Dire Civil Liberties Predictions For 2014

As we come to the end of a year that saw revelations about massive government spying programs, horrifying stories of police abuse, and brazen violations of the Fourth Amendment, I thought I might offer my own grim predictions about where civil liberties are headed in the coming year. Sure, some of these may seem outlandish. But to borrow from H.L. Mencken, nobody ever went broke underestimating the grade and lubriciousness of the slippery slope.

So I predict the following for 2014:

1. Not content with their current powers to employ drug dogs and dubious accusations to engage in asset forfeiture shakedowns of motorists, some states will pass laws making it illegal to have a space in your car where drugs could possibly be hidden, regardless of whether or not you've actually hidden any drugs in those spaces.

2. Also on the forfeiture front: Taking the private prison idea one step further, prosecutors will begin hiring private security firms to pull over motorists in order to seize property for the local government. And they'll get to keep a cut of what they take.

3. Now that they've turned America's cities into surveillance societies, city officials will incredibly claim, incredibly, that using similar cameras to prevent abuse by law enforcement officers would be a violation of police officers' civil rights.

4. Big Brother will begin watching you in toilet stalls -- in order to prevent you from having illegal public sex in them.

5. Governments at all levels will start using license plate scanners to keep lists of who attends protests, political rallies, advocacy group meetings and -- yes -- even worship services.

6. It may soon become a crime merely to be in the general area where police believe other people are committing crimes.

7. It will become a crime for the police to mistakenly shoot at you while you are unarmed -- and not a crime by the police, but a crime by you.

8. College campus SWAT teams will begin protecting themselves against land mines. Not because there are any landmines on college campuses. Just because. Also, college campuses will have their own SWAT teams.

9. Speaking of SWAT teams, the police will begin using them to enforce zoning laws and property codes. In fact, in some places, the police will begin using SWAT teams to serve all felony search warrants, regardless of the crime.

10. The government will spy on you through that little camera hole in your laptop.

11. Zero tolerance policies in schools will reach new heights in absurdity, as children are suspended for using imaginary weapons.

12. Judges will start issuing warrants based on predictions of future crimes.

13. Local governments will ban people from growing food on their own property, for their own consumption.

14. Police will finally give up any pretense about "protect and serve," and just explicitly declare that they are now soldiers, and American neighborhoods are "battlefields."

15. Some states will begin paying allegedly independent crime lab analysts based on how many convictions they help prosecutors to win.


16. College kids suspected of underage drinking will be treated as if they were violent felons who had just escaped from prison.

17. Law enforcement officers will prey on the mentally disabled, tricking or coercing them into becoming pawns for gun or drug stings, then arresting them for it.

18. NSA records will be utilized by law enforcement agencies for purposes that have nothing to do with national security -- like drug investigations. The government will then destroy any records showing how those investigations actually began.

19. So long as they can plausibly claim that they're looking for a suspected cop killer, the police will basically be given carte blanche to open fire on innocent people.

20. Taking videos of your young kids playing in the bath will be cause for prosecutors to bring child pornography charges against you, effectively ruining your life and ending your career.


So as you've probably guessed by now -- especially if you clicked on the links -- the gag here is that none of these are actually predictions. They all happened in 2013. (A couple in 2012.)

I will make one real prediction for 2014: It's probably going to get worse.

Columbia’s city council decided on Tuesday to reverse its unanimous vote that would have given homeless people the choice to either go to a remote shelter or get arrested,

Runyan suggested using the homeless people’s food stamps, Social Security checks and other benefits to help pay to run the shelter, but some aren’t sure if that is legal. The shelter, which is poised to open at the end of the month, also doesn’t have kitchen facilities, so it’s still unclear how it will provide food to homeless people.

Cop Who Raided The Wrong House Tells Homeowner ‘You’re Lucky I Didn’t F--king Shoot You’ (Video)

A recent college graduate in Washington says he wants an apology after deputies in Spokane County mistakenly raided his home, with guns drawn, giving him the scare of his life.

Conner Guerrero says he noticed somebody sneaking around his yard at night and assumed it was burglars.

“Just trying to enjoy my evening. All the sudden, I see a flashlight shining through my doors…” said Guerrero. “I'm thinking this could be a dangerous situation for me.”

“I come over to my door and I slap it to say hey someone is in this house and they're not going to let you come in here,” he told KREM-TV. “Right as soon as I opened this door, and it's dark outside - it's very dark and all I can see is a pistol.”

A man yelled “Sheriff’s office” and told him to come out of the house.

“I'm wondering why the hell there is a gun being pointed at me right now! They directed me to take a knee, well both knees,” he said. “The gun [was] still drawn.”

Deputies reportedly said Guerrero was trespassing and didn’t live there. Not until they looked at his I.D. did they realize Guerrero did live there and they had the wrong home.

Instead of apologizing, one of the deputies told Guerrero, “You’re lucky I didn’t f--king shoot you.”

“We went to the wrong house, yes … after that they handled the call for what it was advised of,” said Sheriff Ozzie Knezovich. “They showed up, it was a dark house, fresh tire tracks, they were looking for a burglar.”

But officers were responding to a call about a suspicious vehicle, not a burglary.

