Ummm... yeah, you need a lawyer. Which would be cheaper, jail time or the lawyer?!?
I would like to think a lawyer would be able to contest their breaking into the house, especially if you had called 911 & not the neighbors. Just my take, but get the lawyer. And, yes, the card will help, depending, but then again, the lawyer. GL.

maybe you can find a doctor who will back date the recommendation
they are generally a $100-$200 set back/investment. i doubt your particular sitiuation will be discussed over the phone so you'll probably have to ask the doctor as you're being checked out if he can back date it for you. THE SOONER YOU GET THERE AND GET YOUR PAPERWORK DUCKS IN A ROW THE BETTER CHANCE YOU HAVE OF FINDING A COMPASSIONATE DOCTOR WILLING TO HOOK YOU UP. hopefully you get you photo id pronto. the longer you take the harder and more expensive it will be to cover your ass.
everyone seeing this thread should know that even if you are not growing for commercial purposes in a med friendly state, you should AT ALL TIMES NO MATTER WHAT NO EXCUSES ARE WORTHY take whatever time and money is required and get your legal documents in order before you begin your grow. don't go the way of shoulda-coulda-woulda

^ya, the messed up part is I had a appointment 3 weeks ago to get a card but my id didn't come yet so I had to reschedule

dude make sure to tell the doctor & desk that.
if you can bring a copy of the reciept for the new id from dmv they'll see the date vs when your original appointment was and maybe hook you up with a backdated rec. any documentation you can use to plead with them will only be in your favor.

Anyone know if it was legal to do this with no consent or warrant, just saying that they needed to check it others were injured?
thats what they have to do, check to see if everyone is ok. if they left without checking everyone and someone who was there kills you or hurts you more, its on the cops for not making sure everything's ok. i doubt the cops will do anything about your grow.

Even if you get a doctor's recommendation and have them pre-date that...you are still out of the legal limit on plants (if your county is according to state law, and that you are in cali).....
why do people call 911 anyways especially with a grow, actually especially with a grow without a med card.

Domestic violence is enough for police to break in.. Your hope now should be getting a doc to backdate your care like Greyskull said.... But the search was legal.. As everybody else said hire an attorney.. Something which you should have already done on retainer since you have a grow.. Even if it's legal it's in everybodys best interests to hire an attorney on retainer... It's a good way to hedge your bets... Since Federal Law still states that marijuana is illegal, all grower's should have an attorney already in line even if they are "legal."
Why would you need to wait for your permanent license in the mail? When I moved to CA I had my card in less than 48 hours after landing at the airport. Heck it only took 48 hours because I landed to late to complete things before closing time that day. I took my temp license and my hole punched 'surrendered' out of state license and that worked fine.

I am not sure what kind of damage you have to yourself, but I doubt that it is so bad you couldn't have treated yourself of drove to the EM. I mean, did you even go to the hospital?

Public Defenders usually know the ADA in charge of the case and they are better than people say(depending on what state your in), if you make sure your on them and research and do work, remember we're talking about your freedom, this should not be taken lightly. You can always say the PubDef is incompetent if you feel he is not doing a good job and the Judge HAS to give you a new one, as long as it is a reasonable time frame of when your case will be held.
I think the search was Legal but the finding of MJ is not submittable in court.I am pretty sure this is true, I would say 80% but a quick 15 min convorsation with a criminal attorney who specializes in drugs(specifically MJ) should clear this up 100%. If you don't have money for a lawyer get a PubDef and a Library card. The rest is up to you, next time you should drive to a hospital or get driven. Ambulance cost $500>, and don't say you intentionally hurt yourself, Accidents happen, stupidity is self inflicted.

public defenders arent even lawyers all they do is accept pleabargins... ususally the first one that the prosecuter waves in his face....

Public Defenders are lawyers, they went through schools and learned the same stuff private attorneys did. They just don't have the monetary incentives or deep resources that other lawyers have. They are not authorized to take plea bargains without the client agreeing to them. Usually in big cities they have a pretty full plate because a lot of regular people cannot afford hired attorneys so they opt for the easiest way out and fight for the cases they believe they can win, so their % doesn't drop too low and they get fired. I repeat, GO GET A LIBRARY CARD and look up as much info about your case as you can and bring it to the Public Defenders attention. This will show him that you aren't just some lazy scumbag who doesn't care about his freedom and is looking at him as the savior. You want to look up cases where warrants were not used but cases had evidence submitted. I don't think what happened was exigent circumstances, "An exigent circumstance, in the American law of criminal procedure, allows law enforcement to enter a structure without a warrant, or if they have a "knock and announce" warrant, without knocking and waiting for refusal under certain circumstances. It must be a situation where people are in imminent danger, evidence faces imminent destruction, or a suspect will escape."

The defendants obtained their Michigan Medical Marijuana license after their arrest. The judge dismissed the case. That's likely why you weren't arrested. Get that permit underway ASAP. Good luck!
