As far as the legality it seems to me this thing is the same as the drug test strips that you can run on the hands and face and it changes color if residue or yes even smoke(on the face) is found. These are legal in Europe but have been shot down in US court because you could pop positive for coke if you handled a few hundred dollar bills.

What i wonder about is they say it's already been used in two busts but i highly doubt the scanner evidence will be used in court. Believe it or not America still has some rule of law. I wouldn't worry about this to much right now. If your in a room with people smoking your positive. Say you break up weed or just shake hands with some guy who just got done fondling his buds growing in the back room, you will test positive.

Defense attorneys have gotten people off for far less and all it takes is a judge who has read 1984 and believes in the law(they do exist!) Notice how the article had no comment from the district attorney. They might use these like lie detectors. Just a tool but not for trial.
