Im leting all my friends know and all the people who know me from my help, to let them know that if im not back here by tomorrow evening I will be in prison......
This may be kinda long, but please read it, its very important to me
If i dont come back tomorrow evening, you know where I went....
Tomorrow is our day in court, I'm praying that the judge supresses the warrant that was issues wrongfully by hear say information, not to mention........ the cop had to blackmail the informant thaty if the information wasnt right he would be charged with perjury. My lawyer is very good, but there was a few things he didnt know i had to show him.
The warrant was wrongfully time, meaning that he based it within a 72 hour peorid. I hope my judge finds it in his heart to do the right thing and squash this warrant
there is one thing I do not beleive my attorney. He states this warrant may be able to be squashed because he found loads of things wrong with it, but the thing i dont undersyand is, if we cant squash it why cant we fight for the 4th amendment right againg illegal search and seizere. The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.'
there was no probable cause. what cause? just because someone said such and such said they was growing pot? THey had no corabarating evidence to support his story, I could make an annoymus phone call saying my neighbor is running a meth lab. its cause for investigation but not a warrant. I could lie, and if they did get the warrant i could say well i smelled it and seen it. Its not enough evidence peorid because without that warrant thereis zero evidence, they did no knock in talk, no trash pulls heat guns nothing!
all by word of mouth they got a warrant by.
in my honest opinion what they did is against 4th amendment rights. I could be wrong... anyone want to chime in? I dont see how its NOT against my 4th amendment right against illegal search..... they didnt have justifiable evidence.....
The snitch didnt say he seen it he said he heard of us growing it,
i wish i could tell the snitchs name iw ould do it in a heart beat, but there is no way im going to break rules here, pg is strict about that policy and idont blame them.
THe snitch got off on probation 3 years probation....
If we cant get the warrant swuasged we are trying to get the plant numbers down I had to show my attorney there was proof that federal law states that marijuana is not a plant without visable roots
and they charged me with 26 plants, when i only had 8 plants with roots, everyone who seen my grow diaraies knows i didnt and never had that many plants.
So tomorrow is the big day, either we squash it,or we dont, either way rigfht after the motion hearing to squash the warrant, it goes right into trial....... the asshole prosecutor wanted it on the same day and told the judge we was wasting his time...
oh and the cop that got the warrant issued hes going to be there tomorrow, he was supenaed (sp?)
the last motion to hearing before tomorrow's date, the asshole prosectuor tryed to LIE to the judges face and say there was a time limit to when a peace officer could be supenaded , god my spelling is rancid
the judge didnt take his word and looked through the law books and told him thats not what it says and allowed the police officer to be supneased
not to mention the prosector said the snitch went in front of the judge himself, thats a lie too, hes trying to play dirty ball with us.
He is even trying to offer us 3 years no probation for first offender status, we even have NO arrest record.... i only have a curfew ticket when i was 16, abd even that i was setup.......
Ivwe been ratted on my whole life, all i did was go see a movie and a kid from my hockey team he worked there and i went to see a movie that went over past 11 ause of the film cut and we had to wait for it to come back up
wel right when we walked outdoors we was snatched up by undercover police officers and thus i got a curfew ticket
but ya, the prosector stated if we go to trial with his hes not allowing us to sign a 409D, which is even if we loose in trial we can still get probation, and he said if we go to trial we get 7 years.
he cant give us that amount of time with the plant numbers, only max 5 years
so tomorrow is a huge day for us, its getting near the end.......
please pray for us, I have faith in my god that things will work, he has told me from the moment those pigs busted through my door, they got that illegally, things will work out just wait......
its just scarey for me, I have alot to lose on the line. , family life my job my meds which i cant have in jail or prison......
and not being able to see my kid and my boyfriend just rips me open to no end, Im the type that has to have that family contact and time or my life just falls apart......
no matter what happens i will never regret what I have done, and if we get sent up,. i have nothing to lose and ill tell the judge that and ill be blunt but nice to him,.
thank you everyone who has been there for me, for grow help, a sholder to lean on when i was sad, for someoen to talk to when i was upset or needed another opinion, for time of legal issues and advice..... those people will never be forgotten in my mind ever.......
