U.S. Seals Court Records Of Border Patrol’s Murder

The Obama Administration has abruptly sealed court records containing alarming details of how Mexican drug smugglers murdered a U.S. Border patrol agent with a gun connected to a failed federal experiment that allowed firearms to be smuggled into Mexico.

This means information will now be kept from the public as well as the media. Could this be a cover-up on the part of the “most transparent” administration in history? After all, the rifle used to kill the federal agent (Brian Terry) last December in Arizona’s Peck Canyon was part of the now infamous Operation Fast and Furious. Conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), the disastrous scheme allowed guns to be smuggled into Mexico so they could eventually be traced to drug cartels.

Instead, federal law enforcement officers lost track of more than 1,000 guns which have been used in numerous crimes. In Terry’s case, five illegal immigrants armed with at least two semi-automatic assault rifles were hunting for U.S. Border Patrol agents near a desert watering hole just north of the Arizona-Mexico border when a firefight erupted and Terry got hit.

We know this only because Washington D.C.’s conservative newspaper , the Washington Times, got ahold of the court documents before the government suddenly made them off limits. The now-sealed federal grand jury indictment tells the frightening story of how Terry was gunned down by Mexican drug smugglers patrolling the rugged desert with the intent to “intentionally and forcibly assault” Border Patrol agents.

You can see why the administration wants to keep this information from the public and the media, considering the smugglers were essentially armed by the U.S. government. Truth is, no one will know the reason for the confiscation of public court records in this case because the judge’s decision to seal it was also sealed, according to the news story. That means the public or media won’t have access to any new or old evidence, filings, rulings or arguments.

A number of high-ranking Border Patrol officials are questioning how the case is being handled. For instance, they wonder why the defendant (Manuel Osorio-Arellanes) hasn’t been tried even though it’s been almost a year since Terry’s murder. They also have concerns about the lack of transparency in the investigation, not to mention the recent sealing of the court case.

Osorio-Arellanes is charged with second-degree murder. The four other drug smugglers fled the scene and their names were blacked out in the indictment. In 2006 Osorio-Arellanes had been convicted in Phoenix of felony aggravated assault and in 2010 he was twice detained for being in the U.S. illegally.

During a Senate Judiciary Committee hearing this month to address the flawed gun-tracking program, Attorney General Eric Holder said it’s not fair to assume that mistakes in Operation Fast and Furious led to Terry’s death. Holder also expressed regret to the federal agent’s family, saying that he can only imagine their pain.

why would a cartel that pulls in multimillions $ not buy wholesale and to hell with the ATF&E rules for purchasing firearms?
our governement facilitated sales through 'fast and furious' to damage our right to possess or carry for protection or sport. simple betrayal.

BINGO! Give the man a cigar.
This was about blaming the flow of legally available firearms into Mexico on legal outlets in the US and ultimately denying law abiding gun owners their rights.
They never really intended to track these firearms to any extent. A few firearms vs. the hundreds they allowed to be sold would have allowed them to "track" their ultimate destination, if that is even possible.
Holder and Obama have the blood of a Border patrol agent on their hands along with that of many others who have been killed or injured with these firearms, some of which have either found their way back into or never left the USA.

That's how I felt when people were all for obama the last election. He turned out even worse than I thought he'd be.

Those aren't the only records to be mysteriously sealed. All of Obama's and his families records have been sealed.

Illinois state senator and communism-lover Alice Palmer, picked O as her chief of staff. As a U.S. senator, he had the most leftist voting record. His wife's only source of American pride came in her 40s as a result of O's own success. He was endorsed by the Communist Party in 2004, and in 2008 Obama got CPUSA's endorsement again, basically running on the CPUSA platform. (And yes, CPUSA have endorsed him again for 2012!)

And this was before the campaign and presidency. Does his bio reflect incompetence or something more sinister? Does his journey sound like one of an all-American or an anti-American?"

Now this idiot (Holder) says that DOJ didn't lie to congress because they lacked the mindset. They "thought" that the inaccurate information they provided was correct, so they weren't lying (apparently just incompetent). And, by the way, they need more gun laws to stem the flow of weapons into Mexico because of our "shared public safety obligations". He seems to forget that his men intentionally ignored the existing laws that they were sworn to enforce in order to perpetrate this fiasco.



WASHINGTON – Attorney General Eric Holder suggested Thursday that weapons lost during the course of the failed "Fast and Furious" gunrunning operation will continue to show up at crime scenes in the U.S. and Mexico "for years to come."

Holder, in testimony on Capitol Hill that comes as the congressional investigation into the program expands, decried the "gun-walking" tactic used in the operation as "inexcusable" and "wholly unacceptable." But a day after an influential senator called for the resignation of one of Holder's top deputies over the scandal, Holder denied department leaders played any role in the crafting of "Fast and Furious."

He continued to assert that top Justice officials were not told about the "inappropriate tactics" until they were made public.

Still, the top law enforcement official in the country conceded that, as a result of "Fast and Furious," guns lost by the Bureau of Alcohol, Tobacco, Firearms and Explosives remain in the hands of criminals.

"Although the department has taken steps to ensure that such tactics are never used again, it is an unfortunate reality that we will continue to feel the effects of this flawed operation for years to come," he said. "Guns lost during this operation will continue to show up at crime scenes on both sides of the border."

Congress has been investigating "Fast and Furious" for nearly a year. Scrutiny of the program intensified after guns from the program were found at the scene of Border Patrol agent Brian Terry's murder.

Republican lawmakers in recent weeks have complained about inconsistencies in the Justice Department's public accounting of the program over the past year. Sen. Charles Grassley, R-Iowa, the ranking Republican on the Senate Judiciary Committee, on Wednesday pointed to those alleged inconsistencies in calling for the resignation of Lanny Breuer, chief of the department's criminal division. Grassley accused Breuer of withholding information about gunwalking tactics used in a Bush administration-era program known as Wide Receiver, and of not being forthcoming about whether he saw a Justice letter to Congress in February that inaccurately claimed ATF was not letting illegal guns walk across the U.S.-Mexico border.

Though Breuer denies seeing the memo, Grassley pointed to emails that show he was sent a draft of the letter.

The Justice Department is standing by Breuer, and Holder testified Thursday that department heads were not aware of the program early on.

"The documents produced to date also belie the remarkable notion that this operation was conceived by department leaders, as some have claimed," Holder said. "It is my understanding that department leaders were not informed about the inappropriate tactics employed in this operation until those tactics were made public and, as is customary, turned to those with supervisory responsibility over the operation in an effort to learn the facts."

Holder said such a program "must never happen again," but effectively urged lawmakers to move on -- and tackle the broader issue of the flow of firearms into Mexico.

"We cannot afford to allow the tragic mistakes of 'Operation Fast and Furious' to become a political sideshow or a series of media opportunities," he said. "Instead, we must move forward and recommit ourselves to our shared public safety obligations."

He used the occasion to prod Congress to support efforts to give the Justice Department broader legal tools to track firearms purchases.

But Republican lawmakers continued to put pressure on Holder about how he's responding to the operation.

"This project was failed and flawed from the beginning," said Rep. Darrell Issa, R-Calif., questioning why Holder has not terminated the "many people involved" with the program.

"Mr. Attorney General, the blame must go to your desk," Issa said.

Holder later said that he's "ultimately responsible" for actions in the department, but stressed the actions he's taken to get to the bottom of the operation once he learned about it.

Despite the controversy over the inaccurate February letter from Justice, Holder also stated: "Nobody in the Justice Department has lied."