Guerrero says he's been having trouble sleeping since the incident, but Knezovich blamed him for making it worse.

“You don't pound on a door, open it and slam it that way. Put yourself in the deputies’ position,” said Knezovich.

Knezovic says the Sheriff’s office issued an apology to Guerrero, but Guerrero wants a personal apology from the two deputies who got the wrong house.

Bigger, Badder NDAA 2014 Quietly Passed the House and Senate – and It Is On the Way to Obama’s Desk -

While everyone is distracted with the holiday festivities, Congress has been hard at work, screwing us over in the name of national security.

Yesterday the 2014 National Defense Authorization Act was fast-tracked through the Senate, with no time for discussion or amendments. And you know, its Christmastime, so they just passed it so that they could recess for the holidays. The new version of the NDAA has already been quietly passed by the House of Representatives.

It authorizes massive spending, including $527 billion in base defense spending for the current fiscal year, funding for the war in Afghanistan, and funding for nuclear weapons programs.

The indefinite detention allowed by the original NDAA is still here, and it’s actually worse now, because there are provisions that will make it easier for the government to target those who disagree. Section 1071 outlines the creation of the “Conflict Records Research Center”, where the unconstitutionally obtained information that the NSA has collected is compiled and shared with the Department of Defense. The information, called in the wording “captured records,” can be anything from your phone records, emails, browsing history or posts on social media sites.

The New American reports in detail on the expansion of powers:


For two years, the NDAA included provisions that purported to authorize the president of the United States to deploy the U.S. military to apprehend and indefinitely detain any person (including an American citizen) who he believes “represent an enduring security threat to the United States.”

Such an immense grant of power is not only unconscionable, but unconstitutional, as well.

Regardless of promises to the contrary made every year since 2011 by President Obama, the language of the NDAA places every citizen of the United States within the universe of potential “covered persons.” Any American could one day find himself or herself branded a “belligerent” and thus subject to the complete confiscation of his or her constitutional civil liberties and to nearly never-ending incarceration in a military prison.

Finally, there is in the NDAA for 2014 a frightening fusion of the federal government’s constant surveillance of innocent Americans and the assistance it will give to justifying the indefinite detention of anyone labeled an enemy of the regime.

Section 1071 of the version of the 2014 NDAA approved by the House and Senate committees this week expands on the scope of surveillance established by the Patriot Act and the Authorization for the Use of Military Force (AUMF).

Section 1071(a) authorizes the secretary of defense to “establish a center to be known as the ‘Conflict Records Research Center.’” According to the text of the latest version of the NDAA, the center’s task would be to compile a “digital research database including translations and to facilitate research and analysis of records captured from countries, organizations, and individuals, now or once hostile to the United States.”

In order to accomplish the center’s purpose, the secretary of defense will create an information exchange in cooperation with the director of national intelligence.

Key to the functioning of this information exchange will be the collection of “captured records.” Section 1071(g)(1), defines a captured record as “a document, audio file, video file, or other material captured during combat operations from countries, organizations, or individuals, now or once hostile to the United States.”

When read in conjunction with the provision of the AUMF that left the War on Terror open-ended and the prior NDAAs’ classification of the United States as a battleground in that unconstitutional war, and you’ve got a powerful combination that can knock out the entire Bill of Rights.

Finally, when all the foregoing is couched within the context of the revelations regarding the dragnet surveillance programs of the NSA, it becomes evident that anyone’s phone records, e-mail messages, browsing history, text messages, and social media posts could qualify as a “captured record.”

After being seized by the NSA (or some other federal surveillance apparatus), the materials would be processed by the Conflict Records Research Center created by this bill. This center’s massive database of electronic information and its collaboration with the NSA converts the United States into a constantly monitored holding cell and all its citizens and residents into suspects. One thing that was omitted is the amendment on the prosecution of sexual assaults in the military. So, we can all be locked up indefinitely for crimes that haven’t been proven, but they don’t care so much if military members continue to rape other military members.


The final compromise, fashioned by the leaders of the House and Senate Armed Services committees, leaves out Democratic language that would have eased restrictions on transferring Gitmo detainees to the United States — a provision that would have helped the administration achieve its goal of shuttering the facility.

It also does not include a controversial amendment by Sen. Kirsten Gillibrand to remove decisions about prosecuting sexual assault from the military chain of command. The New York Democrat says she’s secured a commitment from Reid to bring her proposal to the floor as a stand-alone measure next year. Although she may get her vote, the legislation is not expected to survive in the Republican-controlled House.

Thursday’s defense bill also sidesteps the debate over Iran. Senators who wanted to offer amendments imposing tougher sanctions were blocked because of the bill’s fast-track process, which supporters said was necessary to get it finished before the end of the year. So Iran sanction hawks’ efforts will have to wait until next year. Movement now toward stricter sanctions, the White House has warned, would undermine its ongoing negotiations to curb Iran’s nuclear program.

Senate Minority Leader Mitch McConnell (R-Ky.) suggested Reid had fast-tracked the defense bill because he “can’t stomach” a politically uncomfortable Iran vote. (source)

I was once driven along with my friend to the edge of their beat and was told I an my friend could as easily be in a ditch . tossed out our id and pocket knives and drove off. long walk lol. them backwoods cops don't play.
