9 cops rolled up to my house, I happened to be outside at the time so I got to chat with them for 45 minutes while I decided what to do. I've been around the block, done time and am aquainted with the assfucking legal system. They didn't have search warrants so for 45 minutes we danced around the idea of me giving search consent. They said another cop has been trying to get me raided for a year and a half since I pissed him off big time when a xfriend got busted over some other crap. This xfriend gave himself up so they wouldn't look at all our residences for that evidence and see my grow back then. Good for him but then they tell me he turned around 6 months later and ratted me out for the grow to reduce his sentence. Blah blah blah they tell me other stuff that they know which was pretty accurate. So I'm standing there listening to all this from the lone DEA agent, he played both roles as good cop bad cop For christmas you get one choice of what's behind two closed doors. Door #1 Consent to search- we go in chop the plants, take your equipment and stash and look around. No arrest and a receipt for what we take. Up to the DA what you are charged with. Will recieve a summons in two weeks.
Door #2- cops stand outside the windows to watch me while they get the search warrant. Then they bust down the doors, use flashbang, and destroy my house during their search. Arrest and spend at least one night in jail waiting to go before a judge to bail out.
So having been around the block I don't believe them, I still didn't want to give consent. I'm thinking he's lying and maybe they'll all leave and I can destroy the grow Then i see myself with tampering with evidence on top of the grow besides getting my house destroyed and a night in jail. I also know that best case is they leave then come back, bust in, flashbang and destroy and try to build a case about other crap they know.
So I broke weak and consented. ( this is where ya'll say "you dumb fuk").
They were polite and respectfull. I showed them around and they asked before looking in any drawers etc. Took 50 some plants, equipment, QP stash and left.
Now I wait for paperwork in a few weeks. No guns but prior felonies. I'm not really blaming anybody but myself so
I knew this day was coming for 18 months because that cop back then told me this day was coming and he would see to it. I could have chopped and quit lotz of times since then but oh well, I lika to grow and smokea da weed.
If ya know yer day is coming then for sure it's coming.
I probably should have shut up and let them do what the hell ever they wanted to or could do, but I was well aware that today I was gonna spread my cheeks, one way or the other. another grower down, I"ll keep ya posted while I wind my way thru the entrails of the beast. peace and merry christmas.

sounds like not only a great way to lose a case but for departmental discipline and a lawsuit

after my ratted me (i got out b4 the hammer dropped) and during some real bad times the cops where here several times

youd be surprised how fast they change their tune when you assert your rights like a commanding officer be present and a legal rep

seems the threat of incarceration during Christmas was a heavy weight in their favor

i say this as food for thought to the person ho reads this and has the unfortunate encounter

in the end if you don't have money or the legal background to fight the good fight they make have won in a war of attrition and punished you by pushing the punishment envelope

it puts the hobby grower in a precarious spot because many grow out of the need to reduce the financial strain og having to buy pot so who's a few thousand to retain a lawyer and prepare for the potential possibility of arrest anyway

it's the common wisdom to deny searches, but i'm not so sure that you didn't make the right choice
9 LEO's and a DEA guy? damn that's intimidating!
not sure how it will work out, but it sounds like they may be good to their word and no local charges, just federal to worry about
and 50 plants can't be that high on the federal list, just my guess and hope for you

This is not federal, they don't take any MJ cases around here with less than 100 plants. He was hoping to find guns or meth or coke. I am looking at a state felony and misdomeners though. I have prior felonies and plenty of allegations in their folder on me to make any DA drool at the thought of extracting the max blood anyway he can.
The DEA was an exmarine dressed in full battle gear, camo and black with his short machine gun hanging on his chest like he just stepped off some street in Iraq. He had a long beard and was wearing a black knit cap with a big old german Iron Cross emblem. Every growers nightmare santa.
Ya'll know I'm sitting here replaying yesterday wondering if I should have opened door #2 yesterday. Or done anything different while going through the bust. No way of knowing I guess so I'll probably always believe I should have taken that other door, especially on the beatdown day that is coming. Then again I'm pretty sure no matter what door I'd have chosen, I'd still be spreading my cheeks in front of a judge.
The plants were in dirtbags, they chopped the stem right at dirt level and said they will weigh it up wet and charge me with 1/6th of that total weight.

They would have already had a warrant if they had definitive proof of what you had going inside, no talking and bs just knock down door and come in. You should have NEVER consented man, you made their job way easier. When I lived back in NJ before moving to Cali I once had a whole narcotics team at my door demanding to come in and trying to see something in plain view which would have given them probable cause. Long story short, I told them no thank you and closed the door. Nothing more ever came of it and no warrant was ever granted because there was simply no probable cause to get one.

Let me repeat, NEVER consent.

If they are asking for permission it's the only option they have.

QFT. Had a friend who had a similar problem with a police officer in my city. Cop told him he would get him to his face. Two years later and after having been pulled over quite a few times by this cop(no tickets no nothing) my friend called in the anonymous tip that this cop happened to be running drugs for the coke kings in my city and working security for them. The pig is still oinking his ass off in the pen. Turn the tide on em man.

This is really sad bro I wish you the best of luck. Especially at the holidays these fuckers never let up. They use these intimidation tactics when they have no real proof and want to bust you. It's an old documented technique.

They show up in full force and threaten you with this and that and try to get you to consent to a search. This is when you must hold strong and shut the door in their face! Like SOTF420 said if they had any real proof they would have kicked in your door with a warrant and flashbanged you!

Well if you can establish that happened you can show that you didn't consent voluntarily, because that's coercion, and you can't do something voluntarily under threat. The problem is establishing that it happened, because the cops likely won't admit it.

I stood where you were in 1992, with the cops outside my door asking permission to search so I know how it feels. I guess I was 'lucky' because that was in VA and I knew I was going away for a long time if I said yes. I'm not sure I wouldn't have done so had the cop persisted another few minutes, as I was on the verge of giving in when he gave up. But they did go away and never came back.

Time for an update. I got charged with 4 felonies. I hired a good lawyer. Pythagillo- the lawyer used the coercion angle in negotiations. The cops had recorded it all- I refused multiple times to consent to anything without talking to a lawyer first.
It's been looking bad mostly because I have two prior major felonies on my sheet already. They started out with 2 years each on the new felonies, then droped down to 2 years to plead on one felony, then a misdomenor with SIS, $3000 fine and 3 years probation and 60 days in jail. I DID NOT want no 3 year probation so we countered with me to take a felony and $3000 fine. They accepted and I'm one happy muthafucker. So bascially I'm out $10,000 and equipment. Also I'm totally fucked should I ever get my fourth felony.
My lawyer seemed to think (under my circumstances) they would have stayed on my property till they got the warrant if I would have refused. But I'm thinking anyone who faces a situation like mine should just tell them to show the warrant or leave. IMO
