California pot companies warn of impending industry collapse

LOS ANGELES (AP) — Leading California cannabis companies warned Gov. Gavin Newsom on Friday that the state’s legal industry was on the verge of collapse and needed immediate tax cuts and a rapid expansion of retail outlets to steady the shaky marketplace.

The letter signed by more than two dozen executives, industry officials and legalization advocates followed years of complaints that the heavily taxed and regulated industry was unable to compete with the widespread illegal economy, where consumer prices are far lower and sales are double or triple the legal business.
Four years after broad legal sales began, “our industry is collapsing,” said the letter, which also was sent to legislative leaders in Sacramento.
The industry leaders asked for an immediate lifting of the cultivation tax placed on growers, a three-year holiday from the excise tax and an expansion of retail shops throughout much of the state. It’s estimated that about two-thirds of California cities remain without dispensaries, since it's up to local governments to authorize sales and production.

The current system “is rigged for all to fail,” they wrote.

“The opportunity to create a robust legal market has been squandered as a result of excessive taxation,” the letter said. “Seventy-five percent of cannabis in California is consumed in the illicit market and is untested and unsafe.”
“We need you to understand that we have been pushed to a breaking point,” they told the governor.

Newsom spokeswoman Erin Mellon said in a statement that the governor supports cannabis tax reform and recognizes the system needs change, while expanding enforcement against illegal sales and production.

“It’s clear that the current tax construct is presenting unintended but serious challenges. Any tax-reform effort in this space will require action from two-thirds of the Legislature and the Governor is open to working with them on a solution,” Mellon said.

Companies, executives and groups signing the letter included the California Cannabis Industry Association, the California arm of the National Organization for the Reform of Marijuana Laws, the Los Angeles-based United Cannabis Business Association, Flow Kana Inc., Harborside Inc., and CannaCraft.
In a conference call with reporters, Darren Story of Strong Agronomy said tough market conditions forced him to cut loose more than half his staff. He said taxes that will increase next year make it an easy choice for shoppers. With prices in the underground half of what they see on legal shelves, he said “most consumers are going to take off.”

The companies asked Newsom to include their proposals in his upcoming budget proposal, which will be released early next year.

"The solution to these issues and the possibility of saving this industry lies in your hands," they wrote.

I imagine it would also be extremely helpful if the feds were to deschedule so that dispensaries and growers could deduct normal business expenses.

As for those huge companies who are profiting off the backs of the people who actually
kept the genetics alive thru prohibition who can't afford to go into business themselves.

This is so just like Canada. Too much regulation and taxation. Everybody uses stolen genetics. And the black market still accounts for just over 50%. It's what legal pot looks like.

They jacked up the prices when everybody was told to lock down and collect the stim. $1600 / lb off the hill. That buys a nice tent setup, or two. And the tents just keep on giving, and giving.

I read that Colorado receives 5 times more money in cannabis taxes than from alcohol taxes and we all know how much Coloradans LOVE their beer! And whiskey! And Gin! And wine! (they have some pretty decent vineyards too).:jump:

yeah Colorado breaks records every year for the cannabis tax they bring in, but Colorado is tiny compared to California, I actually got those stats from an article I was reading about how fucked norcal is with illegal cartel grows, but if 100% of the state went legal they would be getting a lot more tax $$$ obviously

and I think jurisdictions can ban home growing, I had a buddy there when it first broke that California went legal and I was like shit have you popped anything yet and he was like no it's not legal where I'm at yet, but at the same time even a large grow is a misdemeanor they pretty much have to prove destruction/contamination of nature or someone got murdered in relation to the grow to get a felony

they say that if feds legalize it will cripple the black market, but I'm not so sure about that, that just means the feds aren't going to put any money into going after black market, they say because it's illegal it drives the prices up but at the same time to be able to sell anything you have to offer lower than dispensary prices

Illegal Again to Grow Cannabis in Quebec

Over the last 4 years, growing cannabis in Quebec from one’s home has gone from being illegal, to being legal, to finally become illegal again recently. The story may not even be over.

