traveling with a safe...warrant??

G

GMax

lets say that i had a combonation safe...here are two scenarios does anyone know the answer ?? it would be in a van so no trunk and cross state

Scenario 1: traveling with all paraphenalia in safe. not single seed stem etc anywhere else. get stopped by cop...searches car finds nothing but combo safe no key..can he get into it ??? does he need a warrant?? can he get one without any outside indications that there anything illegal inside??? will they confiscate it and break into it in lab ?? or will they call in a "safecracking" officer to crack it on spot in case there nothing in it so i can go about my way ???

Scenario 2: again traveling with all paraphenalia in safe.not single seed stem anywhere else, but my car is full of grow supplies basically in plain sight ( no real way to hide van full supplies) same questions as scenario 1 apply, just wanna know if the growing supplies will make a difference (by themselves they are legal right?) i mean i am sure that if he saw that he would definately be more curious then scenario 1 but can he ??

again this is a combonation that i WILL not give them no matter what. if they gonna open it they doin it the hard way

interesting thought on the safe, i don't know the answer
from my limited recall of the law, i think that normally you must consent to a search of your vehicle if there is no 'reason' for LE to search
of course, in reality they can usually pull out a reason why you(or your vehicle) look sketchy
so does a safe add some 'safety'? maybe not, but i'd love to hear more on this from the more legally astute

I got felony stopped with a safe in my trunk once, they searched the whole fucking car and never even asked about the safe. They took the herb in my pocket and gave me a possession ticket and let me go..

Just me, though.. I have no idea what the laws actually are on it..

that is damn interesting, most cops do follow routine procedures, maybe they were fuck ups
but usually they search everything, they love to search after a bust, you're at their mercy and it become like a treasure hunt(for them)

This is an interesting scenario. I have no experience with it, just general knowledge about information security, etc. The first thing that came to mind was this article I read not too long ago:

http://www.wired.com/threatlevel/2010/07/lock-cracks/

Which is just a reminder of rule #1: If LEO wanted it enough, they'll get it. If they thought you were going to be a big fish, they'd find a way to bring you in and keep you around long enough to get it open or find someone who could. So, the trick is to do as much as possible to not make them want it and/or make it a significant hassle.

I don't recommend a combination lock. It may seem better because you don't have to figure out where to hide a key and worry that they'll find it, but with a combination someone knows that you must have it in your head, and if they grill you long enough or delay your trip long enough you'll eventually give it up. Basically, its an invitation to interrogation.

With a key lock or key/code combo lock, you could send the key ahead of you via mail, or leave it behind and request that a close friend mail it to you days after your trip when you know you're in the clear. If sending before, send it days before and someone you trust pick it up and keep it safe. This way, they could search your whole car, not find the key, and be significantly deterred to just give up the idea of getting it open.

Then of course, grow supplies in open view is your choice, but it obviously would increase the chances of you seeming like a big fish and thus they'd have more reason to spend the extra time / bring you in to get that safe open.

Its still generally true that you can't be forced to incriminate yourself, e.g., give up a combination or location of key, but they can sure as hell interrogate your balls off. And honestly, my best advice is to not carry things illegal enough to need a safe across states. Just my thoughts, I wish you luck.

It would be far better to have it boxed & sealed with a paid postage label attached to it to your own address, this requires a probable cause warrant from a federal judge or postmaster to open against your will. They should never be searching your car in the first place unless you gave them permission to do so since you have nothing illegal whatsoever in the passenger compartment. Your license it valid and all your tags, insurance, & other shit is all together before you embark on your journey. May we search your vehicle? The answer is NO. You do not speed, you obey all traffic laws, and pay all highway tolls. :canabis:

How true.

Sealed mail provides an extra layer of protection from searches. The only downside is that if they do get the warrant.... You can be worse off.

I NEVER break traffic laws/have any interactions with the police on the road anyway. But I am extra careful if I am carrying anything illegal.

Someone wiser than myself once told me to "only break one law at a time."

If I have something illegal I'm already "maxing out" on the number of laws I can break at one time. This has saved my ass before, and may again in the future.

Just my $0.02,

Mr. M
