Marijuana legalization victories could be short-lived

(Reuters) - Votes making Colorado and Washington the first U.S. states to legalize marijuana for recreational use could be short-lived victories for pot backers because the federal government will fight them, two former U.S. drug control officials said on Wednesday.

They said the federal government could sue to block parts of the measures or send threatening letters to marijuana shops, followed up by street-level clampdowns similar to those targeting medical marijuana dispensaries the government suspects are fronts for drug traffickers.

"This is a symbolic victory for (legalization) advocates, but it will be short-lived," Kevin Sabet, a former adviser to the Obama administration's drug czar, told reporters.

"They are facing an uphill battle with implementing this, in the face of ... presidential opposition and in the face of federal enforcement opposition," Sabet said.

Colorado and Washington state legalized the possession and sale of marijuana for adult recreational use on Tuesday through ballot measures in defiance of federal law, while a similar initiative was defeated at the polls in Oregon.

The initiatives appeared to reflect growing national support for liberalized marijuana laws, as indicated by a Gallup poll last year that found 50 percent of Americans favored making it legal, versus 46 percent opposed.

The U.S. Department of Justice, which considers marijuana an illegal drug liable to being abused, said enforcement of the federal Controlled Substances Act "remains unchanged."

"We are reviewing the ballot initiatives and have no additional comment at this time," a government statement said.

Sabet said he expected the Obama administration would at some point file a federal lawsuit to challenge and seek to block aspects of state-level legalization measures and that this "is going to be caught up in the courts for quite a while."

HARD TO ROLL BACK CLOCK

But federal action was not expected to snuff out state-sanctioned marijuana in those states - especially the ability of individuals to possess an ounce or less of the drug without risk of arrest by local police.

Sabet, who opposes legalization, acknowledged that states were free to eliminate their own penalties for possession. But he said U.S. Attorneys could send letters to Colorado and Washington governors warning them not to implement provisions to regulate and tax marijuana at special stores.

Or the federal government could wait until such a system is created and sue to block it, he said.

Colorado Governor John Hickenlooper, a Democrat, had said he personally opposed his state's legalization measure. But he has since said he plans to respect the will of voters.

In Washington state, Democratic gubernatorial candidate Jay Inslee, who was leading in the vote count in a tight race, has spoken out against his state's initiative but is committed to implementing it, campaign spokeswoman Jaime Smith said.

If the Obama administration reacts too harshly, it could suffer politically with younger, more left-leaning voters who chose legalization and typically lean Democratic.

But President Barack Obama also faces pressure from anti-drug groups to protect young people from harm they say would result if states set up a regulated and taxed marijuana trade.

Robert DuPont, who served as drug czar for former Presidents Richard Nixon and Gerald Ford and opposes legalization, said he welcomed a confrontation.

"I think it's time to resolve it," he said.

Ian Millhiser, senior constitutional policy analyst with the left-leaning Center for American Progress, said the federal government, even if it sues to challenge the Colorado and Washington initiatives, cannot force police in those states to arrest people for marijuana infractions.

"If I were Barack Obama, I would look at this and say I would rather have young voters with me," Millhiser said.

The whole article is speculation so far... but there were a few official statements in here, and some were positive.

No way after 2 states passed it... we will see. 2 for 2

At the very least this forces the issue for real address... Not that the courts aren't just as politicized as any. CO forces an Oct '13 deadline for the state to enact, and it's a full out system of applying and licensing for grows and for retail outlets. Gonna have a lot of the medical dips trying to change over to the new system... Lots of money and lots of lawyers... Plus an amendment forcing it with deadlines. Time to rock and roll.

we passed medical in ca in 96. and the feds still knock doors down. "its for profit" they say and the whiny bitches believe them. stupid.
in hawaii the state govt wrote the medical bill, but the feds still fly green harvest and fly over every card holders land looking for plants...

its a contradiction.

