This totally sucks. I have paid $480 for a new xbox360 and games etc on ebay which is never going to arrive. The seller claims they have been scammed by some website in china!? :cuss:

To top it all off now the seller is claiming non-payment!!! But i have the receipt when i paid money into their account...

Facking bullshit.

scan the receipt and send it to ebay to start with, and ebay should have a record of your transactions, and if you paid with a money order or check you can verify if and who cashed it. even paypal should be able to help.

that sucks but i hope it works out dude.

Contact the seller and remind them that the contract was between you and them and not you and their supplier. Explain that since they cannot fullfill their order, then they should pay the money back into your account and that if they dont you will a) alert the police b) alert ebay c) begin legal proceedings against them to recover your money, compensation for your legal fees, and compensation for your time. But send this letter to their home address rather than the ebay email address. If you are doing business with someone who is hiding behind an email addy and no registered business address ( which leads to their home addy), then sorry, but you took your chances.

Agreed with GMT -

You may also want to do it formally, which means via mail - also, make sure you CC at the bottom your lawyer, ebay, and if you want, the police.

I feel really bad for you bro, I would be fuming too! This is always why I was too hesitant to ever go on ebay...hope things work out for you mang.

All i know is the womans name and her bank account details. She is a private seller and ebay dont give out adresses... she even has a 98% reputation and sold 280 items.

2 other people were "sold" the same in a lot of 3.

I have initiated the claims procedure but this will take ages to drag out i am sure.

I was even ready to believe her bullshit until she claimed non-payment. HA!

Yes, they do. Address and phone number. As long as you've had a transaction with them, ebay will give you the info. You have to request it though.

you need to get her address and contact the local police department to pay her a visit,
(and dont call me a rat, this is my cash money that got swindled)
i collect vintage diecast and last year someone stiffed me on a $400+ hot wheel, after seeing that ebay could give a shit less, I faxed all the persons relevant info & emails & i got the local law in the guys hometown to visit him and actually got what i paid for, turns out it was some teenager selling off his dads collectibles that had died earlier... and was ripping every other person off he sold to...i do believe its classified as mail/internet fraud...

Im with longdivision. It aint ratting at all. Get the cops involved. And yes, ebay will give the the persons personal info as long as you bought something from that person. Goodluck.

Yeah, they'll help you out, and also a persons reputation and sale history doesn't necessarily mean anything, they can easily have their friends give them rep or just make multiple accounts and give themselves rep, at least they used to be able to. don't know about now I don't mess with that b/s. Good luck, and they obviously have your money so make sure they understand that the police are involved. Chances are they'll send it right back to you.

Ebay goes through great lengths to prevent fraud. Even if the guy was legit and was drop shipping. As these guys mentioned, because his drop ship fell through, that doesn't mean a thing. It was a contract between you and him - you either get the product as advertised or your money back in full. Copy everything you have - receipt, emails, etc. - all contact and notify ebay. They will do everything they can to help right the wrong.

They take fraud very seriously, it's why they grew into the giants they are Today.
