does that mean it has to have a lock on it?..if a person reached over or through a fence,gate,etc,and took off the latch and came through,would that be illegal?..i'm talkin about yer home with a fence around all 4 sides and a gate in front driveway.(like a farm gate,big enough for a vehicle to get through)

In my country if you enter someone else's property...whether it's locked or not...it's trespass possibly with intent....you need permission.

I think you are allowed to walk up the driveway or path to the front door; but you are not allowed to just go in and wander around the place.
Otherwise there would be a lot of Mormons and Jehovas Witnesses in jail.
I think it's only trespass if you are asked to leave and you don't.
Don't know what the situation is if the gate is locked and you jump the fence.

There would need to be a no trespassing or no entry sign at the entrance to the property (or surrounding the perimeter of the property). If the sign is not present, it is safe to assume you can enter the property in order to get to the residence. As stated by a previous poster, you couldn't enter the property and wander around, you can only go to the front door of the house.
If the gate is locked and you jump the fence, that would constitute trespassing with intent.

I'm assuming you're talking about a state law that requires you to keep your grow in an enclosed, locked facility. I'd say that would mean something that requires a key or combination to open.

if yr in Oz (cobber) and the locked gate is across a GAZETTED road, even tho that road is not used or graded, you are allowed to cut the lock to gain access.

get out yr cadastral map of the area just to make sure the road is marked on it.

of course you should not stray off the road.

In the states maybe laws differ from state to state. Not sure. Here, even tho I have a gate that separates my entrance from the public sidewalk people can still enter through my gate legally. NOW, if I put a No Trespassing sign on the gate they have been warned and can face trespassing charges. I have several gates on the side of the house so each one would have to have a no trespassing sigh in full view to give me legal standing to keep people out.

I always just thought you should put one on there by default it's much easier to keep people out that way.

I've seen some of the meter guys here in cali use a "spyglass" to read the meters...

u get a lock and big dog trust me... the meter guys will have you self reporting for them in no time... i had a ridiculously small fence at an old place and threw a lock on it; its the intent of having a locked property not how effective the lock is