When the prohibition of alcohol was repealed, it was because the states took it upon themselves to repeal prohibition. When 18 states made alcohol legal, the Federal Government rolled over and voted to repeal.
So history tells us this is the best way to go for legalization, state by state, writing their own laws to legalize. When enough states do it the government will cave, but it isn't going to happen because only two states legalized Cannabis. As for each states laws, well some states will wright liberal laws that are easy to work with and some state will write laws that are crap. It will be just like liquor sales, some states let booze sell in just about any store like California and some states only sell in state run stores, it'll be the same with weed but its gonna take some time. Shoot the people in Oregon voted no, and that was mainly an ego thing, rather than a vote to get weed legal. A lot of people in oregon didn't like the guy that wrote the law, it wouldn't have made any difference how the law was, it was the writer they didn't like.

So we now have 18 states that have Medical Cannabis 2 of which have voted in full legalization for all users... Keep in mind the DEA and there cohorts are after the money. Cannabis is a very large chunk of the DEA budget. If they dont have to use the dollars on Cannabis I think some would lose there jobs? maybe not I would redeploy them to control our borders.

We already seen what they do with Automatic weapons they lost in Mexico that killed a border patrol officer. IMO these people need to be fired and prosecuted just like we would be..Instead they get to hid behind there badges saying oops we lost one WTF. The DEA has to go or at least get investigated. That whole organization is out of control they have way to much power.

If we keep up the pressure start releasing real facts about cannabis with real science to back it up, We have the right people to to this.. The more we expose the DEA for there lies and abuse of power the better. The DEA needs to Keep there fuking nose out of my asshole.

We are not violent people. In fact we are much less violent then Alcohol users. we are still treated just as bad as Murderer's,rapist,pedophiles some of the lowest scum we have. Kill our dogs and traumatize out children it had to stop. I think we are on the right track. If we keep hitting there wall with out sledgehammer's I think we can break it.

After saying all that I also dont have faith in the system either. Its not in our favor for sure..

I just read on CNN the drug czar under the Nixon and Ford administrations was named DuPont. (Edit: Oops, that's THIS article, sorry about that). Anybody who doesn't see collusion and cahoots is blind, deaf, and dumb. DuPont said he welcomes the confrontation. Sad, isn't it, that striving for truth and honesty has to be a confrontation? It IS sad IMO, but true.

I also read yesterday on CNN that there has been 6000 studies of MJ in the last 5 years. What they failed to point out was that since the US fed gov't has dictated MJ is a Sched. I drug most US labs cannot get any, so most of those studies are foreign, supported by those gov'ts, therefore biased. DUH!

This ignorance and stupidity the US gov't controlled media has had as control, and assuming people are stupid is coming to a sad conclusion, ... or rather at least change. Albeit slowly. The fight for truth is far from over. But the DEA WILL lose their stupid, wasteful, stranglehold they have enjoyed for years. People are learning the truth and finally starting to get fed up with the bullshit they are being fed, largely due to the internet I think. The war is swinging in our favor but this was just one battle, it's FAR from over.

Robert DuPont is one of those mega dickheads we have to deal with. I can't believe he even has the nerve to speak on this, how obvious can you get.
He is a major vertebrae in the backbone of prohibition that needs to be crushed.
We can do it through state rights. Legalize state by state and tell the DOJ, DEA, and all the other alphabets to FOD.
State sovereignty is our strongest and final line of defense against all the problems we are facing.
Whether its MMJ, full legalization of MJ, or defending our eroding Bill of rights, states need to stand firm on their own two feet and take the power back with TRUE representation of the population. Need reps put in office by the people not big business and cronyism. Purge the corporate interest by continuing to write our reps on these issues and tell them to turn away the buy offs because we're watching, and it's obvious when they take a cut.

If they don't get their act together, by 1/1/2013, the DEA gets a 30% budget cut.

no relation. hes a dr from ohio. used to be drug czar. interesting thing? he came out for decriminalizing weed back in the late 70s. was gonna do it under nixon but tricky dick told him if he did he'd get shitcanned.

this just reminds me of the fact that you hear morons who voted saying how they love our democracy and we have the best democracy, yadda yadda yadda... and not once does anyone stop to remind these fucking morons this IS NOT A DEMOCRACY. this is a REPUBLIC. more and more a banana republic but still a republic. big fucking difference kids.
