splitting possession as a defense?

lets say you and another person get pulled over with 25# in the car and get busted. Trafficking which carries a higher penalty is 20#. If forced to go to trial, would a valid defense be half was mine, half was his? product was in 2-3 bags in a box

I'm guessing they will say the two in question were partners in an operation greater than 20#.

Yea, just because they apply one pound to you, doesn't mean they aren't allowed to put it on someone else. You both get charged with the same amount, regardless of who cops to who...unless one person cops to the entire thing.

There's no such thing as "one pound was mine, 24 were his"

I hate to say it but you are both gonna get the rap.
Well that is if both are stand up guys, which is uncommon now days. Either that or one takes the rap and the other assumes the debt, which is even more uncommon now days.

All the more reason to keep your shit to your self and keep your mouth shut. Then if you do get busted then at least you know it's you own fault.