First step: Legalization

Canada first legalized cannabis in 2018. With the legalization of cannabis, the federal government set some minimum national standards. For example, Canadians would be allowed to grow a maximum of 4 cannabis plants per person.
However, each province would be free to make their own rules surrounding cannabis. For its part, Quebec decided that it would make it illegal to posses a cannabis plant and grow any cannabis for personal purposes. However, that doesn’t mean that it’s criminal. Breaking the law by growing cannabis could land you a fine, like a speeding ticket.

2[SUP]nd[/SUP] step: Challenge

A citizen decided to contest the ban against possessing a cannabis plant and growing cannabis for personal purposes. He argued that the province did not have the power to ban Quebecers from possessing a cannabis plant and growing cannabis for personal purposes because the federal government allowed growing up to 4 plants.
In June of 2019, the Quebec Superior Court agreed, and declared that Quebecers could possess and grow cannabis plants for personal use. This meant that it became legal in Quebec.

3[SUP]rd[/SUP] step: The Court of Appeal renders its decision

However, the story doesn’t end there. The Quebec government appealed that decision to the Quebec Court of Appeal.
The Court of Appeal recently declared that the lower court decision was incorrect. The court declared that the province had the power to ban Quebecers from possessing and growing any cannabis plants.
So, growing cannabis for personal purposes has gone back to being illegal in Quebec.

4[SUP]th[/SUP] step: Is the saga over?

The Quebec Court of Appeal decision may not be the final word on the matter. The citizen may try to appeal the decision to the Supreme Court. In that case, the Supreme Court will decide whether growing cannabis for personal purposes is legal in Quebec.

Addendum: In Nova Scotia we can't grow outdoors.

7 Things You Should Know About Cannabis in Quebec

Recreational cannabis was legalized in Canada in 2018. However, “legalized” doesn’t mean that anything goes. Here are some basic rules that you should know!

1. Cannabis is only legal if you buy it from the SQDC

The only legal way to buy cannabis in Quebec is through the Société Québécoise du Cannabis (SQDC). This means that it is illegal to buy your cannabis from a friend or from a website other than the SQDC’s. If you’re caught, you could be charged with a crime.
The rules for medical cannabis are different. You can visit Health Canada’s website to find out more.
There are several forms of cannabis available for sale in Quebec: dried flower, extracts, and edibles. There are restrictions on how they can be produced and marketed. For instance, all products must come in plain packages.
In addition, edibles cannot be made using anything that would make them attractive to people under 21. This means they cannot contain anything sweet or any added colouring.

2. Don’t share cannabis with anyone under 21

Be careful when sharing cannabis with others. It is illegal to buy cannabis for someone under 21 in Quebec or share it with them.

3. You can’t consume cannabis in public

You cannot consume (vape, smoke, etc.) cannabis in a public place in Quebec. The list of public places includes all:
  • outside public places, including parks, playgrounds, sports fields, day camps and summer camps.
  • public roads (sidewalks, alleyways, streets, highways, footpaths, etc.)
  • bus shelters
  • terraces or other outdoor commercial spaces
You also can’t smoke on a bike or in a car, even if it’s parked, and even if you’re not the one driving.

4. You can consume cannabis at home, but your landlord can say no

If you’re a tenant, your landlord can forbid you from consuming cannabis in your home when you sign your lease. Your landlord can also modify your lease. For a 12-month lease, the landlord must send you a notice three to six months before your lease renews. If you wish to contest the landlord’s modification, please visit the Tribunal administratif du logement (TAL, formerly Régie du logement or rental board) website.

If you live in a condo, your condo board can also forbid you from consuming cannabis in the common areas. Condo boards can also forbid cannabis consumption in private area, if that consumption bothers other residents.
If you are a medical cannabis user, special rules apply. Please visit Health Canada’s website for more information.
If you own your home, you can consume in your house or outside on your property. However, there are restrictions. For instance, if you have a daycare in your home, you cannot consume cannabis during the hours where childcare is provided.

5. Where you are limits how much you can possess

In public

In public, the possession limit is 30 grams of dried cannabis. The limit for other forms of cannabis is the equivalent of 30 grams of dried cannabis.

Please note that there are some places where you cannot possess cannabis in public. Here are examples:
  • schools
  • universities
  • daycares
At home
  • You can possess up to 150 grams of dried cannabis or its equivalent at home (see table above). It doesn’t matter if it’s an apartment, condo, or your house – the limit of 150-gram applies to the entire household. This means that if you live with others, you must share the 150-gram limit.
6. You can’t grow cannabis at home in Quebec

In some provinces, you can grow up to four cannabis plants at home. Quebec has decided to ban citizens from growing their own cannabis plants. This means that if you get caught with a plant, you could be fined.

