DUETTE — A few tips came in to detectives Wednesday about possible marijuana grow houses in northeast Manatee County.

The next day, sheriff's detectives showed up at the front doors without warrants or evidence to ask to take a look around.

Surprisingly, the residents of two homes on the same block gave detectives the OK to search their properties, where the detectives happened upon "elaborate" indoor grow operations, each boasting several marijuana plants.

The procedure is called a "knock and talk," and any law enforcement officer can do it, said sheriff's Sgt. Dennis Romano.

Tips can come from another agency or a skeptical neighbor. As long as the investigator is at the front door, determines the person answering is a tenant or owner of the residence and receives permission to search the property, it is legal, Romano said.

"If we knock on the door and they say 'no,' we have to turn around and leave," he said. "... When you're not in law enforcement, sometimes you don't realize you can say 'no.'"

Resident permission to search a home is enough, according to Florida statute, Romano said. During a knock and talk, authorities do not even have to specify what they are looking for.

"We don't offer any more information than we need to, at least until we get to the fruit of the matter," said Romano, supervisor of the Special Investigations Strategic Unit, which conducted the two marijuana busts Thursday morning at two homes on the 30700 block of Taylor Grade Road.

Detectives got tips about the grow houses from the Hillsborough County Sheriff's Office.

They knocked, they talked and they found 24 full-grown marijuana plants and 60 seedlings, high-intensity lighting, a watering system and other growing equipment in the 30720 Taylor Grade Road home occupied by Jorge Luis Aguila-Seara, 37. The street value of the plants was determined to be about $126,000.

Authorities give every plant, including seedlings, a value of $1,500, Romano said.

About 45 minutes later, detectives moved down the street to 30710 Taylor Grade Road, where they spoke with homeowner Barbaro Lopez Hernandez, 32, and tenant Rafael Guzman Noda, 40. After being given consent, detectives found 94 marijuana plants, with a street value of about $141,000, and growing equipment in an outbuilding.

All three men signed search waivers before the detectives scoured the properties.

They were charged with trafficking in marijuana by cultivation. A bill signed into law in June to toughen penalties for marijuana grow houses in Florida makes it a second-degree felony carrying up to 15 years in prison if someone is convicted of growing 25 or more plants. The sentence previously applied to growers with 300 or more plants.

Another knock and talk at a possible grow house in Bradenton last week was not as successful, Romano said.

"The people there didn't let us in, and they up and moved on us in the middle of the night, completely disappeared," he said.


This more informal investigative procedure is common in drug investigations, as well as for warrants and many other crimes, Romano said.

"We don't always do everything undercover because it either doesn't pay off or takes too long," he said.

there is a good chance that they didnt consent. a lot of times cops will just conduct a search and then say that you gave consent. and sometimes people dont know any better, they dont know that they can say "no". its not like the cops ask "can we search your house, please?". they say stuff like "we are going to start the search now"...most people are too scared to retaliate.

Says that they signed waivers before the search. I remember signing 1 when I was young and dumb. Traffic stop, not a grow.

I have a friend who was growing at the time,who consented to a search on a knock and talk. It was several years ago during operation green merchant. He still can't really explain why he consented. Just intimidated and assumed he was caught anyway so why not consent. Dumb move he knows now.

Great thread, yet another reason to never speak to LEO just don’t answer the door.

The thing I see new from what has been discussed here is from what I can see they really had no other evidence than a suspicious neighbor. Not like the hit a dead end just decided to try a “Knock and Talk". So in retrospect if LEO shows up to your door they may have nothing else but a hunch and no other incriminating evidence.

I had LEO execute a warrant on one place, then want to search another. The other place was clean and to speed things along (I was ready to get booked and bond the fuck out versus sitting in the car for 4 more hours) I signed a waiver. I am pretty sure they have to have that waiver signed.


Knock and Talks have been discussed alot but it doesnt hurt to bring this up again.

I am also amazed how people will give in. The 3rd group, they some smart cookies leaving. They will live to fight another day
 
The sit out at hydro stores and then go do a knock and talk who fits the police profile. In Florida is a 25-55 year old Cuban male.

It's really stupid for cops to justify racial profiling.

Anything that makes life easier for the cop, also makes life easier for the criminal.

After 9/11. Racial profiling became open and widespread. What did the terrorists do? They switched to using bombers of Asian, African, and Caucasian descent.

Why do racial demographics in Maine matter to a pot grower who wants to move to California??? The entire thread was about "moving to California" and you suggested he should move to the opposite end of the country because it's whiter.

If cops in Florida profile Cubans as growers, that would be a pretty smart place for a white guy to hide under the radar.

Just a heads up, there are alot more then "Cuban immigrants" growing down here.. most aint immigrants they been here n got there residence allready :muahaha: maybe the new comers just watch over the house? lol

the cubans are NOT the reason for the laws becoming what they are.. the gov knows its one hell of a Cash crop and they want that to come to an end.. The fact that Fl comes in second to cali with indoor grows(according to news articles) is whats pushing the laws, just like cali is tryna change it up aswell..people work around the laws n thats the same ish they do in cali so there trying to stop that.

Legalize the shit n get on with it theyll save so much money it aint even funny..

Ha... I didn't tell him to go to maine because it was all white. I just told him they have really good laws and it was mainly white incase he gave a damn abotu that.. read it again and quit being so defensive because it just makes you assume the worst. Maine is one of the best places for growing bud in this country, white or not. So why move across cali if he can just go to Maine.. just a suggestion incase he had no clue.

You're either black or white where I come from. I jsut know some people like to be around their 'own kind' more so than others. If he was black, he's most likely not gonna want to move to an all white state like maine... I was just letting him know about the state in general.

And regardless of being white and not being a target in florida is irrelevant. The cubans have had a huge impact on the laws there. No matter what color you are, it wouldn't be wise to move there in this business. No, im not hating on cubans.. just stating the obvious.
