

That's one step.
California takes the lead, and the rest of the country follows.
Makes me feel that it's only a matter of time now.
We are chipping away at their wall.
Now they need to release all prisoners that are there for cannabis. That will save money, too.

This was signed into law because now in regard to Prop 19, they can say "why legalize it? There's MMJ and possession is only an infraction, not a crime. It's practically legal already. The laws are good as they are."

Thats what I think. They want to detour prop 19. Arnold doesn't like the legal grows because he is scared of endorsing it and going down federal intervention happens. He does not want that possible future intervention to fuck him . I dont know why he is scared though, he can totally win. he always wins havnt yall seen his movies. he even beat the fucking predator, and got to the chopper. maybe he pulled his groin or something lifting the 500 pound list of problems california has.

Seriously though, this is no reason to give up on prop 19. there should be no punishment for weed, and all people should be able to grow their own if they want.

This is a quick attempt for republicans to try and get a no vote on prop 19. we shouldnt have to pay 100 dollars everytime a cop decides he wants to mess with you. Just another ploy to make money. And they know prop 19 will pass with flying colors. So here is there big attempt to stop it by acting like they are for it. Why hasn't he done this before? why didnt he sign the bill to legaliz hemp production in California two years ago? its because the republicans NEVER want marijuana legal.

Do not let them derail us on making it 100 percent legal. Yes on prop 19. The spin people are putting on it is just to keep it illgl.

Congratulations, California. California has caught up with Massachusetts now, at least in regard to cannabis decriminalization. I have no doubt that Governor Schwarzenegger was influenced as much by enlightened self-interest, as a last minute attempt to influence the November 2nd vote on Prop 19. I'm not complaining -- far better to be inching toward full re-legalization, than to be recoiling away from the wishes of the voters, as is happening in Colorado.

It's always about money, power and control. Pretty simple, only reason tobacco and alcohol are fully legal is because they're fully under control.