7. You can’t consume cannabis and drive

Driving while impaired is a crime. This means that if you have more than a certain amount of THC (the psychoactive component in cannabis) in your blood while driving, you can be charged with a crime. The seriousness of the crime depends on how much THC is in your blood. For more information please see our article on impaired driving.
In Quebec, a “zero-tolerance” system will be put in place. This means that you will not be allowed to drive with any cannabis present in your blood. If you are caught, you will not be charged with a crime, but you could receive a fine and lose demerit points.Your driver’s license will also be automatically suspended for 90 days. This zero-tolerance system is not in effect at the moment, but will be implemented at some point in the future.

In comparison...

You must be 19
19 is the legal age to use, buy, grow or possess cannabis in Nova Scotia. If you’re under 19, you can be fined or face criminal charges.

Be aware of the penalties if you’re under age
  • If you’re under 19, cannabis will be seized and you may be fined up to $150. Parents or guardians may be notified. Restorative justice programs may apply.
  • If you’re under 18 and in possession of more than five grams, it is a criminal offence. You will be prosecuted in the same way as youth drug possession.
  • If you’re over 18 and in possession of more than 30 grams, it is a criminal offence under the federal Cannabis Act.
  • If you sell or give cannabis to someone under 19 or involve them in a cannabis-related crime you may be fined up to $10,000.
  • Know where you can use it and where you can’tThe Smoke-free Places Act applies to the use of combustible cannabis in public places. You can be fined up to $2,000 for a violation. Municipalities may pass additional bylaws that further restrict the use of cannabis in public places. Some have, so be aware of local bylaws.
  • You can use cannabis in the privacy of your own home. If you rent, your landlord may make rules about cannabis smoking or growing that form part of your lease. For more information, visit Service Nova Scotia.
  • Cannabis in any form cannot be used in vehicles by passengers or drivers. You may be fined up to $2,000 for consumption in a vehicle.
There’s a limit to how much you can possess

If you’re 19 or over, you can have up to 30 grams of dried cannabis (or equivalent) with you in public. There are no restrictions on how much you can keep in your home, as long as it’s for personal use. Store cannabis safely and keep it away from children and pets.

There’s a limit to how much you can grow

Legal age adults can grow up to four cannabis plants per household. Each apartment in a house or building is considered a separate household. Take extra care to grow safely if you have children or pets at home.

Municipalities may pass additional bylaws that further restrict cultivation. Some have, so be aware of local bylaws.
Here they say local bylaws. It is province wide under the "Clean Air Act". I haven't seen nor heard of any violations, or "reported" violations. Who wants to advertise!

You can only buy cannabis legally from NSLC

The Nova Scotia Liquor Corporation is the only authorized retailer of recreational cannabis in Nova Scotia. Cannabis can be purchased by adults 19 or over at designated NSLC stores or online. For more information, visit the Nova Scotia Liquor Corporation.

ETA! Until legal entities quit selling "tumbled weed", they will never compete/be able to compete with the BM! I don't know what Que's weed looks like, but here, it has been "tumbled". Folks that don't know any better think its good stuff. It doesn't even take a trained eye to figure that BS out!

Therefore, unless you can "legally" grow your own (reasonably), it is nothing more than a tax grab!

Quebec, since as long as I remember... were always on their own. I'm originally from Mtl.

Quebec is the only province in Canada that doesn't recognize any qualification, that isn't theirs. IOW, you may be licensed to do x, y, z across Canada BUT! Your qualifications don't count unless they were issued in/from Quebec. It is the only province in Canada that does so! This has been the case regardless of which party is in power!

Anyway back to California, people charge too much for weed in general .....guess what you will pay less taxes if you dont charge so much and sales improve if you dont grow and sell such weak crap and that goes for the black market too. Lots of tons of auto weed are being grown in spring and summer it's not all top shelf. Photo period frosty weed doesn't mean its potent
don't be fooled by pretty looking weed instead judge it by its effects

I'm pretty shocked that Harborside has only opened 2 retail stores since legalization passed, prices like this you would expect them to branch out more...
