U.S. Attorney Laura E. Duffy, whose district includes Imperial and San Diego counties, said marijuana advertising is the next area she's "going to be moving onto as part of the enforcement efforts in Southern California." Duffy said she could not speak for the three other U.S. attorneys covering the state, but noted their efforts have been coordinated so far.

This looks like state, not federal initiative.

Duffy has apparently taken that as a license to go after publishers as well:
Duffy said she believes the law gives her the right to prosecute newspaper publishers or TV station owners.


"If I own a newspaper ... or I own a TV station, and I'm going to take in your money to place these ads, I'm the person who is placing these ads," Duffy said. "I am willing to read (the law) expansively and if a court wants to more narrowly define it, that would be up to the court."​



Sounds like Duffy is interpreting law, not necessarily receiving federal directive.


... Duffy allows that the law that legalized medical marijuana had "good intentions." But those good intensions, she tells California Watch, "have almost completely been taken over by people who are trying to use that permission law to get rich, to distribute marijuana and traffic drugs to people who aren't sick, to our youth and to people who are using drugs on a recreational basis."


Does this mean Duffy wouldn't go after non-profits? Sounds like making bank is the onus of her actions.

This is absolutely ridiculous that in her mind she has nothing better to do than try to squash marijuana use and industry. It is just so frustrating that the "educated" "respected" and "successful" people in society are just so damn mind numbingly ignorant to the uses and benefits of marijuana and hemp. Like what the fuck?

Just imagine if all this drug war money was put into education or other areas of law enforcement. They fly fucking helicopters day and night with FLIR technology and send heavily armed task forces through the forests of California yet our response to armed robberies is taking a description of the suspect on a notepad and then going to get coffee and donuts. Maybe review the security tape the next day, if there is one.

In declaring the law unconstitutional, the Court reiterated that "although the Twenty-first Amendment limits the effect of the Dormant Commerce Clause on a State's regulatory power over the delivery or use of intoxicating beverages within its borders, the Amendment does not license the States to ignore their obligations under other provisions of the Constitution."

Furthermore...

"In the federal law, an exception is made for ads that advocate the use of illegal drugs but don't explicitly offer them for sale or distribution. Newspapers, Panzer said, could argue that they have a right under the First Amendment to run the ads, and any "prior restraint" before publication is itself illegal."

Hopefully one of these publishers will call their bluff and ride this one to its conclusion in court, cause its a wildly strong First Amendment case.

yea this is absolutely mind-fucking....this dumb bitch has nothing better to do than waste money going after things that GENERATE SMALL BUSINESS MONEY! the article even says itself, without the extra revenue from MMJ advertisements they would have to lay off writers and staff...

MMJ is so crucial to many aspects of local economies....

i guess all the cocaine and human trafficking going on in San Diego keeps the local governments paid pretty good, so they get bored and attack MMJ.....
