Cops will then just find anything suspicious, if they want to stop you they will and claim they smelled the marijuana by driving after you. There should be a system for the coppers, meaning that before they initate the search they have to input reason and if reason doesnt match findings; they should be fined.

I read somewhere else that they will just use section 5 of the Misuse of Drugs act to get an illegal search instead. So instead of section 44 its section 5 now. All you can do is to deny them the search EVEN if you do not have anything on you. Deny them the search especially if you know that you have nothing and then challenge it in court. If enough people challenge this in court they will have to be more careful about whom they search as they might get bitch slapped for saying they had reasonable suspicion when none was present.

what is the bitch slap officially called? does it actually do anything like punish or fine them? or do they continue to walk on smugly knowing that they are above the law.

This is great advice, and the only way to deal with police. As soon as you give them your 'name' or 'legal fictional title' to better describe it, they have the jurisdiction to do whatever they want to you - i.e. s5968 of the Daring to be Different Act 2011 etc. The only way to safely deal with the police corporation is to decline to contract with them.

Once the admittance from your own mouth arises that you are a 'person' it's game over, and steamroll time. It's usually the same scenario at this point... Law enforcement agencies are a for-profit corporation with targets to issue as many revenue generating orders as they can in any given shift. They are gonna try and pin the worst charges they can so what have you got to lose.

As soon as you hear the magic words - 'You have the right to remain silent, anything you say MAY be given in evidence'. This is your cue to say nothing from now on....NOTHING! MAY actually means WILL. If you feel the situation is hitting a stalemate and agression is being threatened, you can always agree to perform an action 'UNDER JURESS & PROTEST'. Make sure this is clear and clear on anything you are FORCED to sign (as you obviously don't want to be signing anything!)

I guess we all have to handle these situations as they arise as you can never predetermine the variables of stop & search situations, some LEO are more agressive than others (probably because they haven't hit their arrest/sales target for the day), but what you can almost guarantee is that they are relying on your desire to avoid inconvenience, lack of comprehension of the law and above all your fear to control interactions and proceedings. I think only when we work on these things will we really start to see a change in LEO behavior. :2cents:
