So say I get probation and don't go to prison (misdemeanor possession nothing big)

Just what the fuck happens?

I hear the P.O. can just search me and my stuff anytime they want?Is this true?

What happens If I take a piss test, pass. Then they get suspicious and give me a blood or hair test and I fail? Would they charge me with trying to cover it up? Are detox drinks illegal for me to have?

Can they search all my stuff I.E. My computer, my phone records, credit records (things I buy) stuff like that?Do I need to toss this hard drive and delete the account?

Do they give you jail if you slip up and test positive once? Or is there usually a warning system?

Can they just bust in on me while I am sleeping, wake me up and make me take a piss test?(lol)jk

You can get Search and Seizer. That means they can search you, any car or house you are in at ANY TIME. If you are on parole the P.O. can search the house w/out giving you notice. Depending on your probation/parole three positive test will violate you and you will go back to county or prison. If you are HOT and facing any possible time.. Stay off your computer, and NO photos of MJ. A hard drive and be confiscated and if they wanted they could find old files.

Not 4 sure were ur at (don't tell us) but here they can test you 24/7 as for checking ur comp. phone records,etc... For simmple poss.I don't think so but hell they prob. can do what they want If your worried about ur comp. get it out of your house and store it somewhere just to be safe ,phone records you can't do anything about. clean ur house out they can show up at any time and a roach in the ashtray, or smell of bud could def. make them look futher into it ..GOOD LUCK. O and failing a piss test could result in them revolking ur probation and u start ALL over and could mean more charges.

If youre under probation your house and any of your possessions can be searched, this also includes computers and storage units. There is however from what I am aware of a clause saying that they cannot do it at any kind of weird hours unless its with previous notification. it really comes down to where you are and what kind of probation officer you have.

I was on probation for two years a decade ago. (originally 1 year but I violated it, the event it was violated by happend before even got put on probation, but was discovered after the fact and thus my past came to haunt me).

Also this was not drug related, this was violence related, but more than the typical 'domestic disturbance'.

Not sure if they have the right too. But probation officers are not cops. If they wanted/needed that kind of evidence they would do it before you go to court, not after you have been punished and are probation. This is not to say if you give them a reason they wont search, but I never did and nothing of mine ever got searched.

If they are testing your piss (which they most likely will) they aren't going to miss up the testing methods on you, most likely it will be piss the whole way through. Your blood will be clean before your piss will. The same is not for hair but hair can show drugs for a very long time and it would be stupid to test you for drugs you did a year ago which do not relate to this time period.

However during the end of your probation it is possible for them to hair test you but they would probably only look at the time on your hair from when your probation began (a hair is like a time line of your drugs) so if you don't do drugs during your probation you'll be good. I was tested every two weeks at first and then every month, and then every two months. Detox drinks are completely legal there is nothing they can do about those. However, I would not do any drugs

Like I said in the first post, after you get on probation this is after you go to court. Don't give them a reason and them searching your shit is extremely unlikely especially in your circumstance on being charged for paraphernalia.

Violation of probation, it depends. Jail time on your first slip up, not likely. But they do have options. When I was charged for violation I turned a year probation into two. I was also on house arrest for one month. I also was drug tested a lot more frequently for the nest 6 months. Basically in attempt to catch me a second time/violation in which case your consequence could very well be jail time plus extended time of probation/house arrest.

No joking here. They sure can. My officer came in one time at about midnight and drug tested me. He only did this once though, and it was early in my probation. I think he wanted me to know that I could be tested anytime, anywhere. Sometimes, at random your officer will check up on your whereabouts to be very careful. They like to know where you are and what you are doing from time to time. And they will visit you.

Here is the deal and you need to listen closely. This is a very by-circumstance situation. A lot of things matter. The kind of probation officer you get is probably what matters most. Take it from me, step up be a man and fucking get it over with. Don't be a fucking retard smoking weed trying to detox yourself and shit...luck travels in all directions. All it takes is one fuck up. Do not give them any reason to make your life hell. Be a good boy for however long you get. Make them see that they are wasting their time on you. It is not worth fucking up trust me it goes in a downward spiral. Quit doing any drugs and any non acceptable behavior. Do not smoke, to be able to smoke another day. Just trust me do what they say, do your time, try and get a 'good behavior' report and it will get easier and easier. Don't do stupid shit.
 
they arent going to do a hair folicle test.
i doubt u even get probation with a misdemeanor but i dont know if you have priors . usually its just a fine and maybe a drug class.
when in doubt, GET A LAWYER
 
It's mostly like how kinderfeld said. Yes they can search you without warning or question. But it's usually when they have a suspiscion. It's all in what po you get, how long, what for, & how you are adhering to your stipulations. If I were you I wouldn't worry, you only have a misdemeanor. I have a felony poss. & I can't even fail 1 test, threaten anyone, leave the state, lose my job, be out pass curfew(10:00 P.M.), not pay my monthly dues, or not go to my court appointed drug classes. If I do it's over & I'm going back to county. & thats called an intensive probation. Gotta do that for a year, outta 4, before I can relax a little.

So here again it's like kinderfeld said don't be careless & do anything stupid. Just go with the flow slow walk it down.

It really depends on the state guys. When I was on probation in VA in the early 80s and 90s (yes twice) there was no 4th waiver. There's 50 states + the Feds, makes 51 different sets of rules.

Didn't you get any paper work from sentencing in the court. It should detail the conditions of your probation. If not call the lawyer you had and ask what the conditions of your probation are.

Yes there are 50 states but trust me you basically lose all rights under probation or parole. They can and will search your house car anything that is yours if they get imformation that you have something to hide. They also can drug test you whenever and wherever. I had a friend who got piss tested at his work, how imbarrising. They can use a number of different tests including hair and saliva, also BREATHALIZERS. Thats a big one many people on probation and parole are not alloud to consume alchol. Its often overlooked and could possibly nail you. All tests also test for alduterants. The drinks dont work, the shampoos, none of that works and could get you in even more trouble. Alot of people like to argue with this one but don't take the chance they dont work! Not every drug test they submit gets sent out! Depending on the budget of the county or area you are tested in, some tests they simply take and either never send to the lab or just use a dip-stick test in office. They do this partially to keep you on your toes. Also if you are male or female comes into play sometimes when given drug testing. If a female Parole or Probation officer officer has been assighned a male, she may do either one of two things. She may send a male officer into the bathroom with you to watch you take the piss test, or she may give you a different kind of testing, hair, saliva, blood. I have had a few friends get nailed because they prepared themselves for a piss test, by drinking large quantities of water, or using those drinks, and then go to the office and get mouth swabbed for a saliva test. It happens all the time. I even had one friend show up wearing the Whizzanator and failed the test because his officer gave him a saliva test. Just stay clean, hold a job, and NO NEW CHARGES!. If you fail a drug test or get a new charge depending on what it was or on your probation officer they may or may not violate you. A friend of mine was on probation and got a D.W.I and his officer did not violate him. This happened partially because it was a traffic matter, and also because he called his officer and told her right away. If you ever pick up new charges, (even municipal..) always tell your probation or parole officer. THEY WILL FIND OUT ANYWAY. And being honest and forthcomming may keep you out of jail while you go to trial. I had a friend get new charges, he was let out on bail. He then called and told the officer, because he did that the officer said, "thank you for telling me i already knew and i appreciate your honesty". When he went to court he took the case to trial and his officer let him remain on house arrest instead of in jail while the trial took place. The procecution dropped the charges and he was never violated.. Moral of the story. Say clean, Stay workin, And No New Charges!!! Goodluck brother....
