I was scanning through the norml.org website looking at the various laws from state to state regarding cultivation. I know some of the states are extremely rough when it comes to sentencing. In these states its seems like being charged in the federal court system would get you a lesser sentence.
Is there something I am missing here? Everyone always talks about making sure your plant counts are small so you will stay within the state system but in some cases, like the eastern and southern states the federal system looks more lenient to me. Anyone care to fill me in on what i'm missing here?
How does a state decide to pass the case over to the federal courts? Let's say you get busted with 150 mature plants and another 50+ in veg plants and mothers... Is it pretty safe to say your case is going federal no matter what state your in?
Lastly, Is there any state that you may likely get probation, fines community service if its your first offense with the above mentioned number of plants? I highly doubt it but no harm in asking lol.
