So Canada Customs has my seeds...........

You're likely not going to get your seeds.

The real reason they stated "seeds for human consumption" in your letter IMO is that "sterile hemp seeds" and "fibrous stalks of the cannabis plant" are the only parts of the cannabis plant that are NOT illegal, and are exempt from the CDSA (controlled drugs and substances act). All other parts of the plant are considered marihuana.

Seeds for human consumption are subject to regulations involving the importation of any foods. Since yours aren't likely packaged in an acceptable manner with nutritional values, labeled appropriately by the country of origin etc, they likely won't allow them in on that basis alone.... they'd be sent to the CFIA (Canadian Food Inspection Agency) first... I'm sure they'll find some reason they can't let you have them- ie you didn't follow proper food importation procedures.

If they are not for food consumption and will germinate, they are 'marihuana' under the Act, and thus would be subject to confiscation and disposal. You could try to argue that you are licensed under the CDSA section 56 / MMAR to posses seeds (did you obtain your permit/license to possess seeds form E2?) - since by their own definition seeds are 'marihuana' and you are licenced to possess marihuana as a holder of a DGL/DPL .. but honestly this isn't a license to IMPORT seeds, which is what you are doing. This is the crux of Marco Renda's claim against HC for the seeds he illegally tried to import, which are still in Canada Customs' possession.... but a simple license to import is very different for a specific license to import a controlled substance, which cannabis seeds are technically. I personally think you're damned no matter which way you try to play it.

Your path of least resistance is to have your friend in Brazil resend, with a better packing job.

Is it because of the senders location that they were tagged? I have ordered seeds from the UK several times and always get them.

they would probably say its a random check but originating country is a big deal.

Just wanted to know what happened with the seeds and customs man. Canada customs sent me a similar letter stating that they were in possession of a letter addressed to me and wanted my permission to open or they return to Canada post to be dealt with as regulations state. I kinda tripped out and am wondering how it all worked out. thanks

I have researched Canada post policy in relation to this matter. From what I can understand is, once the mail is returned to Canada post corporation from customs Canada post deals with it as undeliverable mail. With undeliverable mail they seem to have three choices. 1-They can open and destroy contents. 2- They can return to country of origin to be delt with there as "undeliverable mail. 3- They open and forward contents to police if in violation of any Canadian acts/statutes/laws.
I am very interested to know how they deal with seeds when found in this matter. That is why I asked what to expect. thanks

I second that. You don't look any more innocent or guilty by justing saying "fuck it". I guess it depends if it was thousands of dollars but a hundred or two id say fuck it and buy locally within Canada from now on or have a buddy import it for you.

Canada customs can be funny about a year ago I ordered a one once floramite from the US when I received the package it had been opened by customs, and the vendor had written "this will keep the mites off your buds" on the invoice and still the package made it to me

We will be addressing this seed issue when we go to court with Health Canada on November 23 2011 in Toronto. Canada Customs has over 7,000 packs of my seeds and they want to release them but Health Canada is stopping them.
